WHEREAS, it has come to the attention of the Miramonte Homeowners Association that at
the outset of the revival of the stiff implementation of the monthly dues collection of the
members of the MHA on May 2016, there were several homeowners who continued to
vehemently disregard payment of their monthly dues which have been accumulating in every
month while others have been irregularly paying the same;
WHEREAS, despite repeated demands of the appointed collector of the MHA Board, these
delinquent homeowners continued to disregard their monthly dues payment for reasons only
known to them;
WHEREAS, it is a common knowledge that their monthly dues is needed to build up funds
for the Association and sustain the payment of administrative services; security services;
costs of street lights, water, maintenance of the clubhouse, basketball court, street sweeper
fees and many other administrative and maintenance services for the benefit of the entire
Miramonte Subdivision;
WHEREAS, while many homeowners and residents have paid their dues religiously, other
homeowners have unpaid dues in spite of their continued enjoyment of services and benefits
which is unfair to the homeowners and residents who pay their dues on time;
WHEREAS, statements and bill reminders were sent, collection visit were undertaken to
keep them always reminded of their financial obligations to the Association, but such
accounts remain unpaid;
1. The MHA will not give entry and exit permits to their tenants, their
furniture and belongings;
2. No requests for the construction permit or any other services from the
MHA Personnel will be attended and approved;
3. MHA Certificition of being a bonafide residents of MHA will not be
issued for purposes of obtaining barangay clearance;
4. Delivery Personnel of any orders, deliveries, outside mails and
correspondence of the delinquent homeowners and residents will not be
allowed entry in the main gate. Concerned homeowners will have to give
a different mailing address outside of Miramonte Subdivision, if they so
desire;
5. The guests of delinquent homeowners and residents will be required to
leave their IDs at the gate and will not be assisted by the guards;
6. Delinquent homeowners and residents will be required by the Gate
guard to leave any valid government-issued ID with picture (SSS, GSlS,
Passport, PRC or Drivers License) before allowing entry to the
subdivison. Likewise, the Gate guard should not to lift the boom for them
and it should be the obligation of the delinquent homeowner to lift and
unlift the boom everytime they make entry and exit to the main gate;
7. Delinquent Homeowners, or their children will not be allowed to enjoy
the use of the Basketball Court and other amenities belonging to the
Association.
8. They cannot participate in any meetings called for by the Board of
Directors and vote during elections.
RESOLVED FURTHER that the names of the homeowners and residents with overdue
accounts as of May, 2016 shall be posted in conspicuous areas within the subdivison
specifically at the Gate and at the Clubhouse on January 05, 2017;
RESOLVED FINALLY that the copies of this resolution be circulated to everybody and
above sanctions be implemented against those homeowners and residents with overdue
accounts as of December 31, 2016 and remain unpaid until January 05, 2017.
