Sir,

It is respectfully submitted as under:

1. That the above noted case is pending in this Honble court

and same is fixed up for Prosecution evidence.

2. That prima facie no case whatsoever is made out against

the applicant/accused.

3. That the bare perusal of FIR reveals that the Police Party

was on patroling and the present accused applicant was

allegedly apprehended on suspicion & after search of

applicant, the tablets was allegedly shown to be recovered


from the pocket but the real facts are that nothing was

recovered from the accused applicant.

4. That it is pertinent to mention here that no case is made

out against the applicant/accused. Moreover, perusal of

the FIR reveals that the Investigating Agency has not

complied with the mandatory provisions i.e. Section 50 of

NDPS Act at the time of alleged recovery.

5. That moreover, the Investigating Agency has not joined

any independent witness at the time of alleged recovery

from the place occurrence/ locality.

6. That the challan in the aforesaid case has been presented

and it will take long time and the detention of the

applicant for such a long time is uncalled for.

7. That the applicant undertakes to abide by the condition

which this Honble court imposed upon him and also

under takes not to leave the country without prior

permission of this Honble court.

8. That the applicant will not tamper with the prosecution

evidence.

9. That the applicant undertakes to appear on each and

every date of hearing and is ready to furnish surety/bail

bonds to the satisfaction of this Honble Court.

It is therefore prayed that the application may kindly

be accepted and the applicant may kindly ordered to be

released on bail till the final decision of the case.
