ence President Dr Farooq Abdullah on
Wednesday said that peace in the Valley
cannot be held ransom to elections in

clueless as to where from the threads of
restoring normalcy are picked up, which
is why even teenage boys and elders over

ty Act on the charges of pelting stones.

ing over the atmosphere of fear gener-
ated across the Valley.
The NC chief stressed the need for
Indo-Pak dialogue, saying war hysteria

Vajpayee saying that even after Kargil
incursion, he gave chance to talks and
invited President Parvez Musharraf for
dialogue in Kargil, as he believed that
friends can be changed but not the neigh-

A private vehicle was gutted in a myste-
rious fire in Sadrabal area of Srinagar city.
Reports said that a Scorpio, bearing registra-
tion number JK01W 36, was parked outside
a local workshop when it went up in flames.The
vehicle was parked on a roadside. Suddenly
it caught fire. Nobody was onboard when
the incident happened, said an eye-witness.
The cause of the fire was not immediately
known.
Government Forces foiled Soibugh free-
dom march for which people had made all
the arrangements.
Witnesses sadi that all roads leading to
Soibugh village in central Kashmirs Budgam
district were sealed by the government
forces to prevent a pro-freedom march called
by the resistance leadersip on Wednesday
morning.
Reports and witnesses said that all the
entry points to the village had been sealed
with army manning the barricades. Accord-
ing to eyewitnesses despite the restriction
people in large numbers assembled in the
main chowk to participate in the pro-freedom
rally. The rally was addressed by a number
of speakers who urged upon people to follow
protest calendar in letter and spirit. They
appealed people to show loyalty and stead-
fastness towards the ongoing freedom
struggle.
Clashes erupted there after government
forces resorted to aerial firing to put a stop
to the pro-freedom rally.Reports and wit-
nesses said that the rally attended by over a
thousand people was nearing its end when
forces raided the area.
They fired in air and used teargas shells
to thwart the rally, said a witness. This
triggered clashes. Reports said that youth
responded with stones while the clashes left
many people injured.
People of Warpora area of North Kashmirs
Sopore town on Wednesday said that men
in uniform on Tuesday night raided the village
of and resorted to ransacking. The locals said
that the forces came around 1:30 AM and
ransacked private property before arresting
an 18-year-old youth. The detained youth
was identified as Masraf Majeed. He was
arrested from his bed.
Soon after the raid, people came out
from their houses protesting against the raids
and highhandedness of forces, local said.
Forces fired tear smoke shells indiscrimi-
nately.
The locals said one tear gas shell landed
inside home of a lady who had given birth to
a baby a few days ago. A police official feigned
ignorance about the incident.
Agitated protesters smashed windowpanes
of scores of private vehicles at Hajin Sonawari
area of Bandipora district when government
forces arrested a butcher whom locals iden-
tified as Ghulam Ahmed Dar. Earlier Batagund
village was cordoned off by the forces and
later on they picked up Dar from Gulshan
Abad area. The detention of butcher sparked
violent protest while agitated youth resort-
ed to massive stone-pelting damaging
window-panes of scores of private vehicles,
said an eyewitness.
In an apparent reaction to those defying
shutdown call, a passenger vehicle was set
ablaze in North Kashmir. Reports said that
unidentified persons torched the Scorpio
vehicle, bearing registration number
JK05:1031 in Delina area of Baramulla district.
Reports from South Kashmirs Pulwama
STATE

to foil Pulwama to Newa freedom march
cordoned off the whole Newa area while
agitated youth pelted stones on them result-
ing in the clashes. Locals told news agency
CNS that CRPF and Police showered tear-smoke
shells and pellets on the protesters resulting
in the injuries of 4 persons. One of the youth
suffered pellet injuries in the eyes and he
was shifted to Pulwama hospital.
Massive protests were staged in Arihal
area of Pulwama district on Wednesday.
Locals alleged during a night raid in the area,
government forces damaged houses and
other properties while to counter the action
of the forces people took to roads in the
middle of the night and chanted pro-freedom
slogans. Forces used tear-gas canisters to
disperse the protesters. Reports said that
during morning hours, a large number of
people again hit to roads and organized a
massive anti-India protest. Forces rushed to
the village and used pellets and tear-smoke
shells to disperse the protesters. Witnesses
and reports said that 7 people were injured
in the clashes.
90 people, majority of them youths, have
been killed and over 14,000 injured in the
ongoing unrest in Kashmir since July 9, a day
after the killing of top militant Burhan Wani

ma and MLC Firdous Tak accompanied the
Chief Minister on her visit to the area.
As many as 126 families have been af-
fected due to the Saturday night blaze in
which 80 residential houses and an equal
number of cow sheds and other structures
including shops, middle school, Masjid, An-
ganwari Centres, Sub-Centre and over 400
cattle and sheep perished.
During her visit, the Chief Minister as-
sured the affected villagers of all possible
support from the Government for their wel-
fare and rehabilitation.
The Chief Minister announced various
relief measures including free ration to every
family for a period of 6 months, Rs 9450000
under IAY (Rs 75000 per household) in favour
of all 126 affected families for reconstruction
of individual houses, and 3 months rental
for accommodation during the winter months
at the rate of Rs 3000 per month per af-
fected family.
The Chief Minister also announced Rs
1.25 crore as relief under SDRF for the af-
fected families, comprising Rs 101900 per
house in hilly area including damaged hous-
es, Rs 1800 per family for loss of clothing, Rs
2000 per family for loss of utensils/ household

goods, Rs 30,000 per Cow/Buffalo or any
other milch animal, Rs 3000 per sheep/goat,
Rs 25000 per horse/bullock, Rs 16000 for
calf/donkey/mule and Rs 50 per poultry bird
upto maximum of Rs 5000.
During the visit, the Chief Minister also
directed the district administration to provide
Smokeless Chullahs and Solar Powered Lan-
terns to the affected families.
Pertinently, Rs 4000 per family out of
Red Cross, tents, kitchen sets, ration kits and
quilts have already been provided as im-
mediate relief to the affected families.

to the notice of the then Prime Minister Dr
Manmohan Singh publicly in Anantnag by
Omar Abdullah, emphasising that Kashmir
problem was not all about jobs and eco-
nomic packages. Again, he said, the Opposi-
tion parties led by Omar Abdullah apprised
Prime Minister Narendra Modi about realities
in the Valley, who in turn agreed the nature
of problems being political.
If Modi really believes what he told to
the delegation from Jammu and Kashmir he
should walk the talk, Dr Abdullah said, add-
ing that this will be in the larger interests of
Kashmir and rest of the country.
The NC chief referred to border skir-
mishes and the fear psychosis prevailing
in forward areas due to shelling and ex-
pressed his partys solidarity with those
required to abandon their homes and hearths
quite frequently. He said the border dwell-
ers were braving main brunt of the hos-
tilities between two neighbouring countries
and hoped the situation to normalize soon.
He exuded confidence that these skir-
mishes would not get converted into war,
which he said, is not in the interest of India
or Pakistan.

Ali Mohammed Sagar and Additional
General Secretary Dr Sheikh Mustaffa
Kamal also spoke on the occasion and
exhorted party workers to meet the chal-
lenges faced to the state with courage
and fortitude.
Sagar and Kamal said that National
Conference has all along stood for religious
amity and regional unity of the state, even
during most turbulent times, and hoped
that the people will carry forward this
legacy of Sher-e-Kashmir Sheikh Moham-
med Abdullah to maintain harmony across
the state.
MLA Mendhar Javed Rana highlighted
the problems faced to the border people,
saying the PDP-BJP government has failed
in mitigating these. As a result of wrong
policies and lack of political vision, the peo-
ple of the border areas in particular are feel-
ing left in lurch, he added.

tions draft resolution that denies
Jewish connection to the site.
The resolution, which con-
demns Israel for its activities in
Jerusalem and the West Bank,
asserts that Jerusalem is holy
to three monotheistic religions:
Judaism, Islam and Christian-
ity. However, it includes a spe-
cial section pertaining to the
Temple Mount that says the site
is sacred only to Muslims and
fails to mention it as sacred to
Jews. The resolution from the
United Nations Educational,
Scientific and Cultural Organi-
zation does not refer to the Al-
Aqsa mosque by either the
Hebrew term for the siteHar

Newly-appointed Jammu and
Kashmir Bank chairman Parvez Ah-
mad has said that the state govern-
ment-controlled lender was ready
to offer Islamic banking, if the Reserve
Bank of India approved the move.
Ahmad said there was a strong
demand for such banking service in
Kashmir but RBI would need to ex-
amine the proposal. There is a lot of
demand for Islamic banking in the
state. We will examine the proposal
and we have to also take RBI on board,
he said. Currently , there are no guide-
lines for Islamic banking, which is
based on the principles of not charg-
ing interest.
Recently, RBI had suggested that
it would review the norms. Towards
mainstreaming these excluded sec-
tions, it is proposed to explore the
modalities of introducing interest-free
banking products in the country in
consultation with the government,
it had said in its annual report.

SRINAGAR: Minister for Education,
Naeem Akhtar, today said that efficient
teaching system would ultimately
improve education standards in the
State.
He said this while chairing a meet-
ing to review progress of various
works under the Rashtriya Uchhatar
Shiksha Abhiyan (RUSA) aimed for
betterment of higher education in
the State.
The Meeting was attended by Com-
missioner Secretary Higher Education,
Asgar Samoon, Director RUSA, Direc-
tor Colleges, Registrar of all State Uni-
versities, Nodal Principals of Amar
Singh College Srinagar and GGM Col-
lege Jammu, Nodal Officer Cluster
University Jammu and other concerned
officials.
During the meeting, the Minister
was informed that almost 60 percent
of physical work has been completed
on various projects taken under the
RUSA project. It was further added
that Rs 54.46 crore was spent on var-
ious components of the scheme under
State Higher Education Plan (SHEP)
till September 2016 against the total
availability of Rs 89.29 crores. Of them
Rs 77.55 crore was released as central
share by MHRD and Rs 11.74 crore by
the State Government.
The Minister urged the concerned
officials to complete the projects
within the stipulated time and impro-
vise from time to time for the benefit
of students.
It was given out that Cluster Uni-
versity Jammu has received Rs 17.74
crore, whereas Cluster University Sri-
nagar has received Rs 17.48 crore.
Speaking on the occasion, Naeem
Akhtar directed reframing of various
courses to be offered at the cluster
universities so that they will become
as seed bed for entrepreneurs. He said
that besides handicrafts, modern trade
should be taught at the universities as
well.
The Minister also asked the officials
to develop a world class model for a
multipurpose auditorium that can host
cultural functions, student parent
meets, exams, indoor sports activities
and other functions. He said that such
multipurpose halls should be con-
structed at every college and univer-
sity level.
The Education Minister stressed
on expediting pace of work on the
revival of EDUSAT network. He ordered
the officials to come up with a plan to
revive the important network within
a weeks time as the same will help
central as well as far off colleges in the
State.

life after the suffocating months

personal law
The Supreme Court can and must make
a pronouncement on the widely excoriated
practice of triple talaq

hirteen years ago, Justice V.R. Krishna
Iyer, pleaded in a piece titled Unifying
personal laws in The Hindu (Septem-
ber 6, 2003): My powerful plea is that
the personal laws may be reformed
from within, without a quantum leap into a com-
mon code. Remarkable changes in Islamic laws are
possible without violating the Quran but adopting
progressive hermeneutics. The issue described as
triple talaq has unnecessarily been confused with
the issue of a uniform civil code, thus thrusting
Indias minority Muslim community into the de-
fensive. But this dilemma is essentially a question
of whether the Supreme Court can pronounce on
an issue of personal law. It is my case that it not
only can, but must.
Ruling in the Shah Bano case
The last time that Supreme Court sought to rule
in a matter concerning personal law was in 1985
resulting in what has come to be known as the Shah
Bano amendment. Shah Bano was married to Mo-
hammed Ahmad Khan, an affluent and well-known
advocate of Indore, Madhya Pradesh, in 1932. The
couple had five children but after 14 years of mar-
riage Khan took a younger second wife. For a time
he lived with both, but when Shah Bano was 62,
she was thrown out together with her five children.
In April 1978, Khan even stopped giving her the
paltry Rs.200 per month that is said to have been
promised.
With no means to support herself and her chil-
dren, Shah Bano petitioned a local court in Indore
against her husband citing Section 125 of the Code
of Criminal Procedure (CrPC), asking for maintenance
of Rs.500 for herself and her children. Khans response:
in November 1978 he pronounced an irrevocable
talaq (divorce), taking the defence that hence Shah
Bano had ceased to be his wife and therefore he was
under no obligation to provide maintenance for her
except as prescribed under the Islamic law, which
was her mehr, promised on marriage, Rs.5,400 in all.
While courts at different levels directed payment of
different sums, all a mere pittance, holding that Sec-
tion 125 of the CrPC applies to Muslims, in 1980 Khan
took the matter in appeal before the Supreme Court
claiming that Shah Bano was no more his responsibil-
ity because he had a second marriage, which was
permissible under Islamic law.
The Supreme Court of India in a two-judge
Bench of Justices Murtaza Fazal Ali and A. Varada-
rajan who first heard the matter held in light of
the earlier decisions of the court that Section 125
of the CrPC did indeed apply to Muslims, referred
Khans appeal to a larger Bench. Some Muslim
quasi-religious bodies, namely the All India Muslim
Personal Law Board (AIMPLB) and Jamiat Ulema-
e-Hind, joined the case as intervener.
The matter was then heard by a five-judge Bench
chaired by Chief Justice Y.V. Chandrachud and com-
prising Justices Ranganath Mishra, D.A. Desai, O.
Chinnappa Reddy and E.S. Venkataramiah. In a
unanimous decision of April 23, 1985 in Mohammed
Ahmed Khan v. Shah Bano Begum and Ors. (1985
SCR (3) 844), the Supreme Court dismissed Khans
appeal and confirmed the judgment of the high
court. It held unequivocally that there is no conflict
between the provisions of Section 125 and those
of the Muslim Personal Law on the question of the

Muslim husbands obligation to provide maintenance
for a divorced wife who is unable to maintain her-
self. There was no doubt, held the apex court, that
the Koran imposes an obligation on the Muslim
husband to make provision for or to provide main-
tenance to the divorced wife. Besides, Section 125
of the CrPC applies to all regardless of caste or creed.
So Shah Bano had the right to be given maintenance
money, similar to alimony. The court also went on
to discuss the desirability of bringing a uniform
civil code in India, holding that a common civil code
would help the cause of national integration by
removing disparate loyalties to laws which have
conflicting ideologies.
The clergy backlash
This judgment was vigorously criticised by the
Muslim clergy. I was at the time a Director in the
Prime Ministers Office (PMO), dealing with matters
concerning the minorities. I found on my table a
slew of petitions and letters criticising the judgment
and seeking government intervention to overturn
a ruling which in their view irreparably compro-
mised Muslim Personal Law. The principal spokes-
men for the clergy were Obaidullah Khan Azmi and
Syed Kazi, founding members since 1973 of the
AIMPLB, which was set up to safeguard Muslim
Personal Law as enacted. But on my table were
letters, petitions, and memoranda from organisations
of Muslim clerics from across the country.
The source of Muslim Personal Law in India is the
Muslim Personal Law (Shariat) Application Act, 1937,
a law that is a colonial anachronism enacted to win
over the Muslim clergy from what was, thanks to the
legacy of the war of 1857, a Muslim population large-
ly hostile to the British. As acknowledged in the State-
ment of Objects and Reasons of the Act, it was in fact
moved by the Jamiat Ulema-e-Hind, described in the
Act as the greatest Moslem religious body.
In my note on the file, I had pointed out that the
representations received were primarily from the
clergy and seemed to arise from an apprehension
that the ascendancy granted to them by the 1937
Act in matters concerning social relations amongst
Muslims was under threat. And indeed the law does
state in Section 2 that in matters concerning in-
testate succession, special property of females,
including personal property inherited or obtained
under contract or gift or any other provision of
Personal Law, marriage, dissolution of marriage,
including talaq, ila, zihar, lian, khula and mubaraat,
maintenance, dower, guardianship, gifts, trusts and
trust properties, and wakfs (other than charities
and charitable institutions and charitable and re-
ligious endowments) the rule of decision in cases
where the parties are Muslims shall be the Muslim
Personal Law. But I advised that the apex court had
arrived at its decision after due reference to the pro-
visions of the Koran. The government must respect
the supreme character of that court and even if the
arguments of the clergy in the matter are well found-
ed, it is for the court to judge on their application, not
the government and not the clergy. I suggested that
a reply go to each of the petitions advising that the
petitioners seek a review by the Supreme Court. The
most that the government might do in this regard is
to agree not to contest the review.

BMW has unveiled a number of
concept vehicles that imagine

Vision Next 100 concept motor-
cycle is so advanced that BMW
claims riders wouldn't need a
helmet.
The Motorrad Vision Next
100 would have a self-balancing
system that keeps the bike up-
right both in motion and when
still. BMW touted the motorbike's
futuristic features, saying it
would allow for riders of all skill
levels to "enjoy the sensation of
absolute freedom." According
to the automaker, the Motorrad
wouldn't require protective gear
such as helmets and padded
suits.
Another traditional feature
was also missing from the con-
cept: a control panel. Instead,
helmetless riders would wear
a visor that acts as a smart dis-

via the smart visor," BMW said
in a statement. "This spans the
rider's entire field of view and
provides not only wind protec-
tion but also relevant informa-
tion, which it projects straight
into the line of sight as and when

drivers will be able to hand over
active control of the vehicle at

The inner quest to be close to the mountains was one reason, besides the
hand of God, which resulted in not just a long stay in Kashmir, but also in
shaping the destiny of many young boys. Turning them into examples. John
Mead Ray, the former Principal of Tyndale Biscoe School, Srinagar,
Kashmir, is one person who can still bring out the spirit of the Biscoe Boys.
This became very evident during his visit in late 2012.

not disappoint us and re-
membered his journey to
Kashmir. Some extracts
from a long conversation
of him with Rajesh Prothi.
Q. You continue to be in the minds
of all those who have been part of the
Tyndale Biscoe School. How did your
association with this school and Kashmir
happen?
JM Ray: To answer your question, I
will have to go much in the past and talk
about my fascination with anything to
do with mountains. I was in one of the
well known schools of Scotland, where
both mountaineering and seamanship
were a part of the curriculum. I was fas-
cinated by mountaineering and had hoped
to experience the Himalayas. Destiny
took me to the Lawrence College, Ghora
Gali in Pakistan, where I worked as a
Senior House Master. My tenure there
did not take me to the mountains as I
wanted.
During the late 1950s, I came across
Dr.Phil Edmonds, a great educationist
of his time, who was also Principal of
Tyndale Biscoe School between 1945
and 1955, he asked me if this school would
interest me. The school attracted me
because of its outdoor activities, boating,
swimming, social service, mountaineer-
ing, besides the challenge which was
awaiting me. During the same time I
met my wife. She was doctoring in a
rural hospital, we got married in 1961
and by August 1962 I was here in Kash-
mir.
Q. What initial challenges did you
face when in Kashmir at School?
JM Ray: Oh! The first which I noticed
was that the school was ready for a take-
over by some developers, the fences
particularly at Lal Chowk side were
crumbling. One or two very slight intru-
sions were there, which we managed
because of the reputation of the school
and old Biscoe boys, who were in theright
official positions. If my memory serves
me well , about nine heads of government
departments were Biscoe boys.
Q. What are your happiest mem-
ories of the school and Kashmir?qna31-

JM Ray: If you talk about the happiest
memories, we have over two decades to
talk about. Our children were born here
in Kashmir. We developed very healthy
relations with so many people from this
place. Each year, we experienced Kash-
mir at different locations when we used
to go for the annual school camping trips.
Each year, before the annual swimming
event, praying to God for the safety of
the boys attempting a Dal Cross. While
swimming across the Dal, Kulchas (a
variety of Kashmiri bread) was thrown
across to them so they could have the
regular source of energy. Cross country
run, there are just so many happy mo-
ments to talk about. I dont think there
is any school in the world with such a
range of activities, besides, maybe some
very expensive school in Switzerland
if any. These were regular high points
for me.
Q. What was the state of education
in Kashmir in the 1960s?
JM Ray: When I came to Kashmir, I
observed that the framework for free
education was already there. The local
colleges which were earlier part of Pun-
jab University were in quite a good order.
The challenge however, was different.
Having a universal education across
Kashmir would have been a huge chal-
lenge. The spoken language was Kash-
miri, the State language was Urdu, the
National language was Hindi and beyond
that English was also part of the whole
process it was a quite a task for the
educationists.
There were two or three English me-
dium schools, DAV School being one of
them. However, ours was the only one
which had a right balance between aca-
demics and outdoor activities. The vis-
ible change in the education came about
during the time of Chief Minsiter Sadiq,
again an old school boy, when a serious
effort was made to increase the quality
of the education in the State.
I remember that the Government
College for Women was doing outstand-
ing work under the supervision of Ms
Mehmoodh Ahmad Ali Shah, a former
Ms Mellsion School student, was pioneer-
ing good quality education.
Q. Any anecdote you remember
from the days gone by?
JM Ray: In 1965, we had a rather
mysterious fire in the roadside building,
which was also the main building of the
school. We were kind of shattered, but
some of our Kashmiri friends told us that
if your house burns down you build a
higher and a stronger house.
This was counted as an accident and
the insurance money helped us to build
a much stronger and higher building.
Q. What was your biggest chal-
lenge in the school?
JM Ray:The biggest challenge was to
maintain the quality across all the ac-
tivities of the school. The best of the
school boys would go beyond the call of
duty and would put in an extra effort in
all they did. By the late 1960s and early
1970s, for the former school boys there
were getting many professional oppor-
tunities. This started creating staffing
issues for the school. We started taking
teachers from government schools and
colleges. Master Amarnath and Master
Kashinath took the burden of training
them so as to meet the standards of our
school. The other challenge was the lo-
cation of the school. Being the middle of
Lal Chowk, we had to keep track of the
ongoing activities in and around this
area, which at times resulted in strikes
or hartals. But generally speaking, we
enjoyed great cooperation from all.
