NOTIFICATION
No.SOR(LG)38-11/2013.- In exercise of the powers conferred under section 144 of the
Punjab Local Government Act, 2013 (XVIII of 2013) and after previous publication, Governor
of the Punjab is pleased to make the following rules:
1. Short title and commencement. (1) These rules may be cited as the Punjab Local
Governments (Delimitation) Rules 2013.
(2) They shall come into force at once.
2. Definitions. In these rules:
(a) Act means the Punjab Local Government Act 2013 (XVIII of 2013);
(b) Assistant Delimitation Officer means a person appointed as such
under these rules;
(c) Delimitation Authority means a Delimitation Authority appointed under
these rules;
(d) Delimitation Officer means a person appointed for delimitation of a
ward or a Union Council under these rules;
(e) election means election to a local government;
(f) form means a form appended to these rules and includes a translation
of the form in Urdu;
(g) publish includes exhibition of a document at a place accessible to the
public; and
(h) ward means an area of a Municipal Committee delimited as a ward
under these rules.
3. Delimitation of wards. (1) For purposes of election, a Municipal Committee may be
divided into such number of wards, as the Government may determine keeping in view the
population prescribed for the Municipal Committee under the Act.
(2) A ward shall be a single member ward and the number of wards in a Municipal
Committee shall not be less than eleven or more than fifty.
(3) A ward shall, as far as possible, consist of a part of a census block, a census
block or adjoining census blocks and the population of wards within a Municipal Committee
shall, as for as possible, be uniform.
4. Delimitation of Union Council. (1) The Government may determine the number
of Union Councils for the Metropolitan Corporation, a Municipal Corporation and a District
Council.
(2) A Union Council shall be an area consisting of one or more revenue estates or,
in the case of an area where revision of settlement under the law has not taken place, one or
more census villages or, in case of an urban area, a census block or blocks as delimited for
purposes of the last preceding census or a census block and a revenue estate, notified as
such by the Government.
(3) As far as possible;
(a) the area of a Union Council shall be a territorial unity;
(b) the boundaries of a Union Council shall not cross the limits of the
Metropolitan Corporation, a Municipal Corporation or a District Council;
and
(c) the population of Union Councils within a local government shall be
uniform.
5. Appointment of Delimitation Officers, etc. (1) The Government may, by
notification, appoint as many Delimitation Officers and Assistant Delimitation Officers as may
be necessary for the delimitation of Union Councils and wards or for the revision of such
delimitation under these rules.
(2) The Delimitation Officer shall perform such functions as may be assigned
under these rules or the Government may assign.
(3) An Assistant Delimitation Officer shall assist the Delimitation Officer in the
performance of his functions.
6. Proposals, objections, suggestions and recommendations. (1) The Delimitation
Officer shall publish in Form-I, on a conspicuous place at his office and the offices of
Assistant Delimitation Officers and the local government, a preliminary list of wards or union
councils specifying the areas to be included in each ward or a union council alongwith the
map, together with a notice inviting objections and suggestions from the public, within a
period of seven days of the publication of the preliminary list.
(2) The notice shall specify that objections and suggestions may be submitted in
writing. within the period mentioned in sub-rule (1), to Delimitation Officer or Assistant
Delimitation Officer.
(3) The Government shall appoint as many Delimitation Authorities as it considers
necessary for deciding objections and suggestions with respect to delimitation of Union
Councils or wards within the area assigned to a Delimitation Authority.
7. Decision on objections and suggestions. (1) The Delimitation Officer shall reject
the objections or suggestions not received after the specified period.
(2) Subject to sub-rule (1), the Delimitation Officer may hear the parties and conduct
such inquiries as he may consider necessary with regard to the objections and suggestions
received.
(3) The Delimitation Officer shall, within seven days of the receipt of suggestions
or objections forward to the Delimitation Authority for orders a concise report pertaining to the
suggestions and objections received by him.
(4) The Delimitation Authority shall, on receipt of the concise report, decide the
case after hearing the parties, within ten days and the decision of the Delimitation Authority
shall be final.
(5) The Delimitation Officer shall make such modifications in the preliminary list of
wards or Union Councils published under rule 6 as may be required under the decision of the
Delimitation Authority and may make such other modifications in the said list as may be
necessary for correcting any error or omission.
(6) The Delimitation Officer shall, after making the modifications as aforesaid,
shall publish, in Form-II, on a conspicuous place at his office and the offices of Assistant
Delimitation Officer and the local government, the final list of union councils and wards along
with a map and shall forward three attested copies of the final list along with maps to the
Government.
8. Notification of Union Councils and wards. The Government shall issue the
notification of a Union Council or wards on the basis of final list of Union Councils and wards
published under rule 7 containing details of areas included in a Union Council or a ward.
