J ' \ WHEREAS, Republic Act 7160 otherwise known as the l"oca! (Jovernrnent (.'ode
.\ ,.,,/ of 1991 empowers the Sa11gg1miang Panlungsod as the legislative body of the city to
ei10.ct ordinances and appropriate funds for the general welfare of the city.

\\-'HEREAS, Section 458, (a) (5) (ii) and (v) of the f,ocal Gnver11n1ent Code
crnpowers the Sangg1miang Panlungsod to approve ordinances \Vl1ich shall ensure the
efficient and effective delivery of basic services and l'acilitics as provided J'or under
Section 17 thereof and to establish n1arkets, slaughterho11se, public terminals and
authorize the operation thereof by the local government u11it;
WHEREAS, the establishn1enl and development of local eco11omic enterprise:.
and puhlic utilities are provided under Section 313 and 325 o( the Local t~overnrncnt
C.ode;

WHEREAS, Section 76 of the T.ocal Government C'ode authorizes local


government units to design and imple1ncnt its O\Vl1 organization;,11 structure and staffing
patter taking into consideration its service requirements and financial capability, su~jcct
to the n1ini1num standards and guideli11es prescribed by the C'.ivil Service Con1n1ission.

WHEREAS, to regulate the operation and establishment of public markets,


slaughterhouses and terminals in the City of rloilo, the herein Iloilo C:ity Market and
Slaltghterhouse (~ode is hereby adopted.

WH~REAS, to increase generation of revenues by the city's econon1ic


enterprises, increase efficiency and provide better services to the constituents, there is a
need to create a Local f<~cono1nic Enterprise ()ffice to O\'ersec and inanage the operations
all local economic enterprises i11 Iloilo l~ity.

NOW, 'J'JIEREFORE, be it ordained by tl1e Sangguniang Panlungsud of the C:ity


of lloilo that:

CHAPTER I

GF:NERAL PROVISIONS

Section 1. Title. - 'fl1is Ordinance. shall be known as the '"fLOILO CITY t\i'IARKI :T 1

AND SLAUGHTERHOUSE CODF: OF 2009".

Section 2. ..(}cope anti Coverage. - f'l1is Code shall govern the establishment

adn1inistration and operation of the following Iloilo C~ity ]Jublic Markets, Slaughterhouse
and l)ublic 'fcnninal:

(a) Iloilo Central Public Market;


(b) lloilo 'J'crn1inal Public rvtarket;
(c) Jaro Big 11 ublic Market;
(d) Jaro Small Public Market:
( e) f,apaz Public Market:
{f) Mandurriao Public Market;
(g) Arevalo Public Market:
(h) lloilo Slaughterhouse
(i) l\1olo Bus l'crminal;

and all ot11er city public markets, slaughterhouse and public terminals ro be hereinafter
established or created; the imposition and collection of market rentals Jor occupa11cy or
use thereat and other relevant 1narket, slaughterhouse and tern1inal fees and charges; and.
the regulation of the operations of public markets, slaughterhouse and public ter1ninals.

,j Section 3. Aut/1ority to Establish Markets, ,5'/aughterht1uses and l'erminalv. - rhc


City of lloilo, pursuant to Section 458 of Republic Act 7160, other\vi~;e known as the
l,ocal (i-ovenunent Code of 1991, shall have the authority to establish, 1naintain and
operate public rnarkets, slatLghterhouses and public tenninals \vithin its territorial
jurisdiction through an ordinance duly approved by the Sangguniang Panlw1gsod.
Section 4. Declaration of lloilo City Puhlie Markets, 5'/aughterl1ouse anti Bus
Terminal as Economic Enterprise!!. - CI'hc Iloilo City Public Markets, Slaughterhouse
and Bus rerminal arc hereby recognized and declared as Economic Enterprises ovvncd
and n1anagcd by the Iloilo (~ity Govc1nn1ent in accordance with the provisions of the
l~ocal (Tovernment (~ode of 1991.

Section 5. Definition of Terms. - l'or purposes of this Code, the fo!lovling tern1s shall
be understood to mean as follovvs:

a. PLTBJ,IC MARKI~T -- refers to any structure, building, or place uf any kind,


\vhich has been established, designated, or recognized as 5uch under existing
lavvs or ordinances, and those to he established upon the recomrnendation or
the local government. It is a place where the buying and scl!ing ofV\'et and dry
products such as but not limited to n1cat, fish, fruits, vegetables, flowers, and
can11ed/bottled products arc done, and V\rhere eateries or special services are
found or offered. It embraces all markets stalls, kiosks, booths, tiendas.
buildings, roads, drainage and other connections, parking space, tem1inals and
other appurtenances which arc integral parts thereoC

b. CITY PUBI.,IC: MAKr:TS - are those local gov-ernment-owncd and operated


public nlarkets established out of public funds or leased/acquired by any legal
mode or rnea11s fro1n persons. natural or juridical to be operated by the
government either thru its instrumentality, brdnch or political subdivision. Tt
refers to the ''ILOl!_,O CI'l"Y PlJBLJC MARKEcfS" and all the other public
1narkets to be hereinafter created by ordinance duly-enacted by the
Sangguniang Panlungsod

c. MARKET PREMISES - refers to tl1c market stalls, pathvvays, entrances and


exits, delivery areas, parking areas, driveway leading to the delivery and
parking areas. and any other open space in the market con1pound or pa1t of the
n1arket lot consisting of bare grounds not covered by market buildings usually
occupied by ambulant vendors especially d11ring n1arket days.

d. MARKET STAf,L -- refers to any allotted stand, space, co1npar1mcnts, store


or any place wherein inerchandise is sold, offered for sale. or intended for
such purposes in the public market.

e. MARKE'f BC)OcfH - refers to any enclosure built or erected on the n1arkct
space 10r the p1rrpose of the sale of goods, merchandise, co1nmoditics or
services.

f. MARKET SECTIONS refers to the classification of continuous stalls in the
niarkets according to the kind of merchandise oftCred for sale therein.

g. MARK1':T (:OMM IT'"J"E,.E - refers to the body whose duty is to conduct the
drdwing of lots and opening of bids in connection V\'ith the adjltdication of
vacant or 11ewly constructed stalls or booths in the city public markets and to
certify to the City Mayor as the case n1aybc the results thereof.

h. S"l"AI,LHOI,IJER - refCrs to the awardee of a definite space V\1ithin a public


market that pays rental thereon for the purpose of selling his/her
goods/commodities or services.
1. MARKl'.'r RI~NTAL, - refers to the fee paid to a11d collecte(l by the City
Governn1ent thru the n1arket collectors for the privilege of using public 111arkct
tacilitie:> .

.J. MARKET' VENI)QI{ -refers to any person, engaged in business at any public
n1arket in the City of Iloilo.

k. VENDING AREA()}{. STAl,L -- refers to a particular lot, space, building or


any similar stn1cture where anin1al meat, fish, poultry, and livestock are being
sold.

1. I IA WKER - refers to a vendor or seller w110 occupies the side\valk, streets


and otl1er public thoroughfares close to a public market \-vho conies either
daily or occasionally to sell goods or services. or \Vho conducts business
inside a n1arkct \Vithout the necessary pern1it from the ('ity: or vvithout being
necessarily related to niarket activity, conducts business on a rublic street, lot
or property which is ])eing 1naintained by the City.

n1. I TARRORINCT -- act means whereby a person gives shelter and ai(l to an
illegal vendors, or to clandestinely shelter, succor and improperly protect
illegal vendors.

n. MEA 1 -- the terin "meat'' as herein used refers to Jiesh rneat fron1 i.:ov,.._
carabao, goat, sheep and s\vine killed in the City Slaughterhou,se.

o. BI,ADED lNS'l'RlJMl'.N'I' - refers to any sharp pointed implement used in


the market to cut. strip, or otherwise mutilate animal carcasses. 1'hc term
includes butcher k11ife, kitchen kniiC, cutti11g knife. sharpe11ing torque
otherwise kno\vn as "panghasa". and similar instrun1ent.

slaughtered for public.
CHAPTER2

ILOILO CITY LOCAL ECONOMIC ENTERPRISE OFFICE

Section 6. Creation of the lloilo City Local Economic Enterprise Office. - 'l'here is
hereby created a !_,ocal Economic Enterprise OJlice Vihich shall exercise direct.
in1n1cdiate and overall supervision and adininistration over all duly established economic
enterprises and the personnel thereof, including those concerning tl1e 1naintenancc.

accordance \\'ith laws, local ordinances a11d other rules and/or regulations pertinent
thereto.

Section 7. Local Eco11omic 1".:nterprise Manager. - 'fhe C~ity Market i\dminislrator


shall act and serve a._<; the L,ocal Economic l~nterprise Manager under lhe control and
supervision of the C'ity Mayor, however. in the event that other economic enterprises not
related to market, slaughterhouse and hus tenninal operations are suhsequently approved
and declared by the Sangguniang Jlanlungsod, a separate Local Economic E11Lerprise
tv1anagcr shall be designated and appointed by the C~ity Ma)'Or. The Local Economic
Enterprise Manager shall have the following duties and responsibilities

a) Supervise the operation and be responsible for the management of all


economic enterprises of the City of Iloilo that have been placed under
the Local Econon1ic 1::.ntcrprise Office and, whenever required, render
a periodic report as to the status imd conti11ued viability thereof;
h) Ensure that all ordinances and policies governing the operation and
n1anagement of all economic enterprises of the City of l!oilo are
in1plcn1e11ted and con1plied \Vith;
c) Prepare plans, develop and implen1cnt strdtegies, as well as initiate,
review and reco1nmend changes i11 policies, objectives and ordi11ances,
for the efficient and profitable operation and manage1nent of all
economic enterprises;
d) Re responsible fOr the 1naintenance, safekeeping 3J.1d accounting of all
properties, assets, and records under his office;
c) In coordination with the City Planning Developn1ent Oflicer.
formulate economic~centered development plans and policies for
consideration of the City Mayor and the Sangguniang Panlungsod;
f) F,xercise such other _pD\vers and perform such other duties as 1nay be
assigned to him by the City Mayor and/or prescribed by ordinance.

CHAPTER3

SUPERVISION OF MARKETS, SLAllGHTERHOUSE AND TERMINALS

Section 8. City Market Admini~trator. - 111ere shall be a (_'ity Market Administralor


under the l,ocal Economic Enterprise Office and who shall be designated by the C'ity
J\1ayor. 'J'he Market Administrator shall exercise the following powers, namely: monitor
and enforce all lav.s and regulations dealing v.ith the Iloilo C'.ity public n1arkels,
slaughterhouse and public terminals; administer the lease of all cotnmercial stalls and
rreparation of such documents; rccomn1cnd to the (~ity Mayor such inatters as may be
necessary for the development of the City public 1narkets, slaughterhouse a11d pltblic
tern1inats; and exercise full control of the administrative direction of all market and
slaughterhouse personnel. "!'he City Market Administrator shall have tl1e Collowing duties
and responsibilities:
a) 10 n1onitor and enforce all laws, ordinances or regulation dealing \.vith public
n1arkets. slaughterl1ouse and public terminals and/or their operations.

b) ro implement and execute the plans and policies of the ('.ity Mayor i11 the
operation of all city owned/operated public markets, slaughterhouse and public
terminals within his/her territorial jurisdictio11 which normally inch1des sanitation,
cleanliness, business hours, order and deportn1ent inside the n1arket,
slaltghterhousc and terminal premises.

c) 10 n1ake periodic reports to the C-ity Mayor on the status of collection and/or
revenue of the public n1arkets, slaughterhouse and public terminals, as \vell as
furnish him with statistical datJ on prevailing prices of goods therein

d) Supervise and C\ aluate the activities and perforinance of al1 f\.1arkcts and

Slaughterhouse In-Charge and subordi11ates and investigate co1nplaints involving


their public performance~. and attitudes.

e) Exercise administrative authority over public markets, slaughterhouse and public


terminals within the territorial jurisdiction of the City.

f) ro monitor, oversee a11d i1nplc1nenl policies on J1ealth, sanitation, avoidance or


fraudulc11t commercial practices such as short selling, tampering of vveighing
scale and all 1nattcrs relative to proper garbage and \Vaste disposal and other
n1attcrs that affect public 1narkets, slaughterhouse and pt1blic terminals.

g) J>erfonn such other functiqn as 1nayhc required by the lavv or ordinances, or


assig11ed by the City Mayor.

Section 9. Market-In-Charge. "fherc shall be a Market-In-Charge fOr each Public


Market 'Who is under the direct supervision of the City Market Administrator. l-lc shall be
i11-chargc of the market to which he is assigned. [le shall be the cnslodian of tl1e market
and shall have itn111cdiatc administrntivc supervision and control O\'er all subordinate
n1arket en1ployecs who arc assigned to the market where he is In-Charge. rhc Market-in-
C.'hargc shall l1ave tl1e follo'Wing duties and responsibilities:

a) Execute and i1nplen1ent directive and policies e1nanating fro1n the C:ity Market
~\ i Administrator as promulgated by the City Mayor, pertaining to the operation of
the City Public Markets withi11 his respective jurisdiction including those on

sanitation, cleanliness, order and conduct inside the market pren1ises and its
immediate vicinity.

i"\\';\ b) Administer the lease of all the n1arket stalls thereat and prepare the docun1ents in

) \ I connection therewith and submit the san1e to the ('.ity Market Ad1ninistrator.

c) Ensure that all stallholders and transient vendors arc strictly provided with the
corresponding official receipts and prescribed cash tickets, respecti'v'ely. for the
stall or space occupied by thc1n.

d) Sltbmit to the City Market Admi11istrator, for the information olthc C:ity ~ayor ..
monthly summary of collection and /or revenues or as often as may be required by
the c:ity Mayor or Market Administrator.
e) Supervise and evaluate the activities and pcrf(lrn1ance of all subordinate n1arket
personnel and investigate complaints relating to their performance anLVor
attitude/conduct.

f) Perfo1111 other ftmction and duties that may be assigned by the (_'itv Mayor or e_:ity
Market Administrator.

Section J0. Other Market Per,.onne/. - Other 1narket personnel as may be deemed
necessary rnay be appointed in accordance with the existing Civil Service J~ules and
Regulations.

Section I l. Exhibition oj.C'ash TiL'ket and Official Receipt. - It shall he the duly of the
1nark~t stallholders, occupants of spaces or tables or kiosk to exhibit in public v:ie\v the
cash tteket or official receipt t<J facilitate inspection by the C:ity Market Administrator or
his authorized representative.

Section 12. Authority to ._';e// i11 PubliL' Markets. - No person shall sell or offer for sak~
any article or 1nerchandise in the public markets or in any market stall/space/table or
kiosk without l1aving bee11 previously authorized by the (~ity Market Adrninistratnr or l1is
authorized representative.

CHAPTER4

AWARO/AOJllDICATION OF STALLS, CONDITION OF LEAS(;;

Section 13. Applicability. - rhis chapter shall apply only to new srall vacancies
occurring at1er the enactrnent of this <~'.ode and shall not in anyvvay affect the existing stall
assignments in all Public Mark(ts in the C'.ity of lloilo.

Section 14. Market lf1mmittee. - 'fherc is hereby created a perinanent Market


C:o1nn1ittee to be co1nposed of the ('.ity Mayor as Chairman or his duly authorized
representative, with the follovving as me1nbcrs: (a) the (~ity rreasurer; (b) the C~hairn1an
of the ('.omrnittee on Markets and Slaughterhouse of the Sangguniang Panlungsod; (c) the
City Market Administrator; (d) the City [,egal Officer; ru1d (c) a representative of the
Market Vendors Association to be appointed by the City Mayor. 'fhe members of the
Market ('omn1ittec may designate a permanent alternate to act in their behalf. 'l'he Market
Comn1ittee shall decide on the award/adjudication of vacant or newly-constructed stalls
in all (',ity-owned p11b!ic markets to qualified applicants and shall perf(lnn the following
functions:

a) Conduct the dra\ving of lots and opening f{Jr the adjudication of vacant
or newly-constructed stalls or booths in the public mrukcts and cc~'tify
the result thereof to the c:ity Mayor, based on the rules and regulations
to be adopted;

b) [)esignate a Market Secretariat;

c) Adjudicate the transfer of stallholders from one section 1o another, or


from 011e stall to another, and;

Section 15. Adjudication of Stalls. - (Notice of Vacancy). 'fhc (~ity Mayor or l1is
rcpresentative shall cause a notice of vacancy of vacant or newly constructed stalls in t11e
public i11arket to be posted at the following places for a period of not less than te11 (10)
<lays 1mn1ediately preceding the date fixed for their award to qualified applicants to
apprise the public of the fact that such stalls or booths are unoccupied and avai Iable for
lease: (a) at the vacant stall; (h) at the bulletin board of the City !Tall: a11d (c) a
conspicuous space within the inarket pren1iscs. T'his notice of vacancy sl1all suhstantially

Any person, of legal age, Filipino, not legally incapacitated and a resident of lloi!o

obtained frorn the Office of the Market Administrator or Market Secretariat) during
office hours and before 12:00 o'clock noon of ______ , 20 . In case there are
inore than one ( 1) applicant, the award of the lease of the vacant stall/booth shall be

Section 16. Application to Lease Market ._)tall - All applicants !Or vacant or newly
constructed market stalls shall have the following minin1u1n qualification: (a) Filipino
citi?en; (b) eighteen (18) years of age; (c) not legally incapacitated and; (d) resident of
lloilo City 10r at least six (6) months prior to his/her applicatio11 as shown by the requisite
barangay ce11ification and voter's ID.

An application fee shall be collected J'rom each applicant to cover the 11ecessary
expenses relative to the award and leased of the stall. An application shall be furnished to
the applicant who shall accomplished under oath and submit the sai11e to tl1e Market
i\dn1inistrator together with his/her barangay certification, voters JD and two (2) pieces
of ID pictures. It shall be lhc duty of the Market Adtninistrator to keep a registry of books
shovving the names and addresses of all applicants for vacant stall/booth/table, the
numbers and descriptions of the stall/booth/table applied for by them, and the date and
hour of the receipt by the officer to ackno\vledge receipt of the application, setting forth
therein the time m1d date of receipt thereof.

CHAl'TER 5

STALL OCCllPANCY

Section 24. Requisite After (;rant o}~'italls. - rhe successful applicant shall f11rnish the

Section 25. l'orjeiture 1Jj Righi.\'. - J~ailure lo occupy the awarded stall \<Vithin sixty (60)
days after the drawing lots shall mean automatic forfeiture of the right and privilege to
tl1e said stall.

Section 26. Transfer. - Stalls n1ay be transferred from the original O\Vner only after the
lapse of six (6) mo11ths from the cffectivity of the contract provided, a transtt-r fee and
(Jood\vill Money are paid by th1~ transferee. 'Transfer in violation of this Section shall be
considered null and void.

Section 27. Vt1<-'ancy of Stall B1ifore Expiration of the lease. - Should for any reason a
lessee discontinue or be required to discontinue his/her business before his/her lease of
the stall expires sucl1 shall be considered vacant and its occupancy thereafter shall be
dispensed of in the 1nanner prescribed i11 this ('ode.

Section 28. Partner.~hip with Stal/holder. - 1\ Inarket stallhol<ler vvho enters into
business \Vith any party after he had acquired the right to lease such stall have no
authority to transfer to his partner (s) the right to occupy the stall and shall be subject to
the provision of Section 24 of this Code. Provided, however. that in case or death or any
legal disability of such stallhol,ier to continue in his business occupying the stall for a
period of not exceeding sixty (60) days within which to wind up the business of the
partnership. If tl1e surviving partner is otherwise qualified to occupy a market stall under
the provision hereof and the spouse, parent, children and relatives within the sixth degree
of consanguinity or affinity of the deceased is not applying f()r the stall he shall be given
the preference to contintte occupying the stall/table concerned if he applies therefore.

Section 29. Death, Di.-.ability or Incapacity of ~'ta/lho/der. - lJpo11 the death. disability
or incapacity of the lawful holder of the stall/booth in the pltblic 1narkcts of the ('ity or
lloilo, all his rights and privileges previously acquired shall be transmitted to the
Collo\ving order: (a) surviving spouse; (b) legitin1ate children; (c) the father or mother of
the occupant of the stall and; (d) relative within the sixth degree of consanguinity in the

his helpers.

Section 31. Number oj ...Stall Leased to Each l"amily. - Number of stalls leased to each
fB.mily shall not exceed one. No fatnily shall be allowed to have 1nore than one stall. For
purposes of this Section, fffinily relations shall include those between hushand and V..'ife.

or lessee of a stall/hooth, in tht: pttblic market is found to be in reality not the persons
\Vho is actually occupyi11g said stall/table, the lease shall cancelled and the stalll1older
ejected. If upon investigation such stallholder shall be found to have sub-leased his/her
stall/table, to another person or to have connived with such person so that the latter may
lOr any rcaso11 not be able to occupy the said stall/table said lease shall also he cancelled
and the stallholdcr ejected. ,-rhe stall shall be declared vacant and adjudicated
accordingly.

Section 33. Disqualification b.v rea.von of communicable disease. - No person suf!Cring


fron1 any comn1unicable disease shall he pem1itted to engage in business in any pltblic
1narket or may be employed therei11 in any capacity.

Section 34. Forward Movement. - When a stall or series of stall hecome vacant, the
adjoining stall holders shall have tl1e preference to the lease or occupation of the vacant
stall/table in \.Vhicl1 case the occupant of stall located i11 the line stall(s) co11cerned, 1na)

1nove forward toward the comer stall; provided, however, that this sc<:tion shall not apply
to stallholder who arc not citizens of the Philippines. Provided, furthermore, that the total
number of stallholders in a given line of stall, l1alf are entitled to 1novc toward the right
\vhen all of the vacant stall (s) are on their right; the other half toward the left corner
should contrary be the case; and provided finally, that the right to n1ove toward the corner
on stalls vacated only and be expressly waived, in \.Vhich case, the stallholders
inunediately next to the stallholder~ refuses to move forward, may occltpy the stall (s) not
occupied.

Section 35. Occupation of Stalls. - Stallholders shall not be allowed to occupy stalls or
space other than those leased to them and it shall be the dlLty of the Market Tn-l--:harge and
his subordinates to enforce this prohibition.

Section 36. Losse.-. or Damage.v of Stal/ho/1/ers. - The City shall not be responsible to
stallholders for any losses or damages which said stallholders may incur in the public
I n1arkets by rea'ion of fire, theft, and other causes, for any merchandise or property left in
the public markets during the hours the public 1narkets are closed and it shall be tl1e duty

and care to prevent such loss of private and public property therei11, and for these purpose
apprehend and tum over to the police any person or persons committing any offense in

i fOr any dan1age or loss of articles or n1erchandise in the public 1narkcts that may be
/ occasioned by fire, theft, or other causes, and all such articles and n1erchandise deposited
therein during the tin1e the n1arkets are closed, shall be at the risk of the market occupant;
provided, however, that it shall be the duty of the policetnan detailed thereat as guard to
take such precautions as may be necessary to prevent any damage or loss to property.
CHAPTER6

MAINTENANACE OF PlJRLIC MARKETS

Section 38. General Mainten11nce of Public Markets.

a. Every public marke1 shall be adequately ligl1ted and ventilated, the ground
surface sl1all be properly drained and paved, and all sta11ds, stalls, tables and
market ftxlure and building shall be constructed in accordance \Vith the
necessary plans and specification recommended by the City Market
Administrator approved by the l~ity Engineer and the City Mayor.

b. All electrical connection fOr market alleys, passageways and C:ity Offices
shall be separate connection and n1eter which shall he the responsibility of the
c:ity CJ-overnmcnt.

c. Any vendor or occttp~ml of market stall/table who desires to have electric light
or corn1ection i11stalled for his/her stall/booth shall furnish the 1naterial and
labor and that the in:,;tallation be under the direct supervision and approval of
the Market Electrician. Any electrical connection not duly approved by the
Market Electrician :>hall be considered an illegal co1111ection and shall be
retnoved and confiscated by market personnel. Violation of this provision
shall be considered as a ground for cancellation or revocation of the l,ease
c:ontract.

d. It shall be prohibited for a stallholder to use or tap the electrical connection of


another stall/booth or consent to be used or tapped for use of his/her O\Vll
electrical connection for the use of another stall/booth vvithl1ut the approval of
the Market Administrator and Market 1-:'.lectrician. Any electrical connection in
violation of this provision shall be considered an illegal connection and shall
be removed and confiscated by n1arket personnel. Violation of this provision
shall also be considered as a ground for cancellation or revocation of the
f .ease Contract.

Section 39. Sanitao Mainlenance. - T'hc sanitary regulations provided i11 this section
and those which may be pro1nulgated hy the C~ity Health OJ1icer for the sanitary
1naintenancc of the public markets, the slaughterho11se a11d other public enterprise in this
(:ity shall apply.

a. The l,cssee shall obligate himself to keep and 1naintain the leased premises
and areas immediately bordering said premises in good. clean and sanitary
condition and, except for ordinary wear and tear, return the sainc in good
tenantable condition as originally received.

h. No stallholder or any other persons shall place refuse on the floors, stills or
any place other than the garbage receptacles provided for the purpose.
c. for each stallholder or occupant of any stall in 1l1e City Public Markets shall
provide the1nselvcs with a garbage receptacles and the cleaning of tl1e n1arkct
stall including the tloor spaces and all appurtenances thereto shall be done hy
the stallholders and their helpers during market hours. Ail \.Vastc n1aterials,
garbage and refuse shall be place hy them in the garbage rccc11tacles provided
i11 the preceding 11aragraph \Vithout prejudiced to the (,ity providing suili.cient
nun1bers of laborers who shall be charge with proper cleaning of the public
n1arkets under the in1n1ediate direction and responsibility of the C'ity Market
,A.dministrator \vho shall see to it that the markets are n1aintai11ed in clean a11d
sanitary condition. All activities incident to the cleaning of stalls as herein
provided shall be under the direction and supervision of the C'.ity Market
Administrator.
d. No shanty or structure in the n1aru1cr of an i11depcndent room shall he
permitted to be put up or co11structed in or about the public 1narkcts other than
the building authorized for the offices of the 1narkets employees or other ('.ity
pttrposcs

Section 40. Water. - 'fhe water consumption of each stall holder shall be their exclusive
responsibility at1d directly connected to the main water pipeline of Metro Iloilo \\later
[)istrict (M!Vv'D). In no case shall the City Government be held liable for any disruption
of 0...-atcr supply, nor unpaid \Vater bill of any stalll1older. Provided, l1owever, that the City

shall provide \Vater for the necessary 1nai11tenancc, sanitation and cleaning of public
n1arkets and other public enterprises.

Section 41. Division/..'Section of Market Proper. -

a. Every n1arket shall be conveniently divided into section according to the kinds
of111erchandisc of1ered for sale. and the sale of merchandise pertaining to one
section shall not be allowed in otl1er section; provided, that the c:ity ~1ayor for
the good of the public may grant temporary pennit not to exceed thirty (10)
days, to sell merchandise pertaining to one section into another section until
after said public goods shall be been satisfied, but the pover to be exercised

RESTRICTION ON MARKET PREMISES

Section 42. Prolribition to Throw Garbage. - It is prohibited to thro\v garbage, refuse or


waist 1naterials other than in the garbage can provided for the purpose by each

Section 43. Unlawful Deposit and Manufacture. - It shall be unlawful to deposit or


111anut3cture any kind of article or to maintain pens for domestic fo\.vls, pigs, and other
anin1als within the pren1ises of the public markets.

Section 44. Unlawful ('ooking. - It shall be unlawful to cook any food or comn1odity
\Vithin the public nlarkets except in stalls for carindcria, cafeteria or eatery vvhich are
pern1itted to cook in stove provided \\>ith cl1in1neys or gas range.

Section 45. Bicycles, Motorcycles not Permittetl. - Bicylccs, motorcycles, carts, caritos
and any other kind of conveyan.ces or vehicles shall not be permitted to enter the public
1narkE~ts.

Section 46. Proltibition on Sale. - No person shall sell or offer for sale fruits, legun1c,
fees, domestic fowls, eggs, meat and native delicacies or ''chuicherias" outside of the
public markets, or within a distance of One Hundred (100) 1netcrs l""ro1n the market
premises ltnless the said articles or merchandise arc being sol(l in private building.

Section 47. Proltibition on Passagewa}'S. - No person shall peddle, sell or offer for sale
any a11iclc or 111erchandise in the passageways of the public n1arket which are i11tended or
the people to pass along one section of the nlarket to another.

Section 48. Proltibition as Dne/ling Place. - 111 110 case shall any n1arket stall or booth
or any portion thereof inside the public n1arket be converted into a ten1porary or
permanent dvvelling. No persort shall be permitted to pass the night in the public tnarkets
except in case of emergency and \Vi th the permission of the Market Adn1inistrator.

Section 49. Orderliness. - All provisions, merchandise goods or articles offered for sale
in the public 1narkets shall be so arranged as not to protrude; that no portion of the alleys
shall be obstructed, and that floor stands, stalls and all other places or things used for
exposing the sa1ne can be easily and perfectly cleaned. All merchandise, and all other
places and things shall be placed i11 such manner as the C.'.ity Market J\clrni11istrator may
direct.

Section 50. E.'Chibition of Goods. - Whenever any article shall be exhibited in any
public market, as if the same were intended for sale, whether sold, or not or directly
offered for sale or not such exhibition shall be held and construed as exposure of the
same for sale and offer to sell \Vithin the meaning of this code.

Section 51. A.~signment to Section. - Vendors shall be assigned to sectton, according to


the nature of the articles, intended for sale, and any attempt to occupy any stall for any
purpose other than that for which it was specifically assigned, shall render void any
privileges granted to the stallholders. Helpers and vendors or sellers in public markets
shall at all times treat n1arkct customers or purchasers with courtesy. Violation of these
requirements shall he dealt with by competent authorities as tl1e facts a11d circu1nstances
of each case n1ay warrant.

Section 52. Peddler.<; or Hawli.ers. - Jleddlers or hawkers shall not be pern1itted in the
public markets of the Cit)' or its surroundings, Viithin a radius of 100 meters from its
confines, to offer for sale of articles or n1erchandise which are sold or exposed !Or sale in
the stall/booth or kiosk of said markets, in order to avoid unjust competition. Neither

shall they be perinitted to expose merchm1dise on sidevvalks, courts (patio) or place for
the passage of the public inarkels of lhe City of lloilo. Market officials a11d employees
a11d policen1e11 detailed in the \ricinity of the public n1arkets shall exercise strict vigilance
un this n1attcr and enjoined strict compliance with this provision. Neither shall ru1y person
be pc1n1itted to peddle, ha\.vk, ~:ell, offer for sale, or expose or sale any article i11 the
passageways or aisles of any public 1narket.

Section 53. Disqualification to Lease. ~ Should a stallholder be ejected frotn his stal I for
l'.ause, as provided for in this Code, he/she shall be disqualified from the leased of said
stall or any other stall in at1y public market of' the City for a period oft\-VO (2) years.

Section 54. NuL'iance. - No person shall conimit any nuisance, con1mit disorderly
conduct, obstruct public market passageways and sidewalks or do any other act \\hich is
calculated to result in breach of peace. All articles displayed in any public market in
violation of any provisio11 of this C'.ode or any rules and regulation related to the
management of the C'ity Public \1.arkcts shall be deemed a nuisance. It shall be the duty
of the C'.ity Market Administrator or his representatives to take custody, and confiscate
sai<.l goods/articles and/or remove all obstn1ctions of passageways anti sidewalks, in
addition to the penalty i1nposcd in this ('.ode.

Section 55. Loafing, Loitering and Begging not Permittetl. - No person not having
lawful hl1sincss in or about any public n1arket shall idly sit, loLmge, walk or lie in or about
the pren1ises of the same nor shall any person beg or solicit alms in or ubout any public
n1arkets.

Section 56. Signboard.Ii for Mea( Vendors. - All tneat ve11dors shall hang signboards
shovving the kind of meat tl1ey are selling or offering for sale. No other kind of meat shall
be pluced under the sign board other than sl1own thereon. "fhe City Veterinarian or his
authorized representative shall sec to it that the provisions of this Code relative to the
rules and regulation of the National Meat Inspection Commission are complied with
strictly.

Section 57. Obstruction. - No person shall annoy or obstruct market employees in the
I discharge of their duties; nor shall any person sit or lie on any market stall or table or play

Section 58. Stray Animals. - No dogs or animals shall he left stray in any pltblic

markets and the C:ity Veterinarian thru his subordinates arc hereby en1powered to catch
such stray animals and to impound them in the ('.ity pound for dispositi<1n as in the case
of other animals impounded therein.

Section 59. Littering, Urint1ting and Defecating. - It shall be prohibited to litter. urinate
and defecute in any parts of the public markets except in duly designated pl1blic toilets in
case of the latter tvvo. Violators \Vil! be punished in accordance \.Vith applicuble and
existing laws and ordinances.

Section 60. Gambling and Other Illegal Acts. - Cia1nbling, in any tOrm, or ai1y other
illegal acts punishable under the Revised Penal Code (i.e. selling of stolc11, illegal or
contrabai1d ite1ns) shall be strictly prohibited \.Vithin or about the premi~es of the public
1narkets.
Section 61. Adeq11ate Attire in .Publil Mt1rkets. -- All vendors in all public n1arkcts arc
re<.1uired to wear proper \.\-ork clothes/attire, preferably t-shirts/sando and punts or short,
and absolutely no bare or naked upper body for men; t-shirt/blousc \Vith
skirts/pants/short, or any other dress, for women: and apron; in the canteen, vegetables,
meat, fish and poultry section ofi:hc public markets.

CHAPTERS

MARKET RENTALS, FEES AND CHARGES

Section 62. Collection of 1'~ees or Rental. - rhe City of Iloilo may collect fees or rentals
for th..:: occupancy or use of the public 1narkcts and premises in accor<la11cc \Vilh this
C'hapter.

Section 63. PO}'ments of Rental and Other Charges. - 'J'he stall rental/occl1pancy fees
fixed in this Chapter shall be payable on a nlonthly basis, with the in1position of the
proper surcharge in case of late payment. Non-pay111ent of rent for t\VO (2) n1onths,
\vhether consecutive or con1mulativc. shall he a ground for tl1c canccl!ation of the lease
and the ejectment of the lessee from the lease premises. The n1anner of pnyment for
electricity. water m1d other rnainten<1nce cl1arges shall be in accordance \.Vith the
regulations to he issued by the C'ity Market Adn1inistrator and specified in the C:ontract of
Lease.

Section 64. Rentals JOr Fixed ~'itajls. - Every legitimate occupant rentir1g stalls in (,'it)
public niarkcts shall be charge with rentals for stall occupmicy in acconJance with the
rates/schedules prescribed in this C~hapter.

Section 65. Market Fees. - rhe C:ity of Iloilo inay collect fees or rentals for tl1e
occupancy or use of public m.arkets <1nd premises in accordance vvi111 this (~hapter.
provided. l1owever. that the n1arket fee must he paid in advn11ce before any perso11 can
sell, or offer to sell, commodity or n1erchandisc vvithin the public market and its
(' premises.

Section 68. Automatic Increase of Rental Rates. The rate of rentals under Section 67 of
this Ordinance shall be subject to automatic increase every t\vo (2) years at the rate
equivalent to ten percent (10%) thereof:

sign of the lessee of the avvarded stall, duly approved and authorized hy and posted in
aecorda11ce with the regulatio11s of the Market rn-Charge, no notices, sign, streai11er,
baru1er or other advertising medium 1nay be displayed, posted, affixed, inscribed or
painted \.vithin or outside the stall premises or on m1y part of the Market J>re111ises, except
as authorized in \Vriting by the (:ily Market Ad1ninistrator. :Further, all pron1otional
displays to be i11stalled or set-up on any part of the Market Premises outside of the
co11fincs of the leased stall shall require the prior written approval of the C:ity Market
.4.dministrator and subject to the paymcnl of Promotional Display l''ee of ()ne Thousand
Pesos (P 1,000.00).

Section 70. Permit Fee to Renovate. - Any person v,.:ho shall alter, disfigure, and /or
change the structure of any stall or 111arket shall secure a written permission fro1n the City
Market Adn1i11istrator before p&.ying tl1e Pcm1it fee to Renovate of '!\vo Hundred Pesos
(P200.00).

Section 71. Transfer Fee. - Any person who applies 10r tl1e transfer nr the award of a
stall shall pay a Transfer Fee of Five 'Thousand Pesos (P 5,000.00)

Section 72. Goodwill Mone):. - Any person a\.varded a stall/table in the City Public
l'v1arkets shall pay a Goodwill Money based on the rates provided under Book IV,
('hapter Ill of 'fax ()rdinance No. 2007-016 otherwise known as the "Revised I~ocal
Revenue (~ode of the City of Iloilo" as follows:

Section 74. Other Market f'ees and Charges. - 'fhe foregoing section shall be \.vitholtt
prejudice to the power and authority of the Sangguniang Panlungsod to impose and
collect other relevant market fees and cl1arges as it deem necessary or to an1end, revise or
rnodify the rates prescribed herein.

CHAPTFR 9

SLAUGHTERHOUSE 'EES AND CHARGES

Section 75. Slaughterhouse-In-Charge. - There shall be a Slaughter-In-Charge 10r each


Public Slaughterhottse who is under !l1e direct supervision of the C:ity Market
Ad1ninistrator. He shall be in-chcugc of the slaughterhouse to which he is assigned. He
shall be the custodian of the slaug,htcrhouse and shall have i1nmcdiate administrative
supervision and control over all subordinate slaughterl1ouse en1ployees who are assigned
to the slaughterhouse where he is ln-C~harge.

Section 76. Slaughterhouse Fees. - rhe City of lloilo shall collect lt:cs for lhc slaughter
of animals a11d poultry or the use of corrals in accordance witl1 the rates provided under
l3ook IV, Chapter VI ofl"ax Ordinm1ce No. 2007-016 otherwise known as the "l{evised
L.ocal Revc11ue Code of the C_'ity of Iloi!o" and \Vhich rates arc hereto re-adopted in t11is
lhaptcr.
Section 77. Permit to 5'/aughter and Fee (City Veterinarian). - Before any animal is
slaughtered for public consurnption, a permit therefore shall be secured fron1 the City
Veterinarian or his du!)' authorized representative and the corresponding fee collected by

Section 79. Place of Slaughter. .- "(he slaughter of any kind of animal for sale or
co11sumption of the public shall be done only at the ('ity Slaughterhouse. 'fhc slaughter of
animals intended for home consumption may be done elsewhere except large cattle,
provided, that the animal slaughtered should not be sold or offered for sale.

Section 80. Post Mortem Fee. - 'fhere sl1all be collected for each kilogram of animal or
poultry meat, including tongue, heart, and liver of any animal or poultry a Po.st Mortem

Section 81. Requirements for the Issuance of Permit for the Slaughter of Large Cattle.
- l.Jpo11 the issuance of the pcnnit to slaughter, the large cattle shall be slaughtered at the
City Slaughterhouse. Before issuing pern1it for the slaughter of' large cattle, the meat
inspector shall require for bra11ded cattle the productio11 of the certificate of ownership if
the owner is the applicant, or the original certificate of ownership and the certificate of
transfer sl1owing title in t11e name of the person applying for the permit if he is not the
original owner.

]f the applicant is not the original owner and there is no certificate of trm1sfCr
111ade in his fa\'Of, one such certificate shall be issued and the corresponding fee
collectible therefore. For unbranded cattle that have not yet reached the reqttired age for
branding,

the 1neat inspector shall require evidence satisfactory to hin1 regarding the ownership of
the animal for which permit to slaughter has been requested. for unbranded cattle of the
required age, the necessary owner's certificate and transfer certificate shall be issued tl1c
corresponding fees collected therefore before the pern1it is granted. rhe following rate
shall apply:

Section 82. Corral Fee. - Fees at the rate herein fixed, per day or fraction thereof

Section 85. Ante Mortem Fee. - F'ee for the examination of animals and fo\.vls by the
City Veterinarian or his authorized representatives prior to slaughter. Animals shall be
prevented from being slaughtered if found with a disease or in an abnorrr1al condition:

Section 86. Pena/ff. - Por violation of any provision of this Chapter, there is hereby
imposed a penalty of a fine of not less than P I ,000.00 nor more than P 5,000.00 in
addition to confiscatio11 and forfeiture of his con1mercial good/articles and/or cancellation
of b11siness pennit and closure if committed by a business establislunent.
CHAPTER 10

BUS TERMINAL

Section 87. T'his Chapter shall govern the in1position and collection of taxes, fees and
other charges in public bus terminal. r11e taxes, fees and rates as provided under Book
IV. C~haptcr VIII of Tax ()rdinance No. 2007-016 other\.vise known as the 'Revised Local
Revenue Code of the C'ity of Iloilo" are re-adopted in this c:haptcr.

Section 88. Terminal-ln-Cltarge. 'fhe City Market Administrator shall designate the
l'ern1inal In-Charge and such personnel necessary fOr the operation of the public tcrn1inal
and the latter shall be under the direct supervision of the City Market Adn1inistrator. The
Ten11inal In-C:hargc shall be in-charge of the public terrninal to \vhich he is assig11cd. He
shall be tl1e custodian of the market and shall have immediate administrative supervision
and control over all subordinate ter1ni11al employees \Vho are assig11ed to t11e ter1ni11al
\Vhcre he is In-Charge. A market-in-charge may be designated as concurrent terminal-i11-
charge taking into conslderatio11 the size of the public market and terminal mid nun1ber of
daily transactions.

Section 89. Bus Terminal Fee. - 'I'he following f~us rcrminal fee are hereby iniposed
and shall he collected, as follows:

a) Trucks with seating capacity of30 persons and belo\\l - - - l> 30.00/trip
b) rrucks with seating capacity of 31 persons and above - - - J> 60.00/trip

Section 90. Concessionaire F'ee~ on Businesses. - Aside from the usual local taxes
payable by person and businesses, there is hereby imposed a concessio11airc fee on
businesses vvithin the bus terminal not otherwise imposed in the preceding section as

WEIGHTS AND MEASURES

Section 91. Authority of Market Personnel. -Market perso1U1el are hereby authciriLed to
inspect, test, confiscate and impound weights and meas1tres within the public markets.
prosecute violators thereof and perform such other duties under c:hapter v or '{'ax
()rdinm1ce No. 2007-016. rhe City 'freasurer may likcvvise authorize n1arket
Slaughterhouse personnel to seal weights and measures.

<,, Section 92. Confiscation of tampered .\cale. Section 81, Chapter V of rax Ordinance
No. 2007-0 ! 6 otherwise known as the "llevised J,ocal Ilevenuc (:ode of the (~ity of
Tloilo" is hereby 1nodified and amended to include the follo\ving provision:
''d) In addition to the above-penalties, the scales shall be
confiscated/impounded and turn1;'d over to the City Treasurer's
()ffice or Market Administrator's ()[lice. In cases 11ot involving
fraud ai1d 1nay be subject of Sectio11 82 hereof, the c_:ity 'l'reasurer
or market personnel shall ensure that the confiscated device is
released to the ov...ner cn1ly when the defective devise has been
corrected and sealed and the corrcspondi11g penalties and/or fc~s
have been paid. If after a period of seven (7) days, the confiscated
weighing scale is not redeemed by its owner, said scale shall be
destroyed. In cases involving fraud, the City 'freasurcr or Market
.i\dministrator shall secure and prcsen.e the same and present it
forth\vith to t11e C:ity I)rosecutors pursuant to Section 76 hereof:"

FLEA AND NIGHT MARKET

Section 93. Flea and Night Market. - T'he City of Iloilo may, by ()rdina11cc, create, fix
and regulate flea and night tnarket as well as ambulant vcndi11g in any C'ity Street or
designated thoroughfare.

Section 94. Rates of Taxes, fee~ and charges. - J11 pursuant to the provision of the
immediately preceding Section. the Sangg11niang Panlungs{>d sl1all fix tlie rates of taxes,
fees and charges after calling for a ptlblic hearing on any proposal under this l-,hapter.

Section 97. Transfer of affected personnel. rhe employment of o11iccrs/employees


affected by the aforementioned transfer of plantilla positions to the Office of the lloilo
C:ity Economic Enterprise ()ffice shall he deen1ed transferred to said Office without loss
of rank including the plantilla positions they occupy.

Section 98. Detail of Per~"onnel from other Offices and Market Electrician. The (~it)1
Mayor n1ay detail existing persotmel of the ('ity f~ngineer's ()[fice, (Jeneral Services
()ffi.cc and other offices presently assigned in pttblic markets, slaughterhouse and bus
tern1i11al upon effcctivity of this Ordinance. Personnel of the City T~ngineer's ()ffice \Vho
\Vill be detailed to public n1arkets, sla11ghterhouse and tem1inals as Market 1-<:Iectricians
shaJJ give utmost priority to their assignment as Market Electrician abuvc all other duties
that n1ay be imposed upon then1 by their superior.
CHAPTF,R 14

MISCELLANEOUS PROVISIONS

Section 99. Business Hours. T'he stall holder shall conduct 11is business in the leased
stall/booth during hours fixed by the Market Administrator. Should there he any change
in schedule, the stall holder shall be duly notified prior to its effectivity. J>osting of the
notice at the entrance of the public market and bulletin board shall be deemed sufficic11t
con1pliance of this Section.

Section J00. Collection. - Collection of rentals, fees, and other charges shall be
undertaken by the (~ity Treasurer or his representative, to be evidenced by the necessary
()flicia! Receipt. All collection shall be remitted daily to the City Treas11rer's ()tlice.

CHAPTER 15

PF:NAL PROVISIONS

Section 101 .')urcharge and Interest. - rherc shall be imposed a surcharge of not more
than twenty five percent (25%) for the late payment of rental, ligl1t and otl1er fees and i:ln
interest of not exceeding two percent (2?-1>) per month of the unpaid a1nount incl11ding
sltrcharg,cs until such amount is fully paid but in no case shall the total interest on the
unpaid an1ount or portion thereof exceed thirty-six (36) months.

Section 102. Non paJ'ment of.rentals and t>ther fees. Any stallholder vvho fails to pay
any market rental including interests and surcharges for at least three (3) months shall be
automatically ejected fron1 the leao;;cd premises in accordance with the lease contract. Any
stallholdcr wl10 fails to pay any light and/or water fees including interests and surcharges

/ for at least one (1) month shall authorize the 1narkct personnel to disconnect his electric
\'
und/or \Vater connection in accordance Viitb the lease contract. Non-payment of market
rentals and electric and/or water fees shall likewise be grounds for revocation of the lease
contract.

Section 103. Cancellation of Lease and Ejectment. - Any stallholder, his/lier helpers
who violates any provisions of this Code shall be sufficient cause for the revocation of
his/her lease contract ai1d shall be ejected fro111 the stall/table or space so occupied in
accordance vvith the Lease Contract. 'fhe revocation or cancellation of such lease contract
inay be effected by the City Mayor upon rcco1nmendation of the City Market
J\d1ninistrator after observance of due process.

Section 104. Penalty. ~ A11y person found guilty of violating any ])rovisions of this (:ode
shall i1nmediately be apprehended and he nieted a fine of not less than One Thousand
Peso~ (Pl,000.00) or imprisonment of one (I) month hut not more than six (6) n1onths or
both, at the discretion of the c:ourt.

Section 105. Administrati11e Penalty. - Any person ca11ght in the act of violating any
provision of this (~ode shall he subjected to the confiscation and forfeiture of his

' co1nn1ercial goods or articles and the same shall co11stitute a ground for clo~ure and
cm1cellation of his h11siness permit.
Section 106. (~ompromise Pena/I}'.- Before a case is filed in court for any violation of
this Code, the C.'.ity Market Adn1inistrator, as authorized by the Cil)' Ma)'Or, is authoriLed
to settle an offense which does not inYolve fraud, the of-fender may be allo\ved to pay a
compromise settlement fee of()ne 'fhousand Pesos (Pl,000.00) vvith the obligation on the
par1 of the offender to pay any and all unpaid tax, fees and cl1arges due hin1 as provided
u11der this Code and other ordinances. cfhis provisio11 \Nill not apply to acts cornmitted
which are punishable under the Revised Penal C:ode and other special !avvs.

CHAPTER 16

FINAL PROVISIONS

Section 107. Separability Clau!Je. -If for any reason, any part or provision of this (\"Jdt
shall be held to unconstitutional or invalid, other parts or provision hereof \.vhicb are not
affCcted thereby shall continue to be in fllll force ai1d eflCct.

Section 108. Repealing Clause. Ail ordina11ces and administrative regulations or


ponions thereof which are inconsistent with any provision of thi:o, ()rdinancc are hereby
repealed or modified accordingly.

Section 109. Fffectivity. - rhi~, ()rdinancc shall take effect upon its appro\al by the C'ity
Mayor and after due publication.
