Section 2.0 Objectives

This Administrative Order is issued to provide guidelines for the


classification of water bodies in the country determination of time
trends and the evaluation of stages of deterioration/enhancement in
water quality; pollution; and designation of water quality
management areas (WQMA). In addition, this Order is issued to set
the General Effluent Standards (GES).

Section 3.0 Scope and Coverage
The WQG applies to all water bodies in the country: freshwaters,
marine waters, and groundwater; and shall be used for classifying
water bodies, determining time trends, evaluating stages of
deterioration or enhancement in water quality, and as basis for taking
positive actions in preventing, control, or abating water pollution.
Moreover, this WQG shall be used in the process of designating
WQMA.
The GES applies to all point sources of pollution regardless of volume,
that discharge to receiving body of water or land. The GES shall be
used regardless of industry category.

Approved Methods of Analysis
for Water and Wastewater

The list of analytical methods shall be used as reference to laboratories in
the conduct of testing for water (freshwaters, groundwater, marine waters)
and wastewater in accordance with:
the latest edition of the Standard Method for the Examination of Water
and Wastewater published by the American Public Health
Association/American Water Works Association/Water Environmental
Federation (APHA/AWWA/WEF),
the latest edition of the United States Environmental Protection Agency
(US EPA) test methods contained in SW-846: Test Methods for Evaluating
Solid Wastes, Physical/Chemical Methods and/or in accordance with
such methods of analysis as the EMB may prescribe.
All other issuances which are inconsistent with this MC are hereby amended
accordingly

Operations Manual for the National
Water Quality Management Fund
(NWQMF) and Area Water Quality
Management Fund (AWQMF)

Pursuant to DENR Administrative Order No. 2012-06 (September 11,
2012), the Implementing Guidelines on the Operationalization of the
National Water Quality Management Fund (NWQMF), and DENR
Administrative Order No. 2013-15 (May 27, 2013), the Guidelines on
the Operationalization of the Area Water Quality Management Fund
(AWQMF), the Operations Manuals for the NWQMF and AWQMF are
hereby adopted and issued officially for the guidance of all concerned.

The NWQMF has been given Fund Code 152 by the Department of
Budget and Management while the AWQMF has been assigned Fund
Code 153.
The Manuals provide guidance and procedures on the assessment,
collection, use, disbursement and recording of the two Funds. The
Manual for the NWQMF guides the EMB Central Offices, Regional
Offices and the Pollution Adjudication Board on the proper recording
and use of the Fund while the Manual for the AWQMF provides similar
directions for the concerned EMB Regional Offices and the Water
Quality Management Area Governing Boards.

Guidelines for Recreational
Waters Monitoring Program

The DENR, through EMB, is mandated by Section 2 of RA 9275 to:
1) Streamline processes and procedures in the prevention, control,
and abatement of pollution of the countrys water resources; and
2) Promote public information and education; and
3) Encourage the participation of an informed and active public in
water quality management and monitoring.

1.0 Scope and Coverage
This MC shall cover all recreational waters pursuant to the
following criteria:
Officially classified Class B or SB waters; or
Water bodies intended for primary contact recreation; or
Water bodies identified by the DOT and LGUs as tourist
recreational areas.

b) To carry out the national policy of maintaining a reasonable
quality of the environment.

establishments that discharge solid, liquid, or gaseous
wastes to the environment or whose activities, products, or
services are actual and/or potential sources of land, water, or
air pollution.

government-owned and controlled corporations, and other
public establishments.

Ambulant vendors and stall owners as defined under: RA 6977 ("An Act to
Promote, Develop and Assist Small and Medium Enterprise Through the
Creation of a Small and Medium Enterprise Development (SMED) Council,
and the Rationalization of Government Assistance Programs and Agencies
Concerned with the Development"), as amended by RA 8289 (An Act to
Strengthen the Promotion and Development of, and Assistance to Small and
Medium Scale Enterprises, amending RA 6977. otherwise known as the
Magna Carta for Small Enterprises),
and materials recovery facilities (MRFs) operated by barangays that do not
handle hazardous wastes are exempt from the coverage of this Order.

The policy has emanated from Section 2, Part V, Rule XXI of DAO 2000-81 where Facility owners wishing to
use emission averaging for compliance purposes must do so through an enforceable Compliance Plan
submitted as a part of the operating permit application. The Bureau must approve the Compliance Plan
and application of emission averaging for it to be effective.

The proposed emission averaging scheme shall be based on a weighted average according to the pollutant
concentration and volumetric flow rate from each source and shall be computed using the formula below:

All new vehicle types except motorcycles/tricycles to be introduced
into the Philippine market by 01 January 2016 shall be equipped
with Euro 4/IV engines and compliant with Euro 4/IV limits/emission
standards. By then, the EMB shall issue Certificate of Conformity
(COC) for such vehicles only. However, the said DAO does not
contain the numerical values for Euro 4/IV emission standards and
test procedures. The said standards are adopted from the European
Regulations.

1. DAO 2013-24, CHEMICAL CONTROL ORDER
FOR LEAD AND LEAD COMPOUNDS
Provide for the restriction and prohibition to use Lead and Lead
compounds in the production/manufacturing of Packaging for food
and drink, Toys, Fuel additives, School Supplies, Water Pipes,
Cosmetics and Paints (as pigment, a drying agent or for some
intentional use) with more than 90ppm threshold limit beyond
three (3) years (2013-2016) for architectural, decorative,
household applications and six (6) years (2013-2019)
for industrial applications.

Provision for transition program and capacity building


1. EMB Memorandum Circular 001 Series of 2014
Philippine Inventory of Chemical and Chemical
Substances (PICCS) signed in January 10,
2014
Seeks to give the public a primer on the PICCS
Emphasizes that the PICCS Certification is not a permit for the
importation of chemical substances and is not being required for
importation or use of chemicals listed in the PICCS.
Industry will no longer apply for the PICCS Certification for the
importation of non-regulated chemical
EMB Central Office and Regional Offices will issue a letter in case of
urgent applications (option).
2. EMB Memorandum Circular 003 Series of 2014
Supplemental Guidelines for the DENR AO 2007-23
(Prescribing Additional Requirements for the Issuance of the
Priority Chemical List (PCL) Compliance Certificate)

To guide the industry and related sectors to comply with the PCL requirements
in order to be issued with the PCL Compliance Certificate.
Requires the industry to comply with three (3) major requirements: chemical
management plan, monitoring plan and contingency plan.
Other documentary requirements are other environmental permits such as
Permit to Operate, Discharge Permit, Environmental Compliance Certificate,
DENR ID, among others.
Also provides for the exemption to PCL registration process for chemical
components with less than 1% in concentration.

Guidelines for the Disclosure of Confidential
Business Information (CBI) and Monitoring of
Small-Quantity Importation (SQI), and Pre-
Manufacture and Pre-Importation Notification
(PMPIN)
Aims to minimize processing delays due to suppliers and importers
resistance (trade secret) and the coordination on CBI processing between
Central and Regional Offices.
Provides for the guidelines and specific procedures in handling Confidential
Business Information (CBI) for the suppliers that do not want to disclose
their chemical information to their clients
Applicable for new chemicals permitting requirements (PMPIN and SQI).
2. Department Administrative Order No. 2015-009
Rules and Procedures in the Implementation of
Globally Harmonized System (GHS) in the
preparation of Safety Data Sheet (SDS) and
Labeling of Toxic Chemical Substances )
The Asia Pacific Economic Cooperation (APEC) encouraged adoption and
implementation of GHS Rules in 2008. The Philippines created the National
Coordinating Council (NCC) led by DTI-BOI to coordinate for the development of
organizational structure and framework.

Ensures the safety of the workers, consumers and the general public (as end-users)
to be implemented in 4-phases of implementation.

Expressed through the preparation of Safety Data Sheet (SDS) and labelling
requirements.

Guidance Document on the GHS
Implementation
provides the guidance for the implementation of GHS policies in the
country through classification of the single substances, compounds and
mixtures, preparation of SDS and labels

Clarifications to the Chemical Control Order (CCO)
for Polychlorinated Biphenyls (PCBs)
Aims to reiterate the phase-out period of 19 March 2014 that should
be implemented by 2018.

The MC for PCBs has clarified the following:


- PCB owners shall register in the online database including result
of testing and screening of equipment (PCB and non-PCB) for
inventory.
- Guidelines on how to conduct the inventory
- No more PCB, PCB-contaminated or non PCB equipment shall
be used.
- Retro-filling is not allowed

Clarifications on the Prohibited Uses of Lead
and Lead Compounds under DAO 2013-24,
CCO for Lead and Lead Compounds
Provides clarifications to the prohibited uses of Lead and Lead compounds
under Section 4 for packaging, water pipes and fuel additives.
Prohibited :
Usage in fuel additives and gasoline for motor vehicles pursuant to RA
8749
Packaging made of Lead or Lead compounds or which has components
of Lead that comes directly in contact with food
Lead water pipes however, Lead used as stabilizer in the manufacture of
PVC pipes are allowed as long as it conforms with the standards under
PNS 65-1993 (unplasticized PVC pipes for potable water supply
specification) from DTI-BPS.

Technical Guidance Document for PCB
Management
Beneficial to the industry sector with regard to their compliance
with the phase-out of PCBs as soon as possible
provides for the detailed procedures on the submission of
requirements including the PCB Management Plan, corresponding
monitoring and validation of PCB owners.
This guidance document will serve the reference document of PCB
owners.

Aims to strengthen the applications and exemptions for the Priority

Draft EMB MC for the Final Draft Code
of Practice for Asbestos
This Code is developed by the DOH, DOLE and DENR to
incorporate the concerns of the three government agencies on
safety/workplace program, health, and environment.

Strengthen the enforcement of the CCO for Asbestos under DAO


2000- 02 of Republic Act 6969 of the Toxic Chemicals and
Hazardous and Nuclear Waste Act and Book IV of the Labor
Standards (PD and PD 856 of the Sanitation Code of the
Philippines and its Implementing Rules and Regulations for
environmental authority and occupational safety and Health
professionals.
2. 3rd Draft DAO for Arsenic and Arsenic
Compounds
One of the PCL to be controlled (DAO 2005-05). The objective is to
reduce the hazards of arsenic to human health and the environment.
Establish requirements and procedure for the proper storage,
handling, and disposal of arsenic as well as arsenic-containing
substances.
Establish prevention and control of the use of arsenic and arsenic
containing substances.
Draft CCO requires both general and specific requirements to be
complied with concerned industry i.e. registration, recording, chemical
management plan, storage and handling, financial resources and
surety bond, use and disposal.
3. Draft DAO for Chromium 6 and Chromium 6
Compounds
Hexavalent chromium = Group 1, carcinogenic to humans (International
Agency for Research on Cancer (IARC)
This draft DAO aims to reduce the hazards of Chromium 6 to human health
and the environment thru raising public awareness about the toxicity of
Chromium6 and Chromium6 compounds, the availability of technically
superior and safer alternatives.
Will provides the framework for proper implementation of appropriate
prevention based programs to reduce and eliminate risks from the use of
Chromium6;
Will provides guidelines and assistance to identify and release potential
chromium exposure industrial facilities to reduce workers chromium
exposure.
4. Draft Revised CCO for Mercury and Mercury
Compounds (DAO 97-38)
Aims to reduce hazards to health and the environment from the production,
manufacture, use, handling, management, transport, interim storage, and
disposal of mercury, mercury compounds and mercury-added products.
Establish requirements, procedures, and limitations for the importation,
manufacture, transport, labeling, re-labeling, spill handling, emergency
procedures, storage, and proper treatment and disposal of mercury and
mercury compounds, mercury-added products as well as mercury-
contaminated containers and mercury-bearing or mercury-contaminated
wastes
Establish the schedule for the gradual phase-out and eventual prohibition
on the importation and manufacture of mercury, mercury compounds and
mercury-added products and comply with the requirements of the
Minamata Convention including its phaseout five years after the effective
date of the Order.
5. Draft Revised CCO for Cyanide and Cyanide
Compound under DAO 97-39
This proposed revision shall added Licensing requirements to
Transport and Distribute and License to Store to effectively control the
illegal distribution and use.

All importers and distributors of Cyanide and Cyanide compounds


must secure a License to Transport and Distribute from the EMB
Regional Offices where the storage facilities are located. The said
Licensing is renewable and valid for 2 years.

Facilities under the Requirements of DAO 207-23 (Prescribing
Additional Requirements for the Issuance of PCL Compliance
Certificate
Not a mandatory requirement for laboratory facilities using PCL chemicals
(listed in the Revised PCL under DAO 2005-27) as reagent for
analysis/testing,

For laboratory facilities using CCO chemicals are covered in Chemical


Control Orders (CCOs)

Also, certified laboratory facilities or applying for an International


Organization for Standardization (ISO) Certification and a DENR Recognition
as Environmental Laboratories are required to secure the PCL Compliance
Certificate.
8. Draft EMC on GHS High Volume Chemicals
(HVCs)
All HVCs imported, locally manufactured , used, distributed and stored in
the amount of 500 MT per annum and above shall be subject to comply
with the GHS requirements (labeling and Safety Data Sheet)

This Memorandum Circular covers the following chemical substances to


comply with the GHS requirements this 2017. They are specifically used
for production or preparations of industrial products and other purposes
except for pharmaceutical, agricultural and consumer products :

9. Draft DAO on Revised Priority Chemical
List (3rd Revision)
There are proposed fifty five (55) substances to be added
to the Revised PCL. An increased in number was
achieved due to the 2nd criteria of actual volume and
importation of substances.

The basis of selection are OECD Guidelines, EU REACH,


US EPA, Japan, Australia.

DAO 2013-22 Objectives
Streamline the existing rules and regulations on hazardous waste
management

Update technical standards and requirements for hazardous waste


generators, transporters, and facilities involved in the treatment,
storage, recycling, reprocess, and disposal of hazardous wastes in
the country
DAO 2013-22 Features
Classification of HW Generators is based on the type and volume of hazardous
wastes generated (small, medium and large)
Categories of TSD Facilities
Inclusion of Material Recovery Facilities as Category F TSD Facility
(Category F TSD Facilities are those that store hazardous wastes, which were not
generated from the facility awaiting transport for treatment, disposal or export.)
Introduced the Online HW Transport Record (Manifest System)

No wastes shall be transported or treated without going through the Online HW


Manifest System
Manifests shall be initiated by the waste generator

Expanded the compliance requirements for HW Transporters


(e.g. accredited PCO)

standards on the categorization of TSD facilities

TSD facility which will store, recycle, recover, treat,

management of WEEE and institutionalize the Extended Producer
Responsibility (EPR)

Purpose: to address potential POPs contaminated sites in the Philippines

Provides:
-current available site assessment protocols
-process that identifies and allows the assessment of risks posed by
potentially contaminated site
-process that insures successful management of contaminated sites
Site Remediation Guidelines
Purpose: to address POPs contaminated sites in the Philippines

Provides:
current available remediation technologies

advice on the environmental management of POPs contaminated


sites and remediation activities
Site Control Guidelines
to address the management and control of contaminated sites to
reduce or eliminate receptor exposure

to identify site control options as part of contaminated site


management
