Marriage Petition No Year 2009

Sonu Sharma, S/O of Mr. Rampal Sharma, Lives at Rathi Nagar ,Near Peeli Kothi,

Application under section 13 of Hindu Marriage Act 1955 for Dissolution of

Marriage.

Respected Sir,

I, Applicant submitted that-

1. That the Marriage of the Applicant got with the respondent on dated 3.7.2003

according to Hindu rights and rituals at village Gopalpur.

2. That at the time of marriage both parties belong to Hindu Cast and still they are

follow Hindu rituals.

3. That after the solemnized of marriage, the respondent came to applicant house at

Rathi Nagar Aligarh and the applicant started living together in marital home in a

solemnized way.

4. That after the marriage the respondent lived at applicants house and they also

had physical relation and applicant fulfilled all the responsibility of the marriage

life.

5. That the marriage of applicant has done according to the Hindu Rituals without

taking any Dowry. That applicants fathers has given all the gifts

like ,golds ,clothes and other valuable things which amounts to Rs 100000/- and

possession of all the things are with the Dolly Sharma.

6. That after the marriage, Respondent Dolly Sharma has come to applicants house

as his wife and the applicantss family also take care in his own way and

according to their status, they also give love and affection to the Respondent. Due

to their love and affection Dolly Sharma gave a birth to a child Harsh Sharma

who is 2 year old and still alive.

7. That the brother of respondent Shatish Sharma is tramp type of offender who has

murdered his own wife and few cases are also pending against him in the court of

law.After few days of marriage ,respondent and their parental house started

forcing applicant to sell the part of his land and start living in the respondents
 house which is situate at Gopalpur and also forced to give his all the salary to

Dolly Sharma ,which was ignored by the applicant which leads to cause agitation

in the family and Respondent also start beating the applicants mother.

8. That the applicant and his family also tried to explain the respondent but there

was no change in the behavior of Dolly Sharma ,then applicant had made

complain to the respondents family about the behavior of Dolly Sharma, that

Applicant suffer from all the trauma and rude behavior of respondent because

applicant was thinking that, his child is small and she has to take care of the child

due to which she is feeling irritated. When the child will grow then she will

understand and change her behavior but their no change has been seen in the

behavior and still respondent creates agitation in the family and she said that she

will lodge a false case against the applicant.

9. That on 09.08.09 at 4:00 PM respondents father Sanjay sharma, Mother kela

Devi, Brother Satish Chandra sharma, shanjay sharma nephew Jitu and pawan
and two to three people had come to applicants house and started abusing
applicants mother and spoke in front of everyone that lets go Dolly I will see
who will stop me to take you from this house ,then Applicants mother told, that
Sonu and his father is not at home, so dolly will not go with you due to which the
people belonging to respondents side started abusing the applicants mother
and also beat her brutally with hand and legs and also gave threat to kill her.That
After hearing the voice of the applicants mother the few people of the colony
Sunil Jaisawal,Shahukar,Shubhash,Yogendra etc came at the place and saw all
 the things which was happening with the applicants mother and also saved her
from those people.Respondent Dolly Sharma took all the things from Applicants
mother which included all the jewellery and Rs 10,000 and also took her 2 year
old son. In the evening, when the applicant and applicants father came to home
the mother of the applicant and all the people of the colony told about the
incident to the applicant.Applicant and Applicants father opened the door of the
house and saw that all the things were scattered in the house,he found that
applicant motherss jewellery and clothes were not at the place. After the incident
the applicant took his mother and father to the Chuki Dori Nagar to file a
complain but they refused to lodge the complain and told them to go Gandhi park
Police station, and Gandhi park police station told them that they will do
investigation.

10. That applicant file a complain to the senior superintendent of Police at Aligarh on
10.08.09.

11. That on 12.08.09 applicant made a phone call to the respondent and told her to
give back all the jewellery and clothes of his mother and also 2 year old son and
if she will refuse to do so ,then he will break all the relation with her,then she
started abusing the applicant and refused to give back all the belongings and also
told that if you put pressure on me to live with you then I will lodge a false
complain of dowry against your family or I will do suicide and I will send your
family to the jail.

12. That from 09.08.09 they dont made physical relation with each other.

13. That applicant also got irritated with the habit of the respondent and survival of
applicant with the respondent has become tough.

14. That on 09.08.09, the respondent went her parental home along with her
father,mother,brothers and nephews and since then she is staying away from the
 applicant and since 09.08.09 till now the respondent has not followed the
responsibilities of a married life and in this span of time they have not established
any physical relationship.

15. That after several phone calls to call her back home made by the applicant, she
did not come back and refused to stay with the applicant. The applicant made last
call on 12.08.09 to call her back and requested respondent to come back and
maintain wife hood. But the respondent under the influence of her father, mother,
brother and nephews totally refused to come back applicants home.

16. That the behavior of the respondent towards the applicant and applicants family
is cruel. And since 9.08.09 the respondent kept the applicant deprived of sexual
relationship. And she has not obeyed her responsibilities due to which the
applicant has suffered high mental trauma and psychological disorders.

17. That after several tries made by the applicant, the respondent is not ready to take
the marriage responsibilities due to which the dispute took place.

18. That the dispute first took place when the respondent got married with the
applicant on 03.07.03 through Hindu rituals in the village- Gopalpur of the
respondent. Further several disputes took place with the applicant and applicants
family in different dates. Further, on 09.08.09 the respondent took all the
jewelleries, clothes and money of the applicants mother went to her parental
home with her mother, father ,brother and nephews after beating the applicants
mother. Finally, the dispute took place when the applicant made call on 12.08.09
and the respondent did not come back applicants home. And the respondent
abused the applicant and refused to come back.

19. That this Honble Court has got the full right to hear the mentioned dispute of the
listener because it comes under the jurisdiction of this Honble Court

20. That the application for hearing the dispute has been decided at Rs. 50,000/- and
had been paid.

21. That after filing the dispute there have no relation between both the parties.

22. That in filing of the dispute no legal restrictions have took place.
23. That in the dispute mentioned within the parties no other dispute or proceeding in
relation to their marriage has been filed in any other Courts.

24. Relief-

Therefore, the applicant pleads the Honble Court, to dissolve the marriage with
the respondent, which took place on 03.07.03 through Hindu rituals.

That in relation to the dispute, the relief to be provided to the applicant excluding
the Advocates fees whatever the Honorable Court deems fit.
