In the morning of August 24, 2016 I dropped my sister at the gate of her house at #

69 West Point St, Barangay E. Rodriguez, Quezon to pick up her bag because she
asked me to drive her to the Five Star Bus Station as she was going to the province.

I opened the gate for her, and stood by the door of my vehicle waiting for my sister.
In no more than 2 minutes, a man asked me who the owner of the vehicle was. I
told him that the vehicle was mine. He then told me that he the vehicle was going
to be towed because it was illegally parked.

I said I was not illegally parked but was just waiting for my sister who went inside te
house to pick up her bag.

The man then tiold me to talk a man who was standing about 40 to meters away.
The man was dressed in a military-like uniform (khaki or fatigue) which had some
patches that made him look like a person of authority.

I told the man, whom I later came to identify as Mr. Charlie Anatacio not to tow my
vehicle because I did not commit any violation.He said the Barangay Chairman
called the MMDA to tow my vehicle.

I texted the Barangay Chairman to verify, the Barangay Chairman replied he did not
make a call. ( I have a Certification from the Barangay Chairman to that effect.)

In not more than 1 minute my vehicle was already lifted by the Towing truck., and
Mr. Anatacio said Eh paano yan. From the tone of his voice, I could tell that he
was asking for lagay. I pleaded to him not to proceed with the towing but was firm
about not giving lagay.

Because I was not hard on my stand, he told me that my vehicle was going to be
brought to the MMDA Towing Compound Area at ULTRA in Pasig. He then instructed
me to sit beside the Driver of the Towing truck.

At the Impounding I asked to see the Chief of the MMDA Impounding area to
complain. Instead, it was his Deputy who faced me. I insisted on seeing the Director
(Atty. Nunez) because he is a lawyer and I thought that he would better understand
my complaint.

The Deputy told me to wait for 5 minutes and the Director would come, the time
the was around 11:00 a.m.. I kept on waiting but the Director did not show up. At
1:00p.m., I could wait no further because I had to attend a press conference at 4:00
p.m., and told the Deputy about it.

I said I was leaving and asked for a piece of paper because I decided to write the
complaint to MMDA General Manager Tim Orbos . When I said this, the Deputy said
they would release my vehicle without penalty and asked me to sign a piece of
document. At first I refused to sign, but he said it was necessary in order for them to
release my vehicle.
As I was in a real hurry, I was forced to sign the document, and then asked the
Deputy to Officially Receive my complaint-letter to Mr. Orbos.

A day or two later, a lady who introduced herself as a secretary to Mr. Orbos told me
to appear at the MMDA Main Office for a meeting with Mr. Orbos. When I showed up
for the meeting with Mr. Orbos, I was told to go to the conference room.

There, it was Atty. Nunez who showed up to talk to me. He got angry at me because
he said he arrived at the Impounding area at 4:00 p.m. and I was not there
anymore. I told him that I was told to wait for 5 minutes, not 5 hours.

After this, I insisted on seeing Mr. Orbos for an interview. I was very difficult because
his staff always had excuses why Orbos could not see me.

When I lost my patience, I broadcast the anomaly over Radyo ng Bayan. Then,
Orbos finally agreed to see me. When I expressed to him my concern, he instructed
his Chief-of-staff, Atty. Chung to settle the damages caused to my vehicle.

The following day, the Tower together with 2 other men met with me and Atty.
Chung at the conference room. One of the men said he was the MMDA traffic
enforcer who was there at the scene when my vehicle was told. That was a big lie. If
he was there, why did he not issue me a traffic violationticket as is the normal
procedure, instead of towing my vehicle. Atty. Chung then asked me to show me the
copy of the estimated cost of damage to my vehicle. After a while, all of them went
out of the room to talk, I was left alone inside. After about 5 minutes, atty. Chung
asked if I would be willing to accept a lower amount. I said, ok, 2 thousand pesos
less.

The following day acertain Ariel called and promised to pay. He never called again
nor answered my text and many calls to him.

I am therefore filing this complaint for Carnapping against the ARD Towing Company
and all the people involved in forcibly towing my vehicle unlawfully.
