2. You are the National Director/President of the Miss Mauritius National Organisation
(MMNO Co. Ltd) which organizes the Mauritius National Beauty Pageant every year.
3. The Contestants have entered into a contract (herein after referred to as the Contract)
with your client, The MMNO Co. Ltd to participate in the 47th Miss Mauritius National
Pageant 2017 (hereinafter referred to as the Pagaent). The contract was signed by both
parties in July 2017.
4. The purpose of the Contract is clearly set out on the first page on the aforementioned
written agreement which reads as follows:
EXCLUSIVE CONTRACT
(a) To use all reasonable endeavours to promote, organise and conduct the Miss
Mauritius National Pageant during the year of pageant.
(b) To provide the contestant with suitable hotel accommodation and meal during the
final period of the national pageant, subject to sponsorship availability.
(c) To provide chaperon and security during the period of the national pageant.
(d) Generally to direct, advise and counsel the contestant as to her conduct and
well being during the period of the national pageant.

6. The MMNO Co. Ltd has acted unreasonably in breach of the Contract by failing in its
undertakings and obligations.
7. The particulars of the unreasonable actions, decisions and behaviors amounting to the
breach of contract are fully set out below.
8. The MMNO Co. Ltd. undertook to promote the Pageant under Paragraph (a) of the
Addendum to Schedule B as set out above. It has failed in this obligation for the
following reasons:
a) The MMNO Co. Ltd. official website (the Website) is http://missmauritius.org/. the
site displays the photos of the 2015 winners.
b) In the Event page of the Website this is what is displayed (as at the 11th of
September 2017):
c) There has been no mention of any of the events which have taken place for this
years Pageant.
d) All the events posted are for the 2015 and 2016 and are completely outdated.
e) In the photo gallery page of the Website, none of the photos for the 2017
Pageant is displayed.
f) No pictures of the 2017 Pageants contestants are posted nor any of their
profiles.
9. The Contestants aver that the MMNO Co. Ltd have unreasonable failed in their
obligations to promote the Pageantry.
Organise
10. The MMNO has a duty to organise the Pageant. The Contestants aver that organise also
mean reasonable preparation and planning. The Contestants aver that there has been
no reasonable planning of organisation for the following reasons:
c) There is no advance notice given for the subject of the meeting or activity.
e) The Miss Elegance contest was organized in a bar after happy hour where a lot
of the members of the public were drunk and rude. Miss Mauritius 2016 was
even insulted during her address.
g) Apart from the Henessy Hotel the Contestants were not provided with a meal and
worst not even a bottle of water.
h) Four of the contestants spent a whole day in a gym for a supposed professional
photo shoot but instead a photographer took pictures on his mobile phone. The
photos were so poor in quality that the Contestants had to spend another whole
day in Caudan for a second photo shoot.
11. During the Caudan waterfront shoot only on a Friday was the photoshoot confirmed for
Saturday morning at 8am, with makeup and hair already done. When the Contestants
arrived, no photographer was there until 11:30 a.m. They had to wait, no food or drink was
provided, when they tried asking to go buy food or when the session would start, Mrs
Primerose Obeegadoo (the President/National Director of the MMNO) was very rude
towards us.
13. Miss Serina Soobaroyen made a request to the Photographer one Mr. Manglaviti who
was rude to her.
14. The Same Manglaviti sat as a member of the Jury for the Miss Elegance and the Miss
Talent Contests. After the Miss Elegance contest she told Miss Soobaroyen that he
penalized her for the Caudan Waterfront incident. She admitted to it and apologized but
said that it was a game for him.
15. The aforementioned facts amount to breaches of the MMNOs obligation to organise the
pageant.
16. Miss Donna Kim Soo arrived for photo shoot at Caudan and left at 15:30 she was not
allowed to buy food and was had to get some food by leaving unnoticed.
Ill-treatment
17. The contestant are generally ill-treated and abusive language is used even in public. The
organisers are patronizing showing no respect for the contestants.
18. In the event any of the Contestants would voice their opinion or express their
disagreement they are humiliated.
Professionals
19. The MMNO Co. Ltd has an obligation to provide professional trainers and coaches under
the Miss Mauritius National Beauty Pageant 2017 Handbook, Rules and Regulations
(the Handbook). The relevant part reads as follows:
B. REHEARSALS
Throughout the pageant period, there will be many rehearsals to ensure that
you are comfortable with the stage patterns you will be performing during the
preliminary show and telecast. These rehearsals are hard work, but
necessary. The people guiding you through your rehearsals are highly
respected professionals who know exactly what it takes to make you
look your best. Your success and stage confidence will depend upon your
willingness to BE COOPERATIVE. Please listen to directions, follow
instructions, and BE ON TIME.

20. No professional was provided for the rehearsals in breach of the MMNO Co. Ltd.
Obligations.
21. The talent and elegance contest were rehearsed same day only a few hours before the
competition.
22. Miss Yukti Gopal had to organise her own show with absolutely no assistance from the
MMNO.
G. SECURITY
Security will be extremely tight during the pageant period. Officers will be with
our group at all times, including backstage, dressing room areas, and at your
hotel. This is done for your comfort and safety so please cooperate with all
security personnel.
24. The MMNO has also beached the obligation to provide security. No security was
provided for during the events. During the Miss Elegance night a drunk member of the
public grabbed Miss Serina Soobaroyen her Friends had to intervene.
25. During the Miss Elegance contest the Contestants had to stand cramped throughout the
evening amongst members of the public most of whom were drunk.
26. The Miss Elegance contest was organized in a Bar during Happy Hour where a lot of
those present were drunk. There was no one to ensure the Security of the Contestants.
27. During the Miss Elegance and Miss Talent Contests the members of the Jury had no
competence and qualification to judge the Contestants.
28. After the Miss Elegance contest the MMNO was confronted with all the complaints by
the Contestants as the result was appalling and rejected by the audience.
29. Mr. Kevin Obeegadoo Vice President of the MMNO then announced to the Contestants
that the Miss Talent contest was declared invalid and void. However as of 11 am today
none of the other contestants have been informed of the MMNOs decision.
Sponsors
30. Despite having a number of sponsors for the Pageant the Constestants did not benefit
from any assistance. They had to get their own transport, meals (exception as
aforementioned), dress, shoes, training , coaching and all other accessories.
31. In spite of the above the Constestants were asked to thank the sponsors on their
respective Facebook pages.
Withdrawal
32. We the Contestants are withdrawing from the Pageantry due to the aforementioned
breach from the MMNO Co. Ltd.
Damage
33. Each of the Contestants has spent time and money to prepare for the Pageant. The
MMNO is liable to pay approximately Rs 1 Million to each of the Contestants as
damages for the aforementioned breaches.
Without prejudice
34. This Notice is without prejudice to all the rights that we enjoy under the laws and reserve
the right to notify you of other breaches of the Contract not mentioned here.
