CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This contract is made and entered into by and between:

of legal age, Filipino Citizen, married, and presently residing at


Balibago, Angeles City hereinafter referred to as the LESSOR;

- and
, of legal age and residing at Angeles City, hereafter known as the
LESSEE.

WITNESSETH:

Whereas, the LESSOR represents that he has the authority and


power to lease a commercial stall at

Whereas the LESSEE warrants that he has the authority and


capacity to lease the aforementioned property;

Whereas the LESSEE has offered to lease the property from the
LESSOR and the LESSOR has agreed to lease the same to the LESSEE
subject to the following terms and conditions:

1. PERIOD - An 18 months lease with P250,000 pesos paid up front


covering the 18th months commencing from March _____2017 until
October 2018 renewable upon the option of the lessee.

2. SUBJECT MATTER OF LEASE - The subject matter of this lease


contract are:

a. LEASE- The space formerly including the kitchen


area consisting of ______ sqms owned by the LESSOR;
b. PERSONAL PROPERTY -The equipment, furniture and
fixtures installed and located thereon owned by
LESSOR and leased to the lessee as part of the lease.
The description of which is contained in the inventory
as annex 1. An inventory of all personal properties of
the lessee is also attached as annex 2;

3. MONTHLY RENTALS The 18 months LEASE RENTAL with


P250,000 (two hundred fifty thousand pesos) to be paid upon
signing of this contract for the area formerly ..including the
kitchen area.

4. MAINTENANCE & IMPROVEMENTS - Those immovable


improvements left by the LESSEE shall belong exclusively to the
LESSOR without obligation to reimburse the LESSEE whatsoever. It
is at the option of the lessee to remove useful improvements
provided no damage is caused to the immovable property. Any
ordinary wear and tear repairs and maintenance of the
lease premises shall be borne by and for the account of
the LESSEE. All equipment included in the lease that is defective
will be repaired by the lessee.

5. ELECTRICITY, WATER & OTHER UTILITITES Expenses on


electricity, water, telephone and other utilities pertaining to the
subject lease shall be for the account of the LESSEE;

6. FIRE HAZARDS - The LESSEE shall not bring or store in the


leased premises any inflammable or explosive goods or articles
which may expose the leased premises to fire or increase the fire
hazards;

7. INSOLVENCY OF THE LESSEE If the rentals herein stipulated


shall be in arrears or unpaid for at least two consecutive months
or if the LESSEE shall become insolvent, then in any of the above
cases, this lease contract shall become automatically terminated
and cancelled, and the said premises shall be vacated peacefully
by the LESSEE and for the LESSOR to take over the possession
thereof, in which event it will be lawful for the latter or any duly
authorized agent to enter into the leased premises as though the
term of the contract has expired without prejudice on the part of
the said LESSOR to exercise any and all rights from this contract
of lease and those granted by laws.

8. RETURN OF PREMISES UPON TERMINATION OF LEASE


Unless this contract is renewed at the expiration of the term of
this lease or upon cancellation thereof as herein provided, the
LESSEE shall promptly surrender the premises to the LESSOR in
good and tenantable condition; The LESSEE hereby authorizes the
LESSOR to enter the premises forcibly or otherwise without the
need of court order upon the termination or rescission of this
lease;

9. JUDICIAL INTERVENTION Any violation of any of the conditions


herein above set-forth or if for any valid reasons it shall become
necessary to file an action or proceeding in court for the
enforcement and/or protection of the rights of any of the parties
hereto, the aggrieved party shall be entitled to liquidated
damages for and in lieu of Attorneys fees, in an amount
equivalent to 25% of the sum of money involved, but in no case to
be less than twenty five thousand pesos (P25,000.00) aside from
the cost of litigation and other legal charges prescribed by the
Rules of Court. In such event, the LESSOR hereby reserves the
right to terminate this lease, and the LESSEE agrees to vacate
forthwith the premises without need of court proceedings.

10. EXCLUSIVE VENUE Any litigation involving the parties


herein shall be exclusively filed and heard in the proper court of
Angeles City.
