CHATTEL MORTGAGE

KNOW ALL MEN BY THESE PRESENTS:

This Contract of Loan made and executed in the City of Baguio,


Philippines by and between:

MELCHORA MALINES PEKAS, of legal age, married, Filipino Citizen and


with residence at 7B Outlook Drive, Pucsusan, Baguio City, Philippines,
hereinafter called as CREDITOR-MORTGAGEE;

- and-
JENNIFER SAGUBO, Filipino citizen, of legal age, single and with
residence at 35 Mines View Park, Baguio City hereinafter referred to as the
DEBTOR-MORTGAGOR;

WITNESSETH

1. That the debtor-mortgagor has obtained by way of loan from the creditor-
mortgagee, the amount of THREE HUNDRED THOUSAND PESOS (P
300,000.00) PESOS, Philippine Currency with FOUR PERCENT (4%) interest
per month;

2. That the term of this loan shall be for a period of ONE (1) YEAR from the
execution of this contract;

3. That the condition of this chattel mortgage is such that the debtor-mortgagor
as a security convey, by way of mortgage, unto creditor-mortgagee, his heirs
and assigns a vehicle including its Certificate of Public Convenience under
case no. 2015-CAR-0012, and its parking rights for Baguio Plaza - Mines
View and vice versa. Said motor vehicle is particularly described as follows:

4. That upon payment of the loan within the stipulated period, this contract shall
be discharged and of no effect. Otherwise, it shall remain in force and effect
and shall be enforceable in the manner provided by law;

5. That failure on the part of debtor-mortgagor to pay the said obligation, the
creditor- mortgagee shall to take extra judicial action against the collateral
aforestated. This is without prejudice to the right of the creditor-mortgagee to
demand payment of the sum demandable from the debtor;

6. That this Contract of Chattel Mortgage supersedes all contracts and


agreements previously entered by the parties involving the abovementioned
chattel;

7. That the aforestated chattel including the Certificate of Registration and


Official Receipt shall be under the possession of the Debtor-Mortgagor.
