AGREEMENT OF LEAVE AND LICENCE

THIS MEMORANDAM OF AGREEMENT made this 1st of April, 2017


BETWEEN Mr.Sunil Kumar, S/o Ram Kishore Prasad, Residing at C/OSri
Sadasheo Prasad Sinha, S.R.P. Market, Lalkothi, Danapur Cantt.., Patna -
801503, Bihar, hereinafter called the LICENSOR (which term shall unless
repugnant or contrary to the context hereof be deemed to include its successors in
interest legal representatives and assignees) of the ONE PART :

hereinafter called the LICENSEE (which term shall unless
repugnant or contrary to the context hereof be deemed to include his heirs,
administrators, executors and legal representatives) of the OTHER PART .
AND WHEREAS the Licensee has approached licensor with the proposal to
allow them to use the flat no. 206, 2nd Floor at Prachi Orchid , Near Pushpanjalli
Kunj, Ashiyana Digha Road , Patna 800025, Bihar on leave and license basis.
AND WHEREAS the Licensor has agreed to the aforesaid proposal of the
licensee and has accepted the same.
AND WHEREAS for future reference and to avoid any misunderstanding the
said terms and conditions are recorded hereunder as follows :-
NOW THIS MEMORANDUM OF UNDERSTANDING WITNESSETH AS
FOLLOWS :-
1) The Licensor hereby inducts the Licensee into the said premises for a period
of 11 calendar months commencing on and from the 1st day of April 2017 on
a monthly rent of Rs. 13,000/-to be paid in advance within 1th day of each
month.
2) The Licensor hereby allow the Licensee to use premises as specified in
AnnexureI on leave and license basis.
3) The Licensor shall give and handover semi-furnished peaceful and lawful
possession of the said premises to the licensee and the licensee shall be
entitled to retain possession thereof till the expiration of its period of license
upon which it shall duly handover vacant and peaceful possession of the said
premises to the Licensor or his nominees.
4) The Licensee without consent of Licensor is not entitled to sublet/sublease
the said premises to any another person or company.
5) The Licensee shall keep the said premises in good condition and shall deliver
semi-furnished possession thereof to the Licensor on termination of the afore
mentioned period of this License. However, the Licensee may also redeliver
the possession of the said premises to the Licensor earlier than the date fixed
for the termination of the license under these presents.
6) The Licensee shall keep all the fixtures & electric fittings (List enclosed) etc.
in good running condition and shall pay all charges duties taxes that may in
law be payable by it or imposed in respect of the said premises of which the
Licensor is not necessarily bound to pay.
7) In the event the Licensee fails or omits to pay rent as it accrues due or omits
of fails to carry out the obligations mentioned in these present, the Licensor
may terminate the license and resume possession thereof.
8) The Licensee hereby covenants that it shall keep the said premises and the
fittings and fixtures attached thereto in a proper state of repair at its own cost
during the currency of this license.
9) The Licensee or the Licensor has the option to terminate the ongoing license
before the expiration of the period of license and in the event either the
license or the licensor has to give two calendar months notice to the licensor
or to the licensee in writing intimating her or him intention to do so. On
expiry of the notice period the licensee shall deliver the possession of the
said flats to the licensor in vacant and good identical condition and the
licensor shall then refund the amount paid earlier as security deposit.
10) Refund will be made only after settlement of the electric bill till the last date
of occupancy. However if the electric bill is not received at time of vacating
the flat, a proportionate amount shall be kept with the licensor from security
deposit. In this case after adjustment or settlement of final electric bill and
maintenance of furniture and materials given to the licensee , balance
amount, if any, shall be refunded.
11) If the licensee wants to continue and renew the license , then rent amount
will be increased by 10%.
12) Electricity bill will be charged at Rs 10/- per unit.
