NARVASA,J:

OnAugust5,1986petitionersinstitutedinthisCourtaspecialcivilactionforprohibitiontotheendthatrespondentGemilianoC.Lopez,Jr.,actingasMayoroftheCityof
Manila,be"perpetuallyprohibitedfromarbitrarily,whimsicallyandcapriciouslyrevokingorcancelling...theirlicensesorpermits(ashawkersorstreetvendors)and
threateningthephysicaldemolitionoftheirrespectivebusinessstallsintheplacesspecifiedinsuchlicensesorpermits.1Theyalsosoughtatemporaryrestrainingorder
inviewofMayorLopez'actualthreatsofphysicaldemolitionoftheirrespectivesmallbusinessestablishmentat12:00noontoday."ThistheCourtgrantedonthesame
day.2

Petitionersclaimtobefiveofabout130"licensedanddulyauthorizedvendorsof...religiousarticles,medicineherbsandplantsaroundtheQuiapoChurch,...
Manila,"bringingsuit'forthemselvesandallotherssimilarlysituatedasthemselves."3Theyallegethattheirlicenses"wererevokedorcancelled(byrespondentMayor)
forreasonsunknowntothemwhichistantamounttodeprivationofpropertywithoutdueprocessoflaws,"writtennoticeofsuchcancellationhavingbeenservedonthem
onoraboutMay30(actuallyMay3),1986thattherevocationoftheirlicenseswasbeyondrespondentMayor'scompetence,sinceSection171(n)oftheLocal
GovernmentCode(B.P.Blg.337)authorizesthesameonly"forviolationofthelaworordinancesorconditionsuponwhichtheyhavebeengranted,"andnosuch
violationhadbeencommittedbythem4butthisnotwithstanding,respondentMayor"badgiven(them)anultimatumof7:00upto12:00o'clockintheafternoon"(of
August5,1986)tovacatethepremiseswheretheirrespectivestallsaresituatedorsufferphysicaldemolitionthereof."5

Inthelightofthefactsdisclosedbythepleadings6andatthehearingofthecaseonAugust13,1986,thepetitionmustbegivenshortshrift.

Theactionmustinthefirstplacebeabatedonthegroundoflispendens,ormorecorrectly,auteractionpendantpendencyofanotheractionbetweenthesameparties
forthesamecause.7

ItappearsthatonJuly7,1986therewasfiledintheRegionalTrialCourtofManila,docketedasCivilCaseNo.8636563,aspecialcivilactionof"prohibitionwith
preliminaryinjunction"againstActingManilaCityMayorGemilianoLopez,Jr.8ItwasfiledbySamahangKapatiranSaHanapbuhayNgBagongLipunan,Inc."(hereafter,
simply"Samahan")composed,accordingtothepetition,of"some300individualownersandoperatorsofseparatebusinessstalls...mostlyattheperiphery

immediatelybeyondthefenceoftheQuiapoChurch."ThepresidentoftheSamahanisRosalinaBuananditsPressRelationsOfficer,LizaOcampo.9RosalinaBuan
andLizaOcampoaretwoofthefivepetitionersinthecaseatbar,10describedinthepetitionbeforethisCourtassuing"forthemselvesandallotherssimilarlysituated
asthemselves":i.e.,vendors"aroundtheQuiapoChurch."11ThethreeotherpetitionersalsoappeartobeSamahanmembers.12

ThepetitioninCaseNo.8636563isgroundedonthesamefactsasthoseinthecaseatbar:themembersoftheSamahanhadbeenlegitimatelyengaged"intheir
respectivebusinessofsellingsundrymerchandise,moreparticularlyreligiousarticles,flowersandornamentalplants,andmedicinalherbs"theyhadbeenreligiously
paying"thecorrespondinglicenseandpermitfeesimposedbyprevailingordinancesoftheCityofManila,"butthisnotwithstandingtheyhadbeengivenwrittennotice
datedMay3,1986emanatingfromtheMayor'sOffice,advisingofthecancellationoftheirpermitsandtheirpossiblerelocationtoanothersiteandtheseacts"are
unjust,illegal,arbitrary,oppressiveandconstitutegraveabuseofdiscretiononthepartoftherespondent."

TherethusexistsbetweentheactionbeforethisCourtandRTCCaseNo.8636563identityofparties,oratleastsuchpartiesasrepresentthesameinterestsinboth
actions,aswellasidentityofrightsassertedandreliefprayedfor,thereliefbeingfoundedonthesamefacts,andtheidentityonthetwoprecedingparticularsissuch
thatanyjudgmentrenderedintheotheraction,willregardlessofwhichpartyissuccessful,amounttoresadjudicataintheactionunderconsideration:alltherequisites,
infine,ofauteractionpendant.13

Indeed,thepetitionersinbothactions,describedintheirpetitionsasvendorsofreligiousarticles,herbsandplants,andsundrymerchandisearoundtheQuiapoChurch
orits"periphery,"haveincurrednotonlythesanctionofdismissaloftheircasebeforethisCourtinaccordancewithRule16oftheRulesofCourt,butalsothepunitive
measureofdismissalofboththeiractions,thatinthisCourtandthatintheRegionalTrialCourtaswell.Quiterecently,uponsubstantiallyidenticalfactualpremises,the
Courtenbanchadoccasiontocondemnandpenalizetheactoflitigantsoffilingthesamesuitindifferentcourts,aptlydescribedas"forumshopping,"viz:

"Theactsofpetitionersconstituteaclearcaseofforumshopping,anactofmalpracticethatisproscribedandcondemnedastriflingwiththecourtsandabusingtheir
processes.Itisimproperconductthattendstodegradetheadministrationofjustice.TherulehasbeenformalizedinSection17oftheInterimRulesandGuidelines
issuedbythisCourtonJanuary11,1983inconnectionwiththeimplementationoftheJudiciaryReorganizationAct,specificallywiththegrantinSection9ofB.P.Blg.
129ofequaloriginaljurisdictiontotheIntermediateAppellateCourttoissuewritsofmandamus,prohibition,etc.,andauxiliarywritsorprocesses,whetherornotinaid
ofitsappellatejurisdictionThus,thecitedRuleprovidesthatnosuchpetitionmaybefiledintheIntermediateAppellateCourt'ifanothersimilarpetitionhasbeenfiledor
isstillpendingintheSupremeCourt'andviceversa.TheRuleordersthat'Aviolationoftheruleshadconstitutecontemptofcourtandshallbeacauseforthesummary
dismissalofbothpetitions,withoutprejudicetothetakingofappropriateactionagainstthecounselorpartyconcerned.'Theruleapplieswithequalforcewheretheparty
havingfiledanactionintheSupremeCourtshopsforthesameremedyofprohibitionandarestrainingorderorinjunctionintheregionaltrialcourt...(orviceversa)...
."14

Asalreadyobserved,thereisbetweentheactionatbarandRTCCaseNo.8636563,anidentityasregardsparties,orinterestsrepresented,rightsassertedandrelief
sought,aswellasbasisthereof,toadegreesufficienttogiverisetothegroundfordismissalknownasauteractionpendantorlispendens.15Thatsameidentityputs
intooperationthesanctionoftwindismissalsjustmentioned.Theapplicationofthissanctionwillpreventanyfurtherdelayinthesettlementofthecontroversywhich
mightensuefromattemptstoseekreconsiderationofortoappealfromtheOrderoftheRegionalTrialCourtinCivilCaseNo.8636563promulgatedonJuly15,1986,
whichdismissedthepetitionupongroundswhichappearpersuasive.16

ItwouldseemthatafterthefilingbyRosalinaBuanandLizaOcampo(presidentandpressrelationsofficer,respectively,oftheQuiapoChurchvendors'association
knownastheSamahan)ofthepetitioninthiscase,"forthemselvesandallotherssimilarlysituatedasthemselves"(i.e.,themembersoftheSamahan,whoarevendors
intheareaofQuiapoChurch)theycametothebelatedrealizationthatinviewofthependencyoftheidenticalactionfiledbythemintheRegionalTrialCourt(CaseNo.
8636563),theywerevulnerabletotheaccusationof"forumshopping,"andthusamenabletoitsdireconsequences.ThisexplainsthefilinginthisCourtbytheirlawyers
ofa"MANIFESTATIONWITHAFFIDAVITOFWITHDRAWAL"onAugust11,1986,17another"MANIFESTATIONANDMOTION"onAugust29,1986,andan"URGENT
MANIFESTATIONANDMOTIONTOSTRIKEOUTTHENAMEROSALINABUANANDLIZAOCAMPO"onSeptember13,1986.Inthesemanifestationstheclaimis
madethatthefive(5)petitionersintheactionbeforethisCourtwhoaremembersoftheSamahan,"wereforciblybrainwashedandguardedby...(Atty.Reynaldo
Aralar)andhisassociatestoaccedetotheinvitationofthesaidcounsel...toappearforthemandfilethecasebeforetheHonorableCourtknowingly(sic)thathewas
furnishedthestatusquoorderofthesamecasependingbeforetheRegionalTrialCourtBranch45ofManila,"and/orsaidAtty.Aralarandhisassociateshad
perpetrated"piracy"ofclientsand"shouldbecondemnedandsuspendedforcommittingactof'shoppingforcourts.'"TheclaimdoesnotinspirebeliefItissooutofthe
ordinaryastorequireclearandconvincingevidenceofitsactuality,whichislackinginthiscase.ItisalsobeliedbythefactthatRosalinaBuanandLizaOcampo
themselveswereamongthosewhoverifiedthepetitionatbarbeforeanotarypublic.18AndtheclaimisunderminedbythemisrepresentationinBuan'sandOcampo's
"JointAffidavitofWithdrawal"thatthestatusquoorderinRTCCaseNo.8636563wasstillsubsistingandthecasestillpendingtrial19whenintruth,thecasehad
alreadybeendismissedandtherestrainingorderliftedbyOrderofJuly27,1986.

Yetanotherreasonexistsforthedenialofthepetition.Notoneofthepetitionersorthe"otherssimilarlysituatedasthemselves"hadavalidandsubsistinglicenseor
permitasofthedateofthefilingoftheirpetitioninthisCourt,August5,1986,alllicensesandpermitshavingexpiredpriorthereto.20Thisisconfirmedbythefew
receiptssubmittedbypetitioners21whichallsetoutexpirydatesbeforeAugust5,1986.Thepetitionersthushavenobasiswhatevertopostulatearighttoplytheir
tradeintheQuiapoareaorelsewhere.Theargumentthatthenonrenewalbythemunicipalauthoritiesoftheirlicenseswasineffectacancellationorrevocationthereof
withoutcauseispuerile.

Finally,theactionforprohibitionhasbecomemootandacademicbytheoccurrenceoftheactssoughttobeinhibited.Thepetitioners'permitsandlicenseshaveall
expiredhence,therecanbenooccasionwhatsoevertospeakoftheinhibitionofanyrevocationorcancellationthereof.Andthe"physicaldemolitionoftheirrespective
businessstalls"hasalreadybeenconsummated.

WHEREFORE,thepetitionisdeniedforlackofmerit,andtheRegionalTrialCourtiscommandedtodismissCivilCaseNo.8636563andtoconductnofurther
proceedingsinconnectiontherewithsaveinaccordancewithandinimplementationofthisDecision.Costsagainstpetitioners.
