REGULATION ORDINANCE NO. 2012-402


AN ORDINANCE REGULATING THE OPERATION OF AMBULANT
STORES IN THE CITY OF ILOILO

WHEREAS, Filipinos are known to be inventive in various endeavor in life.


Innovativeness can be seen in the manner Filipinos market their goods and services;

WHEREAS, foods and other fashionable items are one of the easiest things which can be
sold and marketed instantly;

WHEREAS, to reach a wider market and to increase sales, vendors innt>vate by selling
their goods on pedicabs, carts, tricycle and other similar mode of transportation for the purpose
of vending various goods;

WHEREAS, it is undeniable that these kind of stores exist and operates along various
roads within the City oflloilo; that they can be easily dispersed with in case of traffic congestion.

WHEREAS, it is the authori:ry~of the Local Government Unit (LGU) to enact ordinances
that will regulate the preparation and sale of meat, poultry, fish vegetables fiuits, fresh dairy
products, and other food stuffs for public consumption (Sec. 21 (d) of the Local Government
Code of 1991);

WHEREAS, it is the power of the LGU to regulate the use of streets, avenues, alleys,
sidewalks, bridges, parks and other public places (Sec. 458 (5) (v) of the local Government Code
of 1991);

NOW, THEREFORE, be it enacted by the Sangguniang Panlungsod of the City oflloilo,


in session duly assembled that:

A SECTION I. TITLE

"' \ This ordinance shall be known as, "An Ordinance Regulating the Operation of
Ambulant Stores in the City ofiloilo".

Section Il DEFINITION OF TERMS

For the purposes of this Ordinance the following words shall mean as follows;

a. Ambulant store - is a mode of transportation used to move from one public


place to another with the use of cart, tricycle, pedicab, bicycle, and any other
similar mode of transporting goods for the purpose of selling or vending.

b. Vendor - A person who sells food stuff, fashionable items and other goods
which are similar in nature and within the commerce of man with the use of
the ambulant store.

c. Public Places - shall include but not limited to City streets, sidewalks, alleys,
plaza, school and market premises and other similar places accessible to the
public as egress and ingress.

SECTION Ill. RULES AND REGULATIONS

a. Ambulant Store Owner shall obtain a license plate from the Business Permits
and Licensing Division, City Mayor's Office.
b. The application for the Ambulant Store Plate shall contain the following
information:

1. Name of the Owner of the Ambulant Store;


2. Address of the Owner;
3. Contact Number;
4. Good/s sold by the Owner;

c. Issued Plate shall be placed at the most visible portion of the ambulant store
for proper identification.

d. Vendor/s who are handling food stuff shall secure Health Card issued by the
City Health Office.

Section IV. SCOPE

This ordinance shall cover all ambulant stores conducting business within the
tenitorial boundaries of the City oflloilo.

Section V. PENALTY CLAUSE

A. Any ambulant store caught without a license plate shall suffer the following:

First Offense, confiscation of the ambulant store and shall be released upon
payment of the amount of Five Hundred Pesos by the ambulant store owner,

Second Offense, confiscation of the ambulant store and shall be released upon
payment of the amount of One Thousand Pesos by the ambulant store owner,

Third Offense, confiscation of the ambulant store and shall be released upon
approval of the application for license plate and to the ambulant owner a fine of One
Thousand Five Hundred Pesos.

B. Any ambulant vendor caught without health card shall suffer the following:

First Offense, confiscation of the ambulant store plates, and shall only be released
after payment of a fine of Two Hundred Pesos,

Second Offense, confiscation of the ambulant store plates, and shall only be
released after payment of a fine of Three Hundred Pesos,

Third Offense and for continuous violation, confiscation of the ambulant store
plates, and shall only be released after payment of a fine of Five Hundred Pesos.

This ordinance does not exempt the ambulant store owner or vendor from the imposition
of other penalties for violating other laws and ordinances in the City oflloilo.

Section VI. IMPLEMENTING OFFICE

1. City Treasurer's Office


2. Business and Licensing Division
3. City Health Office
(as to the health card of ambulant vendors handling food stuff)
4. Iloilo City Police Office
5. Any other personnel duly authorized by the Local Chief Executive to enforce
the provisions of this ordinance.

Section VIII. EFFECTI.VITY

This ordinance shall take effect on January 1, 2013 upon publication 1n a


newspaper in general circulation.
