REMIX

Question One

What is the major concern in the case of Princes appropriation of Caricous pictures?
What are the photography communitys concerns versus those of the artistic community at
large?

The concern was that a federal appeals court ruled permitting Richard Prince an artist was
allowed to use someone elses work in the creation of his own when he did not seek permission
or give credit to the original photographer. The court ruled that once Prince was transforming the
images into original works of art he was not violating anyones copyright.

The photography community has fired back stating that their ability to recreate original work is
being stifled, and that if artists wish to use their work they should be required to pay a fee. On
the other hand, the artistic community believes that due to Fair use regulations no laws have
been broken.

Question Two

Do you agree with the final ruling on Princes work? Why or why not?

In my view, there are certainly elements of Lois Greenfields photographs that are present in the
work of Richard Princes imagery. As such I do believe that the judges ruling was not fair to the
photographer. The artistic community believes that the law was not broken but under fair use
there are limitations to the use of any works. It states that the copyright holder has the exclusive
right to make any derivatives works such as transformations and adaptations. It is also required
that the user of any works legitimately acquire the work, in which case Cariou did not, and the
works of the original artist must be cited. That too did not happen. The image was used in an
entertainment setting and should have been paid for. Fair use mainly pertains to use within the
educational circle.

Question Three

Do you think a ruling in favour of Cariou could stifle creativity?

I do believe that creativity could be stifled since this case could have set precedence for rulings
of other cases like this one. I do believe that works of others usually serve as inspiration for
many other artists and others bring out their own interpretations. I do however, believe that
credit must be given to the original artist.

Question Four

Do some extra-curricular research on remix culture, what is it? How are young adults
using it today?
Remixing according to Jessell, (2013) is the act of rearranging, combining , editorializing and
adding originals to create something entirely new. Another definition is presented by Knobel and
Lankshear who see it as taking cultural artifacts and combining and manipulating it into new
products and creative blends. Today, many young adults are using remixing in creative
writing, movies. Lessig (2005) cited in Knobel and Lankshear (2008) indicated many of the ways
in which young persons are using remixing. Some of the uses mentioned include, mixing clips
from movies to create new trailers, recording anime cartoons and adding music of their choice,
creating posters, compositing images and a basic use such as adding text to images (p.23).

Question Five

What points does Burwell make about the use and implications of remixing for
contemporary critical learning?

Burwell points out the following:

Young persons need to be introduced to the concept of fair use.


They need to be helped in understanding copyright and to introduce work that is ethical
and imaginative
Stated that remixing allows for important ideas to be introduced and questions asked
Video remixes assist young people and teachers to create an explicit pedagogy of critical
vocabularies.
Allows opportunity to bridge the divide between young peoples experiences of media
technology inside and outside school context
Allows the opportunity to bridge the divide between young peoples experiences of media

.Question Six

What does she suggest schools should adopt in order to take advantage of the potential
benefits of participating and studying remix culture?

Burwell suggests using the various elements around us of sound, symbols and images around us
to express ourselves.

Question Seven

What is your opinion on remixing? Do you think it has a place in post_sec education? Why/
Why not?

I do agree that remixing has a place in post_sec eduation. The main reason is that students get the
opportunity to be as creative as possible. Students will be given the chance to create new works
based on that of others. It also helps with critical thinking. Opportunities can be given to
critique the works of others and to have discussions based on what works in a piece of art or
song and what does not.

Question Eight

What potential does creative commons hold for both Fair Use issues as well as
contemporary remix?

Creative Commons is useful in that the copyright holder can provide licenses that are free to use
without the hassle of having to come to the holder each time. Creative commons also provides
the ease of access to a wide range of material such as audio, texts, video and images that an
individual can use to create almost anything work of art, song or movie that can be imagined.
