ependently of and was in no

A Compan y shall not be liable to make any payments in
Y respect of such a claim.
Nothing in this Policy or any Clause herein shall affect the
rightofanyperson bythis Policy oranyother
person to reco ver an amount under or by virtue of the
provisions oftheMotorTr Act No. 14 of1951 Sections
102 and 105.
But the Insured shall repay to the Compan y all sums paid
by the Compan y which the Compan y would not have been
liable to pa y but for the said pro visions
APPLICA
In the event of any accident involving indemnity to more than
one person, any limitation by the terms of this Policy and/or
of any Clause hereon of the amount of any indemnity shall
apply to the aggregate amount of indemnity to all persons
and such indemnityshall apply inprioritytothe
insured.
The Compan y shall not be liable under this Policy in respect
of:
(1) any accident loss , damage and/or liability caused,
sustained or incurred outside the land limits of Sr i
Lanka.
(2) any claim ar ising out of an y contractual liability.
(3) any accident, loss , damage and/or liability caused
sustained or incurred whilst any Motor Vehicle in
respect of or in connection with which Insur ance
granted under this P olicy is:
(a) being used for any purpose not permitted by the
current Cer ofMotorInsur ance .
(b) being driven by or is for the purpose of being driven
by him in the charge of any person not authorized
bythecurrent cer ofMotorInsur ance .
(4) any accident, loss , damage and/or liability directly
or indirectly, proximately or remotely occasioned by
contribute to by or traceab le to or arising out of or in
connection with invasion, the act of foreign enemies ,
hostilities of warlike operation (whether before or after
declar ation of war), civil war, strike, riot, civil commotion,
mutiny, rebellion, military or usur ped power or by
any direct or indirect consequence of any of the said
occurrences and in the event of any claim hereunder
the insured shall prove that the accident, loss , damage

way connected with or occasioned b y or contr ibuted to
by or traceab le to any of the said occurrences or any
consequence thereof and in default of such proof the
(5) any accident or loss or damage arising directly or
indirectly whilst the Insured driving such motor vehicle
having consumed any intoxicating liquor or any drugs
or any person having consumed any intoxicating liquor
or an y dr ugs dr iving such motor v ehicle .
(6) any damage and consequential loss directly or
indirectly caused by electronic breakdo wns, failure or
breakages , including that of any microchip, embedded
chips , integrated circuit or similar device failing to
correctly recogniz e an y date as its tr ue calendar date .
CONDITIONS
I. In the event of an accident, loss or damage immediate
notice shall be given by calling the call centre number
indicated inthecer ofinsurance .
Subsequent notice in writing to be followed within two
working days upon the occurence of the accident or loss
or damage . Ev ery letter claim writ, summons and/or
process shall be forwarded to the compan y immediately
on receipt by the insured. Notice shall also be given
in writing to the Compan y immediately the Insured
shall have knowledge of any impending prosecution in
respect of any occurence which may give rise to a claim
under this policy .
In case of theft or other criminal act which may be the
subject of a claim under this Policy the insured shall
give immediate notice to the Police and co-oper ate with
the Compan y in secur ing the con viction ofthe of fender.
II. In the event of such Motor Vehicle sustaining damage
for which the Compan y may be liable under this Policy
no work shall be commenced nor shall any par t of
such Motor vehicle be dismantled nor shall the Insured
accept any estimate of the cost of any repair to such
Motor Vehicle without the prior approval in writing of the
Compan y
III.
(a) No admission offer, promise , payment or indemnity
shall be made or given by or on behalf of the
Insured without the written consent of the Compan y
which shall be entitled if it is so desire to take over
and conduct in the name of the Insured the defense
or settlement of any claim or to prosecute in the
