To Whom It May Concern;

As a union member, who is current in all COBA dues, I am questioning your judgment of your
actions. Your political thuggery to attempt to silence your own union members from speaking
to elected officials is contradictory to the mission statement of COBA, and what you as a union
President should represent.

The fact of the matter is, we would not be at this junction if you did not lie to retired Officer
Maxwell about your meetings with County Legislators. To cover up that lie, you have created
more lies. Unfortunately, for all COBA members, your lying actions have brought on a Five
Million Dollar Defamation lawsuit that could potentially put or union in a severe financial crisis.

As a member of COBA, I am requesting all expenditures on how the law firm Cittone & Chinta is
being paid. Since COBA has chosen to issue a "Cease and Desist" to its own union members, the
payment of services to Cittone & Chinta should not come from the union funds that are
collected by the same members you're trying to silence.

I am also requesting from you and the board, all minutes and records on who motioned and
who seconded the motion, the discussion and who voted, "Yes" or "No" to use the law firm
Cittone & Chinta to issue a "Cease and Desist" to its own union members.
It also appears that Cittone & Chinta carbon copied the letter to President Brooke Jones,
President of the Westchester Correction Association, to the COBA law firm of Kohler & Isaacs.
The communication between law firms brings questions of unethical actions and another
conflict of interests because of a failure to create an information barrier between law firms. Is
Kohler & Isaac working for us or against us? They cannot be our lawyers and assist in legal
actions against us.

If this is the case, then all Westchester Correction Association Members, who are dues-paying
members of COBA, who have active departmental charges or pending charges are entitled and
should receive conflict council of their choice. We do not expect the law firm of Kohler & Isaacs
to participate in the process of silencing our right to speak and properly defend us against
departmental charges. It is a clear conflict of interest.

In my 28 years, I have never seen such deceit, misrepresentation of facts, lack of


communication to members and now what appears to be a misappropriation of union funds for
someone's own personal agenda. As usual, I'm not surprised by your actions. This is not the first
time you have participated in retaliatory legal actions against union members. The 2008 lawsuit
that you, former President Robert Delbene, Lane Young, and Frederick Portella filed against the
Welfare Fund wasted thousands of union members funds, in which you ended up settling for
less than what you started with. You haven't learned from the mistakes of your predecessor.
Now a page out of the old playbook, you want to silence the voices of our members and their
right to organize. Mr. West, it's unfortunate that you have become a Separatist Dictator instead
of a Unifying Union President.

Your actions, though it is personal and contradictory of the mission of COBA, will take the this
once credible union down a rabbit hole, in which it will take years to recover. It is imperative for
the future of COBA and its financial stability that you resign from office.
