STATEMENT OF PROBABLE CAUSE

The Complainant states that the following facts establish probable cause:

Your complainant is a licensed peace officer in the State of Minnesota, and is employed by the Woodbury Police Department. In that capacity and upon review of the reports and attachments, your complainant states the following to establish probable cause:

On August 2, 2017 at 7:30 pm, officers received a report of a domestic disturbance in the area of Wimbledon Ridge in Woodbury, Washington County. When officers arrived they located J.D. who was crying and visibly shaken. J.D. reported that she and HARLEY JAMES ANDERSON, DOB: 1-12-1996, defendant, had been dating for 2 years. That J.D. lived with her grandparents at 2876 Castleford Court in Woodbury, and that her grandmother prohibited the defendant from coming to their residence. On this particular evening, J.D. was supposed to meet the defendant at a park, but had fallen asleep. When she awoke and went outside, the defendant was there hiding behind a truck. She approached the defendant and he started to yell at her calling her a "whore" and "bitch" and accusing her of sleeping with other guys. The argument was so loud that several neighbors reported they could hear the yelling and fighting. At one point, the defendant reached out and slapped J.D.

J.D.'s brother and his friend, A.G. were nearby and heard the altercation. A.G. approached the defendant and J.D. in an attempt to stop the arguing. The defendant then swung at A.G. and hit him. A physical fight ensued. An eyewitness saw A.G. attempt to break up the argument and confirmed that the defendant threw the first punch. The defendant and A.G. continued to fight on the ground, when A.G. realized he had been stabbed as blood was coming out his side. Officers observed a fresh cut on A.G.'s side and a cut on his boxer shorts that was covered in fresh blood.

The defendant fled the scene. He was apprehended on his scooter near Valley Creek and Radio Drive. The defendant was stopped and searched. In his pocket was a pocket knife. The defendant admitted that J.D. was his girlfriend and that he had been at her residence. He denied arguing with her and stated that they were just talking (despite several witnesses confirming that they were yelling and fighting and he was calling her names and accusing her of cheating.). He also claimed A.G. sucker punched him, despite an eyewitness who saw the defendant throw the first punch.
