1. Conditions of Sale:
Buyer acknowledges and agrees that Buyer will forfeit the deposit and any rights to the puppy
if:
a) Buyer fails to complete the purchase of the puppy for any reason, or
b) Buyer fails to pay the balance of the purchase price within ___ days of the agreed delivery
date.
In either event, Seller shall be free to sell the Dog to another party.
In the event that the Puppy is not available due to sickness, death, or any other circumstance
owing to the fault of the
Seller, Buyers deposit will, at Buyers option, be either (i) refunded, or (ii) transferred to the
next litter of puppies.
A boarding fee of R________ per day will be charged for every day the Puppy is boarded by
Seller past the agreed
delivery date.
1.1 If the balance is not paid in full by this date or if the buyer has a change of mind for any reason
whatsoever The Puppy will be re-advertised for sale and the buyer will thereby forfeit the full
deposit.
1.2 Puppies are inoculated at 4 and 7 weeks & micro chipped at 8 weeks of age or before being sold
to buyer.
1.3 De-worming medication is administered at two, four, six and 8 weeks of age.(1.2 and 1.3
Appendix B-Vet Card)
1.4 The breeder does not guarantee coat, colour and size or show quality of the Pomeranian.
1.5 This Pomeranian is being sold with KUSA REGISTRATION and breeders restrictions are
enforced where necessary
1.6 The seller agrees to provide the purchaser with all relevant documents issued by the Kennel
Union of Southern Africa.
1.7 The postal address noted will be used and the registration papers will be posted via registered
mail.
1.4 That reasonable care and skill is and/or will be used when explaining to the Buyer the Future
Health and Welfare Needs of the puppy and any advice or recommendations provided in
Appendix A.
1.5 That he/she, having made reasonable enquiries of the Buyer, in good faith believes that the
Buyer is able to meet the Puppys future Health and Welfare Needs.
1.6 That the puppy is more than 8 weeks old at the date of sale.
1.7 That the Puppy has received adequate care and that the Seller has provided it with the
opportunity to socialize with dogs, humans and other animals it is likely to come in contact
with and it has been habituated to the sounds and experiences of a typical family life.
1.8 That, where appropriate, the Seller has provided the Buyer with all relevant registration
papers and pedigree certificate and that any pedigree indicated for the Puppy is accurately
stated.
1.9 The Puppy to be sound in body and good in health, free from communicable disease as far
as appears to the eye.
2.1 That he/she understands the information provided to him/her under clause 1.2
1.9 above.
2.2 That he/she in good faith believes that he/she will be able, and intends, to meet
the Puppys Future
Health and welfare Needs.
2.3 That neither he/she nor any member of his/her household has been cautioned
for or convicted of
any animal welfare law violation such as neglect, cruelty or abandonment.
2.4 That he/she shall not act in any way contrary to any KUSA
endorsement.
2.5 That in the event that he/she is no longer able or willing to provide a
home for the puppy or
otherwise to meet the Puppys future Health and Welfare Needs he/she will
contact the Seller and
have regard to any advice and recommendations that the Seller
provides.
I confirm that the Puppy seems to be sound and Healthy and answers my requirements. I
take full responsibility for this Puppy and promise to make sure that he/she is eating AT
LEAST 3 to 4 times per day. I acknowledge that I received food and feeding guidelines, as
well as information regarding hypoglycaemia which is explained to me in detail. I
understand that hypoglycaemia is very dangerous in such small dogs and will see that this
Puppy eats at EVERY meal and take note that stress can also be a cause of hypoglycaemia. I
will try to minimize any stress as much as possible. I agree to contact the breeder
IMMEDIATELY, should there be any concern/questions regarding his eating behaviour.
It is agreed that at no time will the owner sell or give this puppy to a pet store, puppy mill
operator, a dog pound, or a dog broker or any similar enterprise.
3.1 That the Puppy is a living creature with interests independent of both Buyer and Seller.
3.2 That in the event of the Puppy suffering any pain or discomfort as a result of any breach
of the obligations set
out in this agreement the party not in breach shall be entitled to recover from the
party in breach damages for
such distress and inconvenience as the party not in breach can establish he/she has
suffered.
3.3 Nothing in this contract affects the Buyers statutory rights including any warranty of
satisfactory quality of the
Puppy implied by sale of goods legislation or other law.
The Breeder agrees to Replace any Puppy that comes down with a genetic life threating disease (heart,
liver, kidneys) up to 6 months of age-as most genetic defects manifest from 4 months onwards.
This is an as is purchase, which exempts the seller from any responsibilities or claims,
once the deal, has been concluded.
Upon payment of the sum of R____________ paid by Buyer to Seller (the purchase price),
receipt of which is hereby acknowledge, Seller grants, sells , conveys and transfers
ownership of the Puppy mentioned in General Puppy Information column A).
I/We, the undersigned hereby accept and understand the following conditions upon
purchase of our puppies:
It is the responsibility of the new owner to ensure that the puppy remains in good health
once they have taken the puppy into their care.
By signing the below the buyer understands the terms of this contract and is in full
agreement:
