SEX OFFENDER
APPEALS

The masseur who sexually assaulted more than 20

women at a Darley Vitality Centre has won the right
to appeal his convictions, due to the neglect of an
ancient legal precedent.
Ronald Van Dorp was found guilty by jury verdict
on 26 out of 35 indecent assault charges in the
Geelong County Court in September 2015.
However, it has since been alleged that Judge
Felicity Hampel did not adopt the legal practice
known as the right to peremptory challenge.
In Victoria, during the empanelling of a jury in a
criminal trial, an accused person has the right to
reject up to six potential jurors without giving any
reason.
During this process, potential jurors are drawn
from the ballot and are required to walk past the
accused in the dock before entering the jury box.
Van Dorp filed an application for leave to appeal
on the basis that in September 2015, none of the
potential jurors walked past the dock, meaning
they werent presented before the accused.
The application was accepted and the 55-year-old,
who is alleged to have sexually assaulted 24 women
aged from 16 to 60, will now appeal against his
conviction for indecent assault matters.
Van Dorp was originally sentenced on all charges
to a maximum prison term of eight years and four
months. He was also classed as a registered sex
offender for a period of eight years.
He will appear in the Melbourne Supreme Court of
Appeal next month.
An alleged victim referred to the news as
distressing.
I was home alone at the time, and if it hadnt
been for a couple of members of the community, I
probably would not have made it through the day,
she told The Moorabool News.
I dont feel like I am strong enough to have to go
through this again. I am shocked and angry and
frustrated that this is allowed to happen.
A second alleged victim said she could not believe
that Van Dorp could appeal on such a small
technicality.
It is a technicality that comes from the judge, it is
something that the judge has, or hasnt, done. This
has the potential to open up a whole can of worms
for a number of other cases, which is very worrying.

Mum clocks 160kph with child Open

A mother was fined after being caught
travelling over 160kph with a child in
the backseat of her car near Ballan.
Dimity Shaw was driving a white
Hyundai on September 4 last year
at around 4:10pm when police first
observed the speeding motorist.
As well as speeding it was alleged by
police that her car wasnt registered
and her plates were not in her name.
When they talked to the accused at the
scene she claimed the reason she was
speeding was she had places to be and
was on the way to her grandmothers.
It was heard by the court that Miss

OLoughlin Road Reserve,
Grenville, has written to coun-
cil several times raising con-
cerns about the poor state of
the road, and that emergency
services would not be able to
locate or access the property in
case of emergency.
The road is a public road for
310m from the intersection of
Sand Road, with about 1km of
former public highway - but
from there is about 510m listed
as an unused government road,
known as a paper road.
One of the property owners
that have raised issues about
the state of the road pointed out
that it is in such bad condition
it is difficult to direct people to
it, and accessibility is poor.
However, a report tabled at
the meeting notes that a plan-
ning permit was issued in 2013
for the residence, from which a
business is run, with no condi-
tions that the section of paper
road would be upgraded to an
accessible level.
One property owner has been
using Hall Road, as in times
of rain, and at other times, the
paper road is inaccessible
however, Hall Road is a private
road through private prop-
erty, and the property has been
vested by the Department of
Environment, Water, Land and
Planning to Hancock Victo-
rian Plantations Pty Ltd, and so
technically should not be used
by the general public.
The report pointed out that
council is not obliged to take
over any paper road until it has
been established that it is rea-
sonably required for general
public use.
In this case, even with the
construction of a dwelling, the
criteria under the RMP (Road
Management Plan) is not met
and typically would not be con-
sidered for addition to the road
register, the report stated.
A council assessment found
the road does not meet the
minimum requirements for
consideration to be added to
the public road register.
The report did, however, offer
alternatives of sorts.
An alternative option may be
that the property owner/s may
choose to construct this section
of road to a standard accept-
able to Council, at the cost of
the benefitting property own-
ers and Council would subse-
quently assume ownership and
maintenance responsibility for
that section of additional road.
A special charge scheme
could be implemented to con-
struct the road with contribu-
tions from land owners.
The property owners may
also choose to upgrade the
section of road to a standard
lower than Council would ac-
cept (akin to a driveway) to ac-
cess their property at their cost
and Council will continue to
maintain the first 300 metres of
OLoughlin Road.
Councillors voted in favour
of the recommendation not to
include the paper road on the
public roads register; coun-
cil officers will now write to
residents gauging support for a
special charge scheme.
A policy will also be prepared
by council officers on the main-
tenance and development of
unused paper roads.

The autumn firewood col-
lection season is upon us.
On Wednesday March 1,
Moorabool residents will be
able to collect firewood from
designated collection areas.
The collection season will
be open for four months,
closing on Friday June 30.
Forest Fire Management
Victoria spokesperson, Pe-
ter Kambouris said it was
important that people only
collected firewood from
within the designated areas
and stayed within collection
limits.
This includes taking a
maximum of two cubic
metres per person per day,
and a maximum of 16 cubic
metres per household per
financial year, he said.
Designated collection ar-
eas are put in place to protect
sites of cultural and environ-
mental significance. People
should check where the col-
lection areas are in their lo-
cal area, while also checking
local weather and forest con-
ditions to make sure its safe
before collecting firewood.
Mr Kambouris said it was
also important to consider
others during the collection
season, as some households
would rely on firewood for
winter energy.
He said availability of dry
firewood would vary across
collection areas and remind-
ed residents that the chop-
ping of trees for firewood
was strictly prohibited.
Authorised officers will be
patrolling parks, forests and
reserves to ensure people are
doing the right thing while
collecting their firewood,
he said.
Concealed cameras may be
installed on areas of public
land where firewood is being
removed illegally to assist
with evidence collection.
Illegal firewood collection
can result in a maximum
penalty of more than $7,000
in fines, one-year imprison-
ment, or both.

dents in the last two years,

In addition to depot secu-
rity, GPS technology is being
explored for the Council ve-
hicles and plant.

intentional killing during a
crime of violence.
In a Supreme Court hearing
in December last year, Wil-
liamsons lawyer at the time,
Richard Edney, told the
court that his client was not
in the room when Mr Hand-
ford was stabbed 13 times in
the back.
Mr Johns said Williamson
had not changed his position
since the December hearing.
My client has indicated his
consistency in relation to his
earlier instructions.... in this
instance, the minimum basis
required does not satisfy a
3a plea.
Justice Jane Dixon said it
was important to progress
the matter quickly, as the
family of the deceased, some
of who had travelled from
interstate, wished to see the
conclusion of the case as
soon as possible.

in court for a change of plea
application on March 20.

A new medical centre will be built in Darley despite it
being labeled as ugly.
Councils February 8 meeting of the Development
Assessment Committee heard an application for a medical
centre, with an auxiliary pharmacy, to be built on Halletts
Way.
But East Ward Councillor John Keogh objected to the
application.
The building is an inappropriate building in a residential
area its a long way from retail areas. That detracts from the
residential zone, its a two-storey and ugly looking building
slap bang in the middle of residential, Cr Keogh told the
meeting.
Applicant Michael Harbour addressed the meeting,
speaking against a requirement that there be only six
medical practitioners instead of seven because of car parking
restrictions.

A fabulous time is being promised at the
upcoming St Andrews Autumn Fair.
St Andrews Uniting Church, Bacchus
Marsh, will hold the fundraiser on Saturday
4 March from 9am-1pm in the church
buildings and grounds.
The event is set to feature displays from
local Denis Beanland, with scale model cars,
trucks and road trains on show.
There will be a display, as well as vehicles
for sale, explained Dennis wife Valerie.
The event will also feature stalls selling
plants, cakes, craft, produce, manure, and a
lucky dip toy stall, as well as a barbecue.

The motivator behind the
Bacchus Marsh Community
College has passed away
aged 91.
Margaretta (Gretta) Wilkin-
son initiated the local Col-
lege, otherwise known as
The Laurels, and helped to
move it beyond its first short
courses to become the full
Adult Education Centre it is
today.
Gretta was born in Sea Lake
to Maggie and Leslie Nor-
man Kean on December 26,
1924.
She attended the Presbyte-
rian Ladies College in East
Melbourne from 1939 and
eventually became a Prefect
and head boarder.
She aimed for a career in
science teaching while stud-
ying at Melbourne Univer-
sity and imbibed a lasting
pleasure for classical music
at youth concerts at the
Melbourne Town Hall and
a thirst for knowledge in a
wide expansion of interest
and friends.
Early in her career, Gretta
took a group of girls camp-
ing in tents at Uluru, long
before the facilities were
available to tourists.
She later became the first
female to join the all-male
Science Teachers Association
and in 1972 took on the role
of president.
In the mid-sixties, she mar-
ried Robert Harvey Wilkin-
son, who belonged to the
Science Teachers Association
and had initially advocated
for women like Gretta to
join.
The couple lived in Medley

As an older resident that
uses the Bacchus Marsh Lei-
sure Centre gym I cannot
understand the Moorabool
councils thinking on this.
They are developing a health
and well-being policy; yet
want to close the Health
club. There are not really any
other options for the people
over 60 who want to keep fit.
The private gyms cater for
younger people and are not
really setup for older people.
The council says they work
with the community, but
have any of the Councilors
ever visited the gym?
For me the gym is just as
much about social interac-
tion as well as keeping fit.
If it closes there will be no-
where else to go.

Forest destruction continues
One of the numerous, should

denial of the facts is not new
and Trump has only brought it
to the fore and, as with his usual
approach, brazenly. Maybe his

the more refined lies we are told

especially true when it comes to
the environment.
Some examples of alternative
facts in the interface between
the environment and business:

to be admitted to university.

possible 99.95, a score of 35 is pretty

be spoken by our governments,
both state and federal. However,
their laws offer an alternative
fact. Under the current system
of management, called Regional forest management. And the state
Forest Agreements, native
forests that are logged are exempt
from national environmental
protection laws, so not even
rare and endangered species are
protected. Even open cut mines
dont get that sort of special
exemption!
In Victoria, the East Gippsland
Regional Forest Agreement
expired on Friday 3rd February.
For the last 20 years this agreement
has licenced environmental
destruction and subsidised
an unprofitable industry. Yet
incredibly, PM Turnbull and
Premier Andrews have no other
plan for Victorias forests, so they
have a more successful score than
those ambitious to teach?
And while an ATAR should not
define you, those who teach our
future generation of children
should have a high level of
intelligence and I cant think of a
better way to measure that than
through academic performance.
Sure, a four-digit number means
little to nothing without the
compassion and motivation to
teach, but these personality traits
intend to maintain the status
quo and extend this destructive
arrangement.
Your precious life-filled native
forests are cut down and
bulldozed. Animals are made
homeless and plants are smashed
to smithereens. Then, napalm is
dropped from the sky to scorch
the former forest, in the name of
government is environmentally
conscious to use an alternative
fact.
Here in Tasmania in 2017, well

wants to open up to logging
despite the protests of the
Tasmanian logging industry

Darleys Second XI cricket-
ers have posted their first
win of the 2016/17 season
with their First XI clubmates
watching on thanks to a bye.
Having secured first in-
nings points in their match
against VRI Delacombe last
week after skittling them
for 64 and finishing the first
day on 6/109, the mission of
the Darley batsmen would
have been to bat for as long
as possible to ensure that
VRI didnt try and record
a reverse outright victory,
which would have been
right on their minds as Dar-
ley lost three wickets for
just four runs early on to sit
on 9/113, but a 30 run tenth
wicket partnership between
Josh Calvitto (20) and wicket
keeper Jordan Monaghan (11
not out) gave the Lions a to-
tal of 143 and a very handy
64 run buffer.
VRI went into bat for a sec-
ond time hoping to knock
up quick runs, but when af-
ter 33 overs had passed and
VRI sat on 3/99, just 30 runs
ahead, they called stumps
on the days play, giving the
Lions their first Second XI
win for the season. Hasitha
Wickramasinghe took two
of the three wickets to fall
for the Lions as a tune-up
for his return to the Lions
First XI for their final-round
game against East Ballarat
over the next two weeks and
their semi-final appearance

The highlight for Darley
came from captain Liam Jor-
dan, who produced his best
bowling figures in Lions co-
lours and his second senior
five-wicket haul by taking
5/52 off 18 overs to lead by
example, snaring the first
three wickets to go with a
Jye Stephenson run-out that
had Buninyong on the ropes
at 4/43 before stringing to-
gether some match-winning
middle order partnerships.
The Lions Third XI will be
hopeful of their third vic-
tory for the season in their
final round match-up with
an East Ballarat side boast-
ing just the one win for the
season next weekend.
Darleys Fourth XI finals
hopes took a dive on the
weekend, going down to
close rivals Ballan by 64 runs
in an enthralling match.
Ballan scored 6/280 after
winning the toss and bat-
ting, with 212 of those runs
coming from the lone bat of
Tyler Trickey, who the Lions
bowlers had no answer to.
Trickey hit 15 fours and an
astonishing 19 sixes in his
unbeaten match-winning
knock, even more astonish-
ing that only one other Bal-
lan batsmen reached double
figures as Regan King took
two wickets for the Lions,
with James Martindale, Ste-
ven Cornford, Brad Roberts
and Jason Randall all taking
one wicket each.
The Lions again started
their innings well, but los-
ing middle-order wickets
in quick succession after
Darren Hynes (46) and Tim
Gallagher (58, his fifth half-
century in a row) gave them
a sniff at the top of the order

only get to 8/214 at the close
of their 40 overs, with a 36
run unbroken partnership

the game for Darleys bowl-
ers, and they delivered with
openers Tyler Cox and Mitch
Ward both striking early
to reduce Ballarat-Redan to
2/10 early, and whilst the
Two Swords fought back
hard in the middle order,
they could manage just
7/133 to fall 43 runs short,
relinquishing second spot
to the Lions in the process.
Miles Seager was the lead-
ing wicket-taker for the
Lions with 3/33, whilst Joel
Cadman and Aiden Cox also
took wickets.
Darleys 14 & Under First
XI took a major scalp on the
weekend, defeating second-
placed Golden Point by nine
wickets.
Despite finals being out of
their reach, the young Lions
performances of the season
to hold Golden Point to 5/109
off their 25 overs, with Ryan
Densley taking 2/11 off four
overs and Noah Simmons
and Austin Macbeth also
taking wickets along with a
run-out.
The Lions then produced
one of their better batting
performances of the season
to finish their innings on
1/123 with both Hayden
Nash and Lane Havelberg
retiring on 30 to anchor the
innings and give the Lions a
memorable win.

batted first and made 6/132
of their allotted 25 overs,.
Best of the bowlers were

Kurtis Beck (1/8). The Lions
top order got the team off to
a good start putting on 53 in
9 overs before Aaron Cad-
man was dismissed for 11.
Rocky Hoey batted brilliant-
ly to retire for 30, but when
Jayson Fawcett 4 and Brodie
Ward (run out for 0) were
dismissed the innings lost
momentum. To their credit
the side fought it out with
Zane Colley, Luke Hayward
and Tyley OHehir showing
some fight but the Lions fell
short making 7/113.

down) and Steve Sullivans rink (10 shots down).
Final score Avenue 70 lost Ballarat East 122.
DIVISION 2 v Daylesford
Grant Stirlings rink fared best with a 9-shot win, whilst
Glenys Kays rink managed a draw. Both Alan Thistlethwaites
rink and that of Bob Delaney were 0-13 and 0-8 respectively
in the early going in their matches, with the Thistlethwaite
rink staging a valiant comeback to go down by the solitary
shot. The Delaney rink got within 2 shots on end number 19,
but couldnt quite hold off their opposition, going down by
10 shots. Overall it was a close game with Avenue just falling
short by 2 shots.
Final score Avenue 91 lost Daylesford 93.
DIVISION 5 v Central Wendouree
Both sides had an equal number of points going into the
game. Avenue were able to claim the bragging rights on the
back of Di Hardiments rink which performed exceptionally
well securing a 15-shot win, whilst Stewart Wilsons rink
managed a 7-shot win. Mike Roberts rink dropped 4 shots
on the second last end to go down by 2 shots, whilst Ray
Humphreys rink surrendered the first 10 shots of the game
to their opponents before ultimately going down by that
margin.
The win places Avenue in outright top spot on the ladder
with one game to go.

DIVISION 7 v Waubra
It was expected to be (and was) a close game all day, but
thanks to a 7-shot win to Oscar Mauffs rink and a three shot
win to Mal Smiths rink, Avenue were able to negate narrow
losses on the other two rinks to run out winners by four
shots, which gives the side tremendous confidence going
into the finals and in full knowledge that they will definitely
finish third after the final game next week.

On Saturday morning the Centre
participated in the newly introduced
Little Athletics PB (Personal Best) Round.
This was a competition day celebrating
PB achievements, whilst focusing on the
athletes own improvements. Athletes
were rewarded with a Little Athletics
Victoria PB ribbon at the end of each event, in which they
achieved a PB. Although conditions were extremely cool
and slightly windy, a total of 219 PBs were recorded by the
athletes. Emma Stewart, Isaac Colella and Ava Westerlaken
all achieved 5PBs for the round.
Little Athletics Victoria has released the progressions for the
State Track & Field Championships to be held on March 11 &
12 at Lakeside Stadium, Albert Park.

when they batted again but lost two quick wickets leaving

steadied the innings but were unable to chase enough runs
to consider going for outright.

proud of their achievements. The majority of the team were
all first year cricketers and to see them improve during
the season was very rewarding. All of the team members

on them later in the year. The Ballan Cricket Club hopes to
see all the team back next year to continue their pathway to
