Charge Description: That on or about 2/11/2017, in Crystal, Hennepin County, Minnesota Quran Jabari
Mitchell did without intent to effect the death of any person, cause the death of a known juvenile male,
DOB 2-3-15, a human being, while committing or attempting to commit the felony offense of assault in the
firstdegree.

 STATEMENTOFPROBABLECAUSE

Complainanthasinvestigatedthefactsandcircumstancesofthisoffenseandbelievesthefollowing
establishesprobablecause:

OnSaturdayFebruary11,2017,atabout11:00pm,aknownadultfemalecalled911toreportthathertwo-
year-oldson(DOB2-3-15),hereinaftervictim,wasnotbreathing.Paramedicsrespondedtothehomein
Crystal,HennepinCounty,andfoundthevictimunconscious,bruised,andobviouslyverycriticallyill.They
tookthevictimfirsttoNorthMemorialandthenChildrensHospitalwherehewasplacedonlifesupport.

Physiciansexaminedthevictimanddeterminedthathehadhadseveralepisodesofcardiacarrestand
wasneurologicallyunresponsive.AheadCTshowedbilateralsubduralhematomaswhicharehighly
suspiciousforchildabuse.Thevictimalsohadbilateralretinalhemorrhages.Hewasbruisedonhisleft
arm,shoulder,ear,cheekandforeheadandhadsimilarbruisesonhisrightside.Thevictimdiedonthe
nightofFebruary12th.TheHennepinCountyMedicalExaminerperformedanautopsyand,whilefinal
findingswilltaketimeduetothecomplexityofthecase,observedthatthevictimhadheadinjuriesand
bilateralretinalhemorrhagesconsistentwithbluntforcetrauma.

Investigationdeterminedthatthevictim,hismother,anddefendantQURANJABARIMITCHELLrenteda
roomintheCrystalhomeofanotherfamily.Aknownadultfemalelivinginthehometoldpolicethatthe
defendanthadbeenbeatingthevictimsincetheymovedininDecember2016.Shesaidshesawbruises
onthevictimonseveraloccasionsoverthepriortwoweeks.Shesaidshehasseenthedefendantkickthe
victim.ShesaidthatonFebruary11th,sheheardloudthudscomingfromthebedroomwherethe
defendant,thevictim,andhismotherlived.Thethudswerefollowedbythesoundofthevictimcrying.A
knownadultmalelivinginthehomesaidthatheheardthevictimcryingandthedefendantyelling,Shut
up!Thiswasfollowedbybangingcomingfromtheirbedroom.

Thevictimsmothertoldpoliceshewitnessedthedefendanthitthevictimintheheadwithashoeand
punchandkickhim.

Inanout-of-custodyinterviewthedefendantsaidthatthevictimhadbeensickoverthecourseofthelast
week.Hesaidthatthevictimwouldnotlaydownandgotobedandthathehithimonhisfacewithaflip-
flopshoenomorethan5times.Hesaidhehitthevictimonhisthigh4-5times.Hesaidthechildfelldown
andgotbackupafterhehithim.Healsosaidheusedhisfootonthevictim4-5timesbutsaidhenever
actuallykickedhim.Thedefendantsaidtheonethinghemadesureofwasthatheneverhithimtoohard.

Thedefendantalsosaidhehitthevictimonotheroccasionsbutnevermorethanfivetimesatonce.He
saidthathispreferredmethodofdiscipliningthevictimwastohavehimstandinthecornerbuttheynever
listenthefirsttimeanditwasnecessarytoswathim.Theinvestigationintothishistoryandtheageofthe
victimsinjuriesisongoing.

Thedefendantisincustody.
