Throughoutthisstatementofprobablecause,duetotimeconstraints,DeputyKlassenwillbereferredtoas
I,me,aswellasDeputyKlassen.

OnAugust9,2017,DeputyGraceMcCallumcontactedDeputyBryanKlassenwithinformationthatwhile
shewasattrainingshehadreceivedafriendrequestviaherFacebookundercoverprofilefroman
unknownpartywhowaspurportingtobeDeanSwerman.Deanstatedhewas60yearsold.Deputy
McCallumaskedDeputyKlassenifhewantedtocontinuetheconversationwithhimasDeanbelieved
DeputyMcCallumtobea13yearoldgirl.

DeputyKlassensadvisedDeputyMcCallumtosendhiscellphoneinformationtoDeansothatDeancould
communicatewithDeputyKlassendirectlyandbeoffoftheFacebookapp.AshorttimelaterDeputy
KlassenreceivedamessagefromDeputyMcCallumwhohadtextedDeputyKlassenscellphone
informationtoDeanandshehadreceivedbackamessagefromDeanshowinghiscellphonecontact
informationalongwiththetextofyoucantextmenowifyouwant.

DeputyKlassentextedDeanatapproximately1207hoursonAugust9,2017statinghey.

whereDeputyKlassentellsDeanthatIdon'tlikesendingalotofpicsduetothetroublethatI'vebeenintoin
thepastwhenmymomfoundoutthatIsentpictures.

statedheunderstoodhisrights.
Deanstatedthatontoday'sdatehewasinAustinMNvisitinghisgrandsonwhoisinagrouphomeand
droveback.Hestatedhehasa2012ChevyEquinoxwhichhasaloanofapproximately$16,000.00onit.I
thenshowedhimthecellphonethatwastakenoutofhisvehicleandDeanstatedthatthatwashiscell

Dakotaandhestatedhedidtalkwithheralittlebit.IadvisedhimthatthatiswhyhewasunderarrestthatI
hadreceivedacomplaintfromaparentthatwasconcernedabouttheirdaughterhavinginappropriate
communicationswithanadultmale.
DeanstatedthathewasonlygoingtogiveherafullbodymassageandthathehadstoppedinSauk
CentreandpurchasedthestuffedanimalforDakotaandalsohadpurchasedsomebodyoilswhichwerein
thevehicle.IaskedDeanaboutthemethamphetaminepipethatwasinthevehicleandhestatedthatwas
hisandhedidsmokesomemethamphetamineearlierintheevening.Healsostatedtheremaybeasmall
amountofmarijuanaintheWalmartbaginthevehicle.DeanstatedDakotawastheonlyonethatwas
talkingaboutsex,thathewasnotgoingtohavesexwithher,however,didadmittohavingcommunication
withheraboutDakotastraddlinghisfacenakedandteasinghismouthwithhervagina.Deanalso
admittedtobeingexcitedaboutthecommunicationthathehadhadwithDakota.IaskedDeanhowhehad
metDakota.Deanstatedhesentherafriendrequestastheyhadoneotherfriendincommon.Onthe
profile,hestatessheis21.DeanstatedhestartedtalkingwiththepartyandDakotatoldhimthatshewas
11yearsoldandthenchangeditto13.Deanstatedheaskedherageandshestatedshewas11andthen
statedOkveryyoung.Iwon'tbotheryouagain,accordingtotheFacebookmessagingprofile.Deanthen
statedshestatedshewas13yearsold.
Deanstatedhecontinuedtalkingwithhereventhoughheknewshewas13yearsoldandhegaveDakota
thecellphonenumberatwhichpointtheybegancommunicatingviacellphone.Deanconfirmedalotofthe
communicationthathappenedbetweenDakotaandhimself.Headmittedtotextinganddrivingwhilehe
wasdrivingbackfromAustin.WhiletakingthestatementfromDean,IaskedDeanifhiscellphonehada
passwordonit.Deanstateditdidbutdidn'twanttoprovideitwithoutfirsttalkingtoanattorney.Iadvised
DeanthatthatwashischoiceandthatjustsohewasawareIwasgoingtobeexecutingaSearchWarrant
onittogetthecommunicationbetweenhimselfandDakotaoffofitandthatifhedidn'tprovideit,therewas
alikelihoodthatthecellphonewouldbedestroyedintryingtoobtainthatinformation.Deanthenaskedif
hecouldhaveanattorneypresentsohecouldmakethedecisionwhetherornottogivemethecellphone
password.Iadvisedhimthatthatwashischoicebutlikelythatwouldnothappentonight.Istoppedtalking
aboutthecellphone.
DeputyKlassenandDeancontinuedtalkingaboutothermattersaboutthecaseandafterawhileDean
stoodupandgrabbedhiscellphoneatwhichpointIstoodupandtookitfromDean'shandsasIwas
afraidhewasgoingtodestroythephone.Iaskedhimiftherewassomethinghewaslookingforandhe
statedjustputpasswordinashewasn'tgoingtogetanattorneyanyway.IadvisedDeanthathedidnot
havetoprovidemewiththatinformationifhedidn'twanttoatwhichpointhestatedthathewantedto
providethepassword.Deanthenstatedthepasswordwas2706.Atthatpoint,infrontofDean,Ientered
thepasswordandremovedthepasswordprotectionfromhiscellphoneandplacedthephoneinairplane
modetopreventaremotedeleteandthenturnedthecellphoneoff.IadvisedDeanthathisvehiclewas
subjecttoforfeitureandthathiscellphoneandvehicleweregoingtobesearchedwithSearchWarrants.I
advisedhimthathewasunderarrestforOnlineSolicitationofaMinorandpossessionofthe
methamphetaminepipeandpotentiallyachargeforpossessionofmarijuana.Ithenendedthestatement.
DeputyKlassentestedtheglasspipewithafieldtestingkitformethamphetamine.Theglasspipetested
positive.Atapproximately1505hrsDeputyKlassenexecutedaSearchWarrantonDeanscellphone.The
