AGREEMENT

I, K.Prabhakar Reddy, S/o. Sai Reddy, R/o. 1-36/6/B, Jawahar Colony, Chandanagar,
Hyderabad – 50 contractors do hereby tender to execute work between the Hospital
Development Society/Medical Superintendent of Area Hospital, Kondapur,
R.R.District under mentioned description of work and in accordance with the
conditions noted below and rules set forth on Annexure – IV below on consideration
of payment being made for the quantity of work executed “Tender for Cleanliness,
Maintenance and upkeep of building and compound in the District Hospitals/Area
Hospitals/Community Health centers from 01.04.2010 to 30.09.2010 as per the tender
conditions”.

TERMS AND CONDITIONS TO THE CONTRACTOR
SECTION -I
1) The contract will be offered to the bidder who quoted the lowest price. The Self
help group / Voluntary organizations!/ NGOs who work on no profit base will
be given preference. Preference will also "be given to (he groups of un-
employed youths who form as a society with an understanding to share the
remuneration on equal terms.

2) The successful bidder has to enter in to the contract with the hospital
authorities by executing a bond of Rs.________________ within 7 days of
receiving information of bid acceptance.

3) The contractor shall deposit an amount, equal to 5% of the annual value of the
contract with the hospital authorities as Security Deposit. The security deposit
will be forfeited to the hospital should the contractor breach the terms and
conditions of the contract without valid reasons.

4) The contract is subject to condition of prescribed eligibility being fulfilled.


Any/defect found at a later date will automatically result in termination of
contract and the performance security deposit will be forfeited.

5) The tenure of the contract shall be initially for a period of 1 year and may be
extended for another one year on satisfactory performance with or without the
terms and conditions being modified;, as the situation demands.

6) The contract can be terminated by the hospital authorities by giving a notice of


one month without assigning any reason.

7) The contractor is not permitted to sublease the work of maintenance of


satisfaction to any other person under any circumstances such an action will be
automatically result in termination of the contract.

8) The contractor shall maintain Suggestions/Complaints book to be kept


available to the employees and public visiting the hospital.
Hospital Authorities reserve I the right to change the frequency and timetable
depending upon the need and also reserves right to add or delete any item from the list
of activities..

OUALITY OF WORK:

1. The cleaned area shall be totally dust free from smell,


2. Shall not spoil the natural shine on look of the furniture and other materials.
3. Shall not cause any disturbance to the activities of the hospital staff.
4. The Garbage shall be collected and disposed as directed by the hospital
authorities.
5. Shall cheque the Flush outs. Urinary Pits, Washbasins, Drainage Pipes, Taps
and report any problem to the Hospital authorities.
9) Any lapse found in maintenance of sanitation is to be rectified within the time
given by the Hospital Authorities. A deduction of Rs. 1,000 or above, as
decided by the hospital authorities will be imposed on the contractor for every
failure. This will be recovered from the monthly payment. Three consequent
failures in rectification will lead to automatic termination of contract.
10)The contractor has to provide the list of workers engaged by him for the
maintenance to the hospital authorities with their complete addresses and a
declaration regarding clean antecedents. The workers have to work under the
overall supervision of an officer nominated by the Hospital Authorities.
11) The contract shall provide Uniform and Photo Identity Cards to all the workers
who are employed by him in the hospital.
12)The contractor himself is responsible for the losses of his material or injuries
suffered by his workers during the course of contract and the hospital
authorities shall not be liable for any such occurrence. |
13)Contractor shall have to compensate for the loss in full sustained by the
hospital on account, of damage or theft of material by his workers.
14)The contract includes the expenditure towards manpower and material. The
cleaning material shall be as per the quality prescribed by the hospital
authorities,
15)The contractor is responsible for payment of wages / remuneration. Income tax
and other statutory deductions of his workers. The hospital authorities are in no
way responsible for the remuneration paid to the workers.
16)The hospital authorities will pay the services costs eveiy month within 5
working days of submission of claim by the contractor, duly making the
deductions like Income Tax other statutory deductions ^nd towards penalty if
any.
17) The decision of the hospital authorities is final and binding in any issue
regarding the maintenance of the sanitation, like entering in the contract and
termination the contract.
18)The Hospital Authorities reserve1 every right to accept or reject any tender on
reasonable grounds.
