ThereportoftheHouseCommitteerecommendingacomprehensiveprobeintotheallegedirregularitiesin
implementationoftheBMICPhascomeasanewrayofhopeforthelandlosersafteragapof11years,sinceboth
theHighCourtandtheSupremeCourt,during200506,hadrejectedpleasforaprobebytheCBI.

Expressingsatisfactionoverthereport,manyofthosewholosttheirlandfortheprojectduetoillegalities
hopedthatthegovernmentwouldaccepttherecommendations,includingaprobebytheCBIandtheEnforcement
Directorate.

However,someofthelandlosershaveexpresseddoubtonwhetherthegovernmentwouldacceptthe
recommendationsintotoassomeinfluentialpoliticiansandMinistersareindirectlysupportingNICE.The
reporthasgivenusnewhope,andthebattlewillcontinue,saidlandlosers.

M.KKempegowda,whohasbeenfightingabattleagainstirregularitiesbytravellingonlyonhisbicycleforseveral
years,ishappy.Hehopesthegovernmentwillaccepttherecommendationswithoutyieldingtointernal
pressuresandwillthoroughlyexamineallthelegalaspects.

Assomeoftheoldlitigationsontheprojectarestillpendingforadjudication,bothintheHighCourtandthe
SupremeCourt,legalexpertssaythecompanywouldcertainlymovethecourtssoonafterthegovernmentformally
comesoutwithanorder,basedonthereport,asthepanelreportalonecannotbechallengedinthecourts.Thecourts
cannotinterferewithreportssubmittedonthefloorsofthelegislature.

ThoughtheHighCourtin1998inSomashekaraReddycaseandintheJ.Madhuswamycaseandothersin2005,had
rejectedrepeatedpleasforaCBIprobe,legalexpertssaidthenewlegalbattlewouldbemainlyonthealleged
violationsoftheFWA,signedin1997,assuchviolationswouldalsoamounttoviolationoftheCourtsorders,
whichhaddirectedimplementationoftheprojectinletterandspiritoftheFWA.Thepanelcouldhavegathered
sufficientmaterialtoestablishtheallegedirregularities,legalexpertssaid.

fromKodiyakaraionNovember28weresafeandbeingbroughtbackashore.Sourcessaidthatallbutthe35
fishermenhadreturnedhome.Ateamofrescuepersonnelhadbeendespatchedfortheirimmediaterescue.The
engineofoneoftheboatsofthefishermenhaddevelopedasnag,leavingthemstrandedinmidsea.However,the
fishermenwerereturninghome,thankstotimelyassistancefromtherescueteam,hesaid.

Thereafter,theTWADBoardwillbeforcedtopumpwateranditcandosowiththeKeralaGovernments
permission.Sourcessaidthattheboardhaddonesointhepastandthistimetoo,ifpushcomestoshove,itwilltalk
totheKeralaGovernment.

IntheaddedareasThudiyalur,Vellakinaru,ChinnaVedapatti,Vilankurichi,SaravanampattyandKalapattithe
watersupplyisexpectedtobeatthecurrentlevelastheCorporationgetswaterfromtheboardfromthePilloorI
scheme.

Financial assistance for human death or permanent

incapacitation increased
TheStategovernmenthasenhancedcompensationforlossoflifeanddamagetopropertycausedbywildanimals.

Thecompensation/relief(financialassistance)forhumandeathorpermanentincapacitationhasbeenincreased
fromRs.3lakhtoRs.4lakh.Foramajorinjury,thecompensationwillbeRs.59,100.However,thereisnoincrease
incompensationforcropdamage,whichisRs.25,000anacreortheactual,whicheverwasless.

TheenhancedcompensationfollowstheannouncementinthebudgetearlierthisyearbytheFinanceMinisterthat
thecompensationprovidedforlossoflifeanddamagetocropsandpropertybecauseofattacksofwildanimals
wouldbefixedonaparwiththeStateDisasterResponseFundnorms.

Basedonthis,theChiefWildlifeWardenpreparedaproposalforenhancingcompensationorreliefamountandits
timelydisbursements.KarnatakaandKeralahadalreadyenhancedthecompensationamount.

Sincethehumanwildlifeconflictwasanunforeseennaturalevent,hesaidmakingfinancialassistanceonaparwith
theratesapprovedbytheRevenueDepartmentasperSDRFnormswasrecommended.Thegovernmentpassedan
orderenhancingthecompensationorreliefamountundervariousheads.

Undertheneworder,thecompensationforafullydamagedorseverelypuccahousewouldbeRs.95,100,for
kutchahouseitwouldbeRs.10,000,andRs5,000forseverelydamagedhouse.
ThefinancialassistanceforpartiallydamagedhousewouldbeRs.5,200perhouse.Compensationforlossofmilch
cattleisRs30,000,bullockRs.25,000,goatandsheepRs.3,000,poultryRs.100abird,pigRs.3,000oractual
value,whicheverisless.TheactuallossorRs.2,000,whicheverislessforhouseholdarticles.
