1 A Bill for an Act to amend the law relating to
2 medicinal cannabis, and for related purposes
3 The Parliament of Australia enacts:
4 1 Short title
5 This Act is the Medicinal Cannabis Legislation Amendment
6 (Securing Patient Access) Act 2017.

7 2 Commencement
8 (1) Each provision of this Act specified in column 1 of the table
9 commences, or is taken to have commenced, in accordance with
10 column 2 of the table. Any other statement in column 2 has effect
11 according to its terms.

4 1 After section 51A
5 Insert:

6 51B Conditions on the importation of medicinal cannabis


7 (1) This section applies in relation to the importation of prohibited
8 goods intended to be used as medicinal cannabis products.
9 (2) For the purposes of satisfying the conditions of a licence,
10 permission, consent or approval to import the goods:
11 (a) the goods are taken to be drugs required for medical
12 purposes; and
13 (b) if a condition permits the supply of the goods to a person for
14 a purpose mentioned in paragraph 19(1)(a) or (b), or
15 subsection 19(5), of the Therapeutic Good Act 1989, that
16 condition is taken to also permit the supply of the goods to a
17 person in the circumstances mentioned in
18 subregulation 12A(2) of the Therapeutic Goods
19 Regulations 1990.
20 Note 1: Paragraphs 19(1)(a) and (b), and subsection 19(5), of the Therapeutic
21 Goods Act 1989 permit supply of imported medicinal cannabis under
22 the Special Access Scheme CategoryB, clinic trials scheme and
23 authorised prescribers scheme.
24 Note 2: Subregulation 12A(2) of the Therapeutic Goods Regulations 1990
25 permits the supply of imported medicinal cannabis, as exempted
26 goods, under the Special Access Scheme CategoryA.

27 2 Application provision
28 The amendment made by this Schedule applies in relation to the
29 following:
30 (a) a prohibited good imported on or after the commencement of
31 this Schedule;
32 (b) a condition of a licence, permission, consent or approval
33 imposed before, on or after the commencement of this
34 Schedule.

2 3 After subparagraph 11K(2)(b)(ii)
3 Insert:
4 (iia) supplied for the purposes of use in the circumstances
5 mentioned in subsection (2A) if the supply for that
6 purpose is, or is likely to be, notified to the Secretary
7 under the Therapeutic Goods Act 1989; or

8 4 After subsection 11K(2)


9 Insert:
10 (2A) For the purposes of subparagraph (2)(b)(iia), the circumstances are
11 the following:
12 (a) the medicinal cannabis is to be given to a person who is
13 seriously ill with a condition from which death is reasonably
14 likely to occur within a matter of months, or from which
15 premature death is reasonably likely to occur in the absence
16 of early treatment;
17 (b) the medical practitioner by whom, or at whose direction, the
18 medicinal cannabis is to be given to the person has complied,
19 or is likely to comply, with the requirements under the
20 Therapeutic Goods Act 1989, and regulations made under
21 that Act, in relation to the supply of the medicinal cannabis to
22 the person.
