2. The benefits under this Offer is/are neither assignable nor transferable under any
circumstances.

3. The redemption to the User shall be provided subject to compliance with all applicable
statutory legislations, guidelines, processes and formalities as may be essentially
required.

4. Any User(s) providing any incorrect information or concealing/withholding any

information from Paytm E-commerce with intent to defraud will automatically be
disqualified.

5. The User(s) shall indemnify and keep indemnified Paytm E-commerce and their officers,
directors, employees, customers, affiliates and agents harmless from and against any
and all claims, losses, suits, proceedings, action, liabilities, damages, expenses and costs
(including attorneys fees and court costs) which Paytm E-commerce may incur, pay or
become responsible for as a result of breach or alleged breach of the representations or
 obligations of the User(s) under the T&C hereunder, any failure by the User(s) to comply
with applicable law and any third party claim in respect of misuse of any information of a
third party. Paytm E-commerce shall have the right to defend themselves, pursuant to
this Clause, at the cost of the User(s). Paytm E-commerce or their respective affiliates
shall not be responsible for any direct, indirect, incidental, special, punitive or
consequential damages, including loss of profits, incurred by the User(s) or any third
party, in connection with the Offer.

6. All incidental costs, taxes or levies related to the benefit under the Offer, shall be
exclusively borne by the User(s), including but not limited to TDS, gift tax (if any),
Insurance and any other taxes applicable by the Central, State or Municipal government.

7. The User(s) hereby irrevocably authorize Paytm E-commerce and its owners, affiliates,
subsidiaries, associates to use the data gathered during and/or after the Offer in respect
of the User(s) in any of its communications including marketing promotions and
advertisements.

8. This Offer is subject to force majeure circumstances including without limitation, floods,
natural disasters, war, act of terror, political unrests, technical snags, act of God, change
of laws or any circumstance beyond the reasonable control of Paytm E-commerce
(Force Majeure Event). Paytm E-commerce shall not be liable for any delay or
adverse effect caused to this Offer there under as a result of a Force Majeure Event.

10. Paytm E-commerce reserves the right to extend, cancel, discontinue, prematurely
withdraw, change, alter or modify this Offer or any part thereof including the eligibility
criteria, the T&C and benefits at their sole discretion at any time during its validity as
may be required including in view of business exigencies and/or changes by a regulatory
authority and/or statutory changes and/or any reasons beyond their control and the
same shall be binding on the User(s).

11. Failure by Paytm E-commerce to enforce any of their rights at any stage does not
constitute a waiver of those rights. Further, Paytm E-commerce shall assign any of its
rights within the Offer to any party without prior intimation to User(s).

12. Paytm E-commerce does not make any commitment, express or implied to respond to
any feedback, suggestion and/or queries of the User(s).

13. The User(s) understand and agree that Paytm E-commerce, its officers, directors,
employees, customers, affiliates and agents shall not be liable for any loss or damage
whatsoever that may be suffered, or for any personal loss or injury that may be suffered
(including loss of life), to the User(s) and/or any third party, directly or indirectly, by use
or non-use of the benefits under this Offer.

14. Apart from the entitlement to this Offer, the User(s) or their legal heirs/ successors/
representative will have no other rights or claims against Paytm E-commerce, its owners
and affiliates. Maximum aggregate liability of Paytm E-commerce/One97 shall not
 exceed value of the benefits under this Offer, in pursuance to the terms and conditions
herein.

15. Any dispute arising out of this Offer and terms & conditions of this Offer shall be
attempted to be resolved amicably through negotiations with the Paytm E-commerce
representative. In the event amicable settlement fails, the dispute shall be referred to
mediation, and the venue of mediation shall be at Delhi.

16. There will be no cash alternative to User(s) beyond the above-stated benefits.

17. Subject to any applicable law, all warranties of any kind whatsoever w.r.t to
this Offer, whether express or implied, are hereby expressly DISCLAIMED
from the side of Paytm E-commerce. The User/s understands and agrees that
Paytm E-commerce shall not be liable for any quality constraints/ usage constraints/
value deterioration issues/ timely delivery issues that may arise with benefits under this
Offer, since it is a third party product/service to which effect, Paytm E-commerce is only
a facilitator and not the actual product/service provider since such responsibility is of

Part- C: Additional Terms & Conditions for Cashify:

1. The benefits of assured buyback offer will be available after Six (06) month(s) from the
date of purchase at www.paytmmall.com/cashify.
2. Using this link, you can enter your Assured Buyback request by entering IMEI of the
phone.
3. The IMEI will be validated and you will have the option to enter Address and Contact
Details for pickup along with a time slot and date.
4. You might receive a call from Cashify customer support to confirm the request made.
5. On confirmation, pickup will be made from your desired address and time arranged by
Cashify.
6. During pick up the following Three (3) details will be checked by Cashifys pickup
executive:
a. IMEI should match and device should switch ON.
b. Screen should not be damaged physically or functionally including lines, spots,
water damage etc.
c. iCloud lock and personal data should be removed from the device.
d. The original phone box and with all the accessories should also be provided.
7. If and only if the above 4 conditions are matched, the executive will collect the phone.
Otherwise the Buyback request will be cancelled by Cashify.
 8. An OTP will be sent to User registered mobile number to confirm that the pickup is
completed by Cashify.
9. Once the phone is received at Cashify warehouse, Cashify will check that the iCloud lock
is removed correctly from the phone and this process may take between 2 to 7 days of
time.
10. If the iCloud lock is already removed by the User, payment will be credited immediately
to the Users paytm wallet.
11. If the iCloud lock is not removed by the User, Cashify customer support will reach out to
User and suggest to remove the iCloud lock.

13. User can check the status of phone by logging on www.paytm.com/cashify
14. If there is no update from Cashify in 10 days, customer support can be reached on
paytm@cashify.in or on cashify@paytm.com
15. The only exception is if the iCloud lock hasnt been removed; in such a case, Cashify or
Paytm Customer Support will reach out to the User and resolve the lock issue. Once the
User remotely removes the lock, the payment can be processed.
16. If for any reason User cant be reached or iCloud cant be removed in 7 days, Cashify
will pay Rs. 2,000/- (Rupees Two Thousand Only) to the User paytm wallet
account. If the User can remove the iCloud lock in the next 7 days (or 15 days from
pickup), the balance payment will be made, otherwise the same will be forfeited.
17. Cashify will always make payment in a maximum of 10 days from pickup date of Users
iPhone, with an exception being of delays caused due to an iCloud lock of the Users
phone.
18. Cashify will pay to its User(s) Rs.9, 000/- (Rupees Nine Thousand Only) only which
is inclusive of all taxes and other surcharges, if any applicable.
19. In case the original phone box and/or accessories are not returned Cashify will deduct
Rs. 2000/- (Rupees Two Thousand Only) and a payment of minimum Rs. 7000/-
(Rupees Seven Thousand Only) will be made to User.
20. Devices returned under this program will be returned exclusively and directly to Cashify,
there is no other way to avail of the assured buyback under this Offer.
21. Cashify will work actively to resolve any User escalations and improve User experience.
22. The device returned should not have its manufacturers warranty void due to
unauthorized service/repair of the phone.
23. The offer is not transferable to another person and can only be availed by the User of
the device as per invoice.
