1.1 EXPLAIN THE IMPACT OF KEY LEGISLATION THAT RELATES TO FULFILLMENT OF RIGHTS AND
CHOICES AND THE MINIMISING OF RISK OF HARM FOR AN INDIVIDUAL WITH DEMENTIA?
The key legislation are Human Rights Act 1998, Mental Capacity Act 2005, and Adults with
Incapacity Act 2007, Mental Health Act 2007 Disability Discrimination Act 2005, and
Safeguarding Vulnerable Groups Act 2006. These law are in place to protect individuals
from harm and abuse. These regulations are also made to make sure that persons with
dementia are respected by health and social care workers regardless of their condition
because they have the right to make their own decisions and choose the care they want.
2.2 EVALUATE AGREED WAYS OF WORKING THAT RELATE TO RIGHTS AND CHOICES OF AN
INDIVIDUAL WITH DEMENTIA?
The agreed ways of working that relate to rights and choices of individuals with dementia
can be done by following the correct rules and regulations with in the care settings.
Employers must see to it that implementation of these laws are strictly followed by the
heath care and social workers. They must also abide with the set of standards that the
state require so they can provide efficient, effective and quality care among their
residents.
1.3 EXPLAIN HOW AND WHEN PERSONAL INFORMATION MAY BE SHARED WITH CARERS AND
OTHERS, TAKING INTO ACCOUNT LEGISLATIVE FRAMEWORKS AND AGREED WAYS OF WORKING?
The law of confidentiality protects people from having their personal details be shared
without their consent. Personal details can only be shared for example if it is necessary,
health care workers can inform other medical practitioners regarding the condition of the
resident. This way they can give due medications and treatment needed.
