FACTS:

Noel and Maribel met in Mapua; Noel thereafter courted Maribel. It

was only after years of pursuit that Maribel accepted the
proposal.
Maribel was aloof and snobbish. She constantly rejected Noels
invitations to family gatherings.
Despite their break-up, they maintained sexual contact. Later on,
Maribel allegedly got pregnant.
Upon his mothers advice, Noel begrudgingly married Maribel on Nov
23, 1998. She refused sexual contact with him.
She did not show signs of pregnancy and later claimed to have had a
miscarriage. They had a huge quarrel which prompted Maribel to
leave Noels house.
After less than two years of marriage, Noel filed a petition for
declaration of nullity of marriage. Maribel did not participate in
the proceedings.
RTC: rendered a decision in favor of Noel. Maribel failed to perform
essential marital obligations due to her Narcissistic Personalty
Disorder, according to findings made by Dr. Tayag.
CA: reversed the RTC. Noel failed to establish the disorder and that it
was permanent and incurable.
Moreover, refusal to have sexual contact was not psychological
incapacity; they already engaged in such relations before
their marriage.
According to the CA, what Noel should have filed was a petition
under Art. 45(3).
Noel: CA erred in declaring Maribels refusal to procreate as psych
incapacity. Pre-marital sex was inconsequential. Narcissistic
Personality Disorder was proven and was permanent and
incurable.

ISSUE + RULING:

WoN the marriage is null and void under Art. 36 FC. NO.
The totality of evidence presented by Noel was not sufficient to
sustain a finding that Maribel was psychologically incapacitated.
Noels evidence merely established that Maribel refused to have
sexual intercourse with him after their marriage, and that she
left him after their quarrel when he confronted her about her
alleged miscarriage.
 He failed to prove the root cause of the alleged psychological
incapacity and establish the requirements of gravity, juridical
antecedence, and incurability.
An unsatisfactory marriage is not a null and void marriage.
