Cobras Victorious
A five goal haul from Mace Cousins,
including a best on ground performance,
has helped the Under 16.5 Reserves
junior football Cobras take out the holy
grail for season 2017.
Bacchus Marsh played a strong Lake
Wendouree side in the Grand Final at
Mars Stadium on Sunday.
The Cobras burst out of the blocks in
the first quarter kicking five goals to two
with the wind.
The boys kept the pressure on in the
second, allowing Lakers only three
goals, with the wind, to their two before
the long break.
The last half was tight and Bacchus
Marsh kept their head above water and
maintained the lead throughout to take
the Premiership Cup.
The Red, Black and Yellow boys kicked
accurately all day with 14 scoring shots at
goal to Lakers 20.
The final score saw Bacchus Marsh 11.3
(69) defeat Lake Wendouree 8.12 (60).

Fire could be the last straw

A 145-year-old house could

be one step closer to meeting
the wrecking ball following
a blaze that swept through
the property last week.
Webster Brothers Yard
in Graham Street, Bac-
chus Marsh caught fire on
Wednesday evening (Sep-
tember 6).

the dwelling, which was
well alight and with all
rooms impacted by the fire.

Our main concern was the
condition of the structure as
the house has been derelict
for some time, he said.
The brick building was
erected in 1872 and is a rare
surviving example of a Vic-
torian gothic style cottage.
It is protected by Moora-
bool Shire Councils Herit-
age Overlay, meaning any
changes to the property, in-
cluding demolition, require
a planning permit.
In December last year,
community advocate for
the National Trust of Aus-
tralia, Caitlin Mitropoulo
described the state of the old
building as demolition by
neglect.

building, but know they will
not get permission, let it fall
into a dire state so it cannot
be salvaged, and owners
therefore have a better argu-
ment to demolish it in the
future.
The Moorabool News is of

owner of Webster Brothers
Yard was issued a notice by
Moorabool Shire Council to
improve the standards of the
building prior to the fire.
When asked about the
notice, a spokesperson for
Council said due to privacy
obligations, they were un-
able to reveal any notices is-
sued to the owner.
In reference to the fire,
Moorabool Shire Council
CEO Rob Croxford said
council were attempting to
make contact with the own-
er of the property in order to
determine the appropriate
next steps.

Geoff Howard, Member for Buninyong, has
announced that he will not be contesting the
next state election.
With Labor pre-selections opening soon
ahead of the 2018 state election, Mr Howard
announced last week that he will not be put-
ting his name forward.
Having had the honour of serving the
people of Ballarat East (1999) and Buninyong
(2014) in parliament, I believe its time to
begin a new phase of my life, Mr Howard
wrote in a statement.
I also believe the timing is right to provide
the opportunity for a new face to take on the
Buninyong seat. I know there are a number
of promising people within Ballarat Labor
who could become strong representatives
and bring fresh ideas.
Ballarat East was the most marginal Liberal-
held electorate in the state prior to Mr How-
ards election in 1999, but has since been con-
sidered a safe Labor seat.
Few people including me would have be-
lieved that I would be here 18 years later and
get to enjoy the privilege of choosing my own
time to exit public office. Im pleased that I
will leave with Labors position here greatly
improved from when I was first elected.

Tourism grants a big deal

There are new rules for both
major and new tourism events
in Moorabool, in relation to the
council funding they are eligi-
ble for.
There is also an extra $5,000
available specifically for busi-
ness events.
A review conducted by coun-
cil, and tabled at the September
6 council meeting, looked into
how event funding has been
allocated over the past three
years, and how it should be
granted in the future.
A recent review of the funding
provided since 2014/15 shows
that a total of $114,000 has been
provided to eight different
events.
Currently two Major Tour-
ism Events receive long term
financial support from Council
due to their established nature
and their perceived level of
success.
The Draft Moorabool Desti-
nation Management Plan 2013-
18 identified that the Straw-
berries and Cherries Weekend
had the potential to generate
an estimated $584,000 for the
local economy, while the Bal-
lan Autumn Festival could
potentially generate approxi-
mately $188,000, read a report
tabled at the September council
meeting.

ism Events and New Tourism

low other groups to apply dur-

This makes it difficult for
a group to approach Council
with a new initiative within
this timeframe.
Traffic management plans also
are proving an issue, with coun-
cil having contributed $33,617,
unbudgeted, in-kind support
assisting events with plans.
It is recommended that this
practice is not continued with
the cost to be absorbed within
the event operators budget
where funding/allocations
have been made under Coun-
cil Grants. In cases where no
other grant has been provided
by Council, the subject in-kind
support be raised as a separate
line in the expenditure budget.
The report recommended that
the Strawberries and Cherries
festival, and the Ballan Autumn
Festival, both receive consistent
support so that organisers have
certainty of funding.

Shire boasts four winners

Carbine was the great great
grandson of the legendary
Phar Lap, the inaugural in-
ductee into the Australian
Racing Hall of Fame and the
1890 Melbourne Cup winner.
The champion racehorse is
one of four Melbourne Cup
winners with connections to
the Ballan district, including
one residing at the historic
Ballark property.
Carbines story will be
shared alongside that of Don
Juan (1873 winner), Malua
(1884) and Mentor (1888) in
a historical display that will
feature at the 2017 Emirates
Melbourne Cup Tour.
Ballan is one of 31 lucky
locations, throughout Aus-
tralasia, that will host the
15th annual trophy tour this
year after a successful sub-
mission by the Ballan Jockey
Club. The 18-carat gold cup,
valued at $200,000, will ar-
rive in town on Wednesday
October 11.
The Peoples Cup will en-
gage in a number of exciting
activities including a cham-
pagne breakfast, street pa-
rade and cocktail party.
A display at the Ballan
Mechanics Hall will be fol-
lowed by a visit to Ballan
District Health and Care.

the Mechanics Hall through-

said the tour was a real
coup for the town.
These horses ate our grass
here in Ballan and to have
the famous cup come to our
little town is just amazing.
Society secretary Richard
Biden agreed.
To have four Melbourne
Cup winners associated
with the Ballan Shire is
something that all of us can
be very proud of, he said.
Mrs Biden said research
into the four champion hors-
es took around nine-months.
Fortunately, a lot of the
information was here in
the society, so it was really
a matter of knowing where
to look and verifying the
information before we went
ahead with the display.
While there wasnt a lot of
information on Malua, there
were piles on Carbine, and
we came to a bit of contro-
versy surrounding Don Juan
and who actually owned the
horse at the time.
It was important to en-
sure we had all the facts
straight before compiling
the information.
The historical display will
include pictures and mate-
rial on each horse, alongside
the history of Ballan and its
schools during the late 1870s
to 1900s. The display will be
held between 9:30am and
5pm.

available, with information
on horse owners and race
tracks involved in Ballans
rich history.
The Ballan leg of the Emir-
ates Melbourne Cup Tour
will kick off at 7:30am at St
Brigids Primary School for a
champagne breakfast.
A street parade will see a
colourful exhibit of horses,
jockeys and children fol-
lowed by a delicious lunch
cooked by the Ballan Coun-
try Womens Association.
Residents are invited to dress
in 1880s themed costumes.
The day will conclude with
a cocktail party in aid of the
Ballan Hospital at the Me-
chanics Hall between 6pm
and 9pm.

VCAT ruling has domino affect

A tale of two permits, both re-
jected, played out at the Septem-
ber 6 council meeting.
A decision on an application for
a three-lot subdivision of a Lynd-
hurst St block in Gordon had been
deferred from the June council
meeting until the outcome was
known on a similar case, in Cor-
betts Road in Gordon, that had
been taken before the Victorian
Civil and Administrative Tribu-
nal following councils decision
to reject that application.
In early July, VCAT ruled to af-
firm councils decision to reject
the Corbetts Road permit, and
the grounds upon which that
decision to reject was originally
made are identical to those given
in the council officer recommen-
dation to reject the Lyndhurst St
application.
The largest of the proposed
Lyndhurst St block sizes was
839sqm, and while it was above
minimum required lot size for
the area, it was not considered to
be keeping with the larger spa-
cious block sizes in the area.

Rather, the proposal would in-
troduce a distinctly urban charac-
ter at odds with the village char-
acter of Gordon, and in particular
the semi-rural character of this

One puncher escapes jail time Drug help

A one punch attack that left a man

unconscious in front of his wife and
two young children was an act of self-
defence, according to the perpetrator.
22-year-old Craig Jones (pictured),
of Melton, allegedly punched the fa-
ther of two in the head after he was
approached by the man at a Bacchus
Marsh venue on February 1 this year.
The victim was accompanied by his
wife and two children, aged five and
ten.
Appearing in the Ballarat Magistrates
Court on Thursday (September 7), the
accused claimed he felt threatened at
the time of the attack and acted out of
self-defence.
The court heard the victim and his
family were having dinner at the Bac-
chus Marsh venue, when the accused
and a group of ten friends began using
inappropriate language.
The victims wife allegedly approached
the group, asking them to be wary of
the young children nearby.
The court heard a member of the group
responded to the woman by swearing
and stating, I can say whatever I f*****
want in front of your kids.
As the woman attempted to find the
venues manager, the victim proceeded
to approach Jones, who hit the man in
the head, forcing him to land on the
ground and fall unconscious.
The man was taken to Sunshine Hospi-
tal with a sore head and neck.
A police prosecutor in court said he
didnt believe any form of aggravated
self-defence was necessary, however
Joness defence stated that his client
felt threatened by the victim, who was
much bigger than Jones and had ap-
proached the accused first.
He said Jones had no criminal history
and was on the cusp of being a young
offender.
Jones previously appeared in the Bac-
chus Marsh Magistrates Court on July
14, where a sentencing indication was
sought by his lawyer.
Magistrate Gregory Robinson said if
the accused were to plead guilty, he
would be imprisoned for one month.
Magistrate Robert Kumar, who was
presiding over the matter on Thursday,
said it was only two-weeks ago that a
29-year-old, charged with similar of-
fences and with no priors, received a
term of six-months imprisonment.
These are young people who get
drunk and do bad things and in this
instance it happened in front of very
young children, he said.
Jones defence stated that it wasnt his
intention to shy away from the serious-
ness of the offending.
However, the victim was not severely
injured, he was not king hit from be-
hind. He approached my clientwho
felt threatened and reacted in what he
felt to be a reasonable way at the time.
[Jones] should not be punished for
what could have happened, but what
did happen.
The court heard Jones had great em-
ployment prospects, with a hiring
company offering him a three-month
placement in Queensland in the com-
ing weeks.
He is on the up and up. He has good
work ethic and comes from a good fam-
ily, the defence said.
Magistrate Kumar said the only thing
keeping Jones from imprisonment was
his age and lack of prior history.
If the injuries to the victim were more
serious, you would be in another juris-
diction with potentially many years of
imprisonment.
Jones was convicted and fined $750.
He was sentenced to a 12-month
community corrections order, with
conditions including 250-hours of un-
paid community work, and treatment
and rehabilitation, including anger
management.

Local residents will now have better access to free drug and
alcohol counselling in Ballan.
The Ballarat Goldfields Brief Intervention Program is a
new service available at Ballan District Health and Care,
which is available to anyone facing emerging or pre-existing
substance use problems.
The free service is being delivered by UnitingCare Ballarat -
an alcohol and other drug treatment agency.
Under the new program, residents will be offered up to five
brief intervention counselling sessions; psychological and
information-based support and referrals to other services.
The program is also available to those affected by someone
elses substance use.
Ballan District Health and Care CEO, Wayne Weaire said
BDHC was very pleased to be able to offer the specialised
service to the community.
It can be difficult to find help when you are facing problems
with alcohol and other drug use, or when someone elses
substance use is having a negative impact on your life, he
said.
This new service is an excellent opportunity to start
exploring change and it is available here in Ballan.
Moorabool Drug Action Group member, Senior Constable
Jim Ross welcomed the new program.
Any counselling services or programs that engage in a
positive result from substance abuse is a benefit to not only
the addict and their families, but the broader community as
well, he said.
Families are reminded that the Family Drug Support
Group operates in Bacchus Marsh and residents from Ballan
are more than welcome to attend.
Those interested in the Ballarat Goldfields Brief Intervention
Program are encouraged to ask their GP and other healthcare
workers about a referral.

Dear Editor,
Roads are the lifeblood of country
communities - thats why were in-
vesting more than ever before to our
country roads safer and stronger.
Since coming to office, the Andrews
Labor Government has doubled
spending on road maintenance.
Over the next 12 months VicRoads
will be doing more pavement work
than it has done in decades, part of
our $530 million investment to im-
prove regional roads.
In this financial year alone, Vi-
cRoads will fix more than 1,400 km
of roads across the state.
And were not just filling pot holes;
were rebuilding entire sections of
some of our most critical links.
Were investing $58 million in re-
surfacing, asphalting, sealing and
shoulder repair at more than 100
locations in Western Victoria.
As part of the package sections on
Bacchus Marsh-Gisborne Road at
Comadai will also be rebuilt.
By dumping the dud East West
Link in the city, weve been able to
redirect $690 million in funding to
regional roads upgrades.
It was the right call and one, as
Minister, I am proud to stand by.
But we will not stop investing in
our critical roads infrastructure.
The VicRoads senior leadership
team has spent the last few weeks
touring country Victoria, talking
to locals about how they can better
plan, build, manage and maintain
the 19,000 kilometres of country ar-
terial roads.
VicRoads have acknowledged that
they can do more to explain how the
roads are built, what might cause
them to fail, and what it takes to
repair them and support a better
future.
This work wont happen overnight,
and there is always more that we
can do but were backing country
Victoria investing in the roads we
need to unlock jobs and investment
and protect families.
Victorians deserve roads they can
rely on, and this investment will
make sure the roads are safer and
more reliable than ever before.

The article by the Tom Kingston,
We make the mess; but you clean
it up (5 September Opinion Piece))
claims that the Minerals Council
of Australia (MCA) is attacking
environmental charities. This is
incorrect.
The MCA supports integrity meas-
ures that will ensure that registered
charities who enjoy significant tax
concessions adhere to the exist-
ing Charities Act requirements. The
Act states that charities should not
promote or engage in conduct that
is unlawful or unsafe and that they
should not promote or oppose po-
litical parties or candidates.
Mr Kingston suggests that improv-
ing the compliance of charities with
existing law amounts to curbing
free speech or political activity.
Again, this is not correct. As the
Gillard Government pointed out,
none of the requirements under the
Charities Act affect the free speech
or political activity of individuals;
and organisations are not required
to comply with these requirements
unless they choose to register as a
charity.

Properties sought
for weed trial

Moorabool Landcare Groups are looking at alternative ways to control
and prevent serrated tussock.
The invasive weed is regarded as one of the worst in Australia because
of its potential to spread and its economic and environmental impacts.
Coimadai Landcare Treasurer, Allison Backhouse said the new
committee, combined with Parwan and Bullengarook Landcare
groups, had been looking at pasture management, rather than
chemical usage to control and prevent the aggressive weed.
As a result, the three community groups were the recent recipient of
an $18,000 Victorian Serrated Tussock Working Party grant.
This will enable us to research serrated tussock and the environment
that it needs to grow, Ms Backhouse said.
There are ten properties across Coimadai, Parwan and Bullengarook
that will be analysed for the project. We will be conducting our
research over summer, which is the peak growth period for the weed.
The main project outcome is to achieve a chemical free reduction,
so over the next four to five months we will conduct three trial plots
that will enable us to depict what inhibits and encourages the weed
to grow.
Ms Backhouse said a chemical free prevention program had a number
of benefits to both landholders and the environment.
There is a lot of time and money that goes into actually applying
chemicals to the land. They are not cheap and they are a huge expense
to farmers, she said.
We also know what chemicals do to us, whether theyre airborne
or through the soil, which eventually seeps through and into our
waterways. Chemicals are a major problem to the environment so the
prevention of them is imperative.
If we can get to a point where we can put strategies in pace that
prevent the growth of the weed in the first place, then everything is
chemical free.
With the research project soon to commence, Ms Backhouse said
Coimadai, Parwan and Bullengarook properties were still being
sought to participate.
Property requirements include three areas of similar size, where
serrated tussock is known to grow and with the ability to graze.

The club has had another busy couple of weeks of
competition. The weekend of 9th & 10th of September saw
four out of the five sections competing. The Sub Juniors
started the weekend out with their Barwon competition
on Saturday morning at Geelong Performing Arts Centre
(GPAC), and were awarded a place in every item: March
Highly Commended, Clubs 3rd, Free Exercises 3rd,
Rods 2nd, Aesthetics Honourable Mention, and Song &
Dance 3rd. The Seniors made the trip to Broadmeadows
for their Northern Districts Calisthenics Competition on
Saturday evening and received a Highly Commended for
their Aesthetics. On the Sunday morning it was the Juniors
turn to head to GPAC for their Barwon competition in their
second competition there was a big improvement in their
performances. They were awarded the following placings
March Highly Commended, Clubs 3rd and Revue
Honourable Mention. The Intermediates were then awarded
an Honourable Mention for their Clubs on Sunday evening
for their Northern District Calisthenics Competition.
The weekend of 16th and 17th September was a little
quieter with just the Intermediates competing. They
travelled to Frankston for their Longbeach competition. A
huge improvement in most items saw the girls awarded the
following placings: March Highly Commended, Clubs
3rd, Free Exercises Honourable Mention, Rods 3rd,
Aesthetics Honourable Mention, Dance Arrangement
Honourable Mention.

Gisborne Bowling Club for the
annual Bakers Delight Cup on
Saturday 16 September.
This event has become a keenly
contested match since its inception
three years ago.
The score line stood at 1-all before the match and both teams
were determined to tilt the ledger in their favour.
Avenue took the initiative from their opponents from the
get-go and led all day to record an excellent win 280-161,
which is worthy of note given Avenues 2 top teams were
both relegated at the end of last season, and Gisborne won
the CHBD Division 1 premiership in 2016/17.
Strong performances by all Avenue rinks in a game played
in a friendly but competitive manner ended up with Avenue
winning 9 of the 11 rinks on the day.
Standout performances were from Judy Autys rink (44-7)
and Stephen Sullivans rink (39-9) which paved the way for
the overall victory. Interestingly the two Avenue rinks that
lost, were each by a margin of less than 10 shots.
Following a strong performance last week against BMS, Friday 15 September, Race 4 Winner: Shez All Rock (6).
