OntarioImmigrantNomineeProgram:WhoCanApply?
Tobeeligibletoapply,theemployermustmeettheemployercriteriaandmustbeseekingapprovalfora
positionthatmeetsthepositioncriteria.

EmployerCriteria
Employersmusthavebeeninactivebusiness(corporations,limitedpartnershipsandsole
proprietorships)foratleast3years.
EmployersmusthavebusinesspremisesinOntariowheretheprospectivenomineewillwork.
Employersmustbeincompliancewithallprovinciallabourlaws,includingbutnotlimitedto
employmentstandards,healthandsafety,andlabourrelationslegislation.
EmployersinsideoftheGreaterTorontoAreamusthave:
aminimumof$1,000,000ingrossannualrevenueforthemostrecentfiscalyear,

fivepermanentfulltimeemployeeswhoareCanadiancitizensorpermanentresidents(perpositionto
befilledeachnominationyear)atthelocationwhereprospectivenomineewillwork.

EmployersoutsideoftheGreaterTorontoAreamusthave:
aminimumof$500,000ingrossannualrevenueforthemostrecentfiscalyear,
threepermanent,fulltimeemployeeswhoareCanadiancitizensorpermanentresidents(perposition
tobefilledeachnominationyear)atthelocationwhereprospectivenomineewillwork.

PositionCriteria
TobeconsideredforapprovalbyOINP,thepositiontobefilledmust:

Beapermanentandfulltimeposition
mustconsistofaminimumof1,560hoursofpaidemploymentina12monthperiod

Beinaskilledoccupation(NationalOccupationClassificationCode0,AorB)
Meetwagecriteria
prevailingwagelevelifthepositionisgoingtobeofferedtoaprospectivenomineeapplyingunder
theForeignWorkerStreamor
entrylevelwagelevelifthepositionisgoingtobeofferedtoaprospectivenomineeapplying
undertheInternationalStudentwithaJobOfferstream.
iftheprospectivenomineeisalreadyworkinginthepositiontobeapproved,theemployerisrequired
topayawageequaltoorgreaterthanthewageapprovedforthatposition.

Notaffectthesettlementofanylabourdisputeoraffecttheemploymentofapersoninvolvedinsucha
dispute,oradverselyaffectemploymentortrainingopportunitiesforCanadiancitizensorpermanent
residentsofOntario.

Notethatemployersmustdemonstratesufficientproofofrecruitmenteffortsiftheprospectivenomineeis
anindividualwhocurrentlylivesabroad,isvisitingCanada,orisworkinginaprovinceorterritoryother
thanOntario(seeproofofrecruitmenteffortsinSection2.3SupportingDocumentsformoredetailsonthis
requirement).

Important:PositionsthatareNotEligible

Thefollowingarenotconsideredpermanent,fulltimeemployeeseveniftheywork1,560hoursina12
monthperiod:

seasonal,orparttimeemployeesregardlessoftheirworkinghours
subcontractorsoragencyworkersand,
employeeswhodonotworkonthecompanyspremises,suchasemployeeswhoworkfromhome,or
employeeswhoworkinavirtuallocation,andservetheemployerbytelecommuting.

Important:WageRequirements

TheOINPexpectsthattheemployeewillreceivepayforhoursworkedaccordingtotheinformation
providedbytheemployer.TheOINPrequiresthatanemployerswageoffertoaprospectivenomineebe
describedonthebasisoftheindividualshourlywageexpressedaseithera)hourlypayandhoursper
year,orb)weeklypayandweeksperyear.Thisallowstheprogramtoverifythatprospectivenominees
willbeappropriatelyremunerated.

Pleasenote:Theprogramdoesnotconsiderremunerationbypiecework,bonuses,commissions,
vacationpayornonfinancialcompensationascomprisingpartofaprospectivenomineesofferedwage.
Anemployermayofferaprospectivenomineepiecework,bonuses,commissions,ornonfinancial
compensationinadditiontobasepay.However,thesewillnotbeconsideredpartoftheprospective
nomineeshourlyorweeklybasepay.Additionally,thehourlyorweeklybasepayofferedtothe
prospectivenomineemustmeetorexceedtheprevailingwage(fortheForeignWorkerStream)orentry
levelwage(fortheInternationalStudentwithaJobOfferStream)establishedbyoccupationandregion
onthefederalgovernmentsJobBankwebsite.

MultiplePositions
EmployersinsidetheGTAcanrequestonepositionforevery5fulltimeemployees.Employersoutsideofthe
GTAcanrequestonepositionforevery3fulltimeemployees.Forreference:

1positionrequested=5existingfulltime,permanentemployees.
2positionsrequested=10existingfulltime,permanentemployees.
3positionsrequested=15existingfulltime,permanentemployees.

CompaniesoutsideoftheGreaterTorontoArea:

1positionrequested=3existingfulltime,permanentemployees.
2positionsrequested=6existingfulltime,permanentemployees.
3positionsrequested=9existingfulltime,permanentemployees.

Employerscanrequestuptoamaximumof20positionspercalendaryear.Requestsformorethan20
positionswillbereviewedbyOINPonacasebycasebasis.

EmployersmustcompleteonlyonePrescreenApplicationformevenwhenseekingapprovalformultiple
positions.Allpositionsmustbelistedonasingleapplication.
