REGULATION ORDINANCE NO. 2017-041


AN ORDINANCE INSTITUTIONALIZING THE AREVALO AND
CALUMPANG LYING-IN CLINICS AS BIRTHING FACILITIES IN THE
CITY OF ILOILO

WHEREAS, Section 11, Art. XIII of the 1987 Philippine Constitution states that
"The State shall adopt an integrated and comprehensive approach to health
development which shall endeavor to make essential goods, health and other social
/ services available to all people at affordable cost";

WHEREAS, Section 17 of the Local Government Code of 1991 likewise state


that the local government units shall exercise powers, functions and responsibilities
necessary, appropriate or incidental to efficient and effective provision of the basic
services and facilities;

WHEREAS, the lying-in clinics both in Arevalo and Calumpang had been in
existence for a number of years and had benefited thousands of expectant mothers
around the city;

WHEREAS, these lying-in clinics had been successfully operating even with a
meager assistance coming from the City Government.

NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of lloilo


City, in session duly assembled, that:

Section 1. Title - This ordinance shall be known as "An Ordinance


Institutionalizing the Arevalo and Calumpang Lying-in Clinics as Birthing Facilities in the
City of lloilo";

Section 2. Purpose. - To bring more closer to expectant mothers effective and


quality birthing services and to ensure the safety of both mother and child during
childbirth;

Section 3. Coverage. - The Arevalo and Calumpang Lying-In Clinics shall serve
pregnant women who are bonafide residents of the City of lloilo and who have
undergone pre-natal check-ups in their clinics prior to their expected delivery, or in case
of emergency, who have with themselves their records of laboratory and pre-natal
check-ups in other health institutions;

Section 4. Supervision and Control. - The operation of Arevalo and


Calumpang Lying-In Clinics shall be under the control and supervision of the lloilo City
Health Office;

Section 5. - Period of Operation . - The Arevalo and Calumpang Lying-In Clinic


shall operate twenty four (24) hours a day from Monday - Sunday, including holidays;

Section 6. - Staffing and Management. - The Arevalo and Calumpang Lying-


In Clinics shall be manned by the following personnel on their designated working
hours:

a) Arevalo Lying-In
1) One ( 1) Medical Officer - to supervise the whole operation of the Lying-In
2) Eight (8) Midwives
3) Four (4) Nurses
4) Four (4) Utility workers

b) Calumpang Lying-In
1) One (1) Medical Officer- on call duty
/ 2) Eight (8) Midwives
3) Four (4) Nurses
4) One (1) Nursing Aide
5) One (1) Clerk
6) Four (4) Utility workers

Section 7. Service Fee. - The service fee for Non-Philheatlh members shall be
the service fees as provided for under Section 6 of Regulation Ordinance No. 2015-163
and shall remain to be observed under this ordinance, as follows:

RESIDENTS: must secure a voters certificate upon availing of services

Service Fee-1,600.00
(P1 ,000.00 birthing clinic Trust Fund, maintenance of birthing clinic)
(P 600.00 NBS Kit (P550.00 for the kit, 50.00 processing)
or have the option to avail of P1 ,500.00 Expanded NBS)

Those who don't want to undergo NBS will have to sign a waiver

NON-RESIDENTS:

Service Fee - P 2,200.00


(P 1,600.00 birthing clinic Trust Fund & supplies)
(P 600.00 NBS Kit (P550.00 for the kit, 50.00 processing)

Extra drugs and supplies shall be charged accordingly and payment will go to the
Birthing Clinic Trust Fund Service fees shall be collected by an authorized Birthing
Clinic staff, an official receipt be issued on every transactions made and tum over the
payment to the City Treasurer, and PS0.00 processing fee for NBS shall be retained by
the Health Facility. The Health Facility shall keep the records of transactions made
chargeable to this.

Philhealth members shall be free of charge of any service fee, medicines and
medical supplies at both Arevalo and Calumpang Lying-In Clinics;

Section 8. Observance of Department of Health requirements. - For the


operation of both the Arevalo and Calumpang Lying-In Clinics as birthing facilities, the
requirements set forth under the Department of Health Administrative Order No. 2012 -
0012, must be strictly followed;

Section 9. Education/Training/Advocacy. - The City Health Office shall


include in their Annual Budget plans and programs for trainings, continued education
and advocacy for mother and child health care;

Section 1O. Repealing Clause. - All other ordinances, rules and regulation or
part thereof which are inconsistent with this ordinance are hereby repealed or modified
accordingly;

Section 11. Separability Clause. - If for any reason/s any portion or provision of
~is ordinance is declared unconstitutional or invalid, the other portions or provisions
V .. ereof which are not affected shall continue to be in full force and effect;

Section 12. Effectivity Clause. - This ordinance shall take effect immediately
upon approval.
