EXAMINATION OF PROSECUTION WITNESS

Court: Who is your first witness?

Atty. Dewm: May we call on our first witness Gen Lee.
Court: Swear in the witness

Court: Purpose
Atty. Dewm: Your Honor, the testimony of the next witness is being offered to
prove the following:

1. That the accused did not try to defend himself when he shot the victim.
2. That the accused threatened Gen and immediately run away from the
crime scene after the deceased was shot.
3. That the accused did not voluntarily surrender and was apprehended by
PO1 Velasquez and Cruz
4. She will also identify the accused and testify such other matters relevant
and pertinent to the case.

May I proceed your honor?

Atty. Baconawa to witness

Q: Can you tell us where were you at around 2 oclock in the morning of
August 11, 2011?
A: I was at Barpels Boarding House, room 14
Q: What did you do at Barpels ?
A: Tony allow us to stay for a night because Edmundo and I will be leaving
for Japan the following day and our scheduled flight is at 4 oclock in the
morning.
Q: Who is Tony?
A: He is our friend and the tenant of room 14
Q: Who are you with during that time?
 A: I was with Edmundo
Q: How about Tony?
A: He went home to Naval to attend his sisters wedding.
Q: Do you recall what were you doing at around 3 oclock in the morning?
A: I was preparing and packing our things for our flight to Japan and
someone knocked heavily on the door.
Q: What did you do after, if any?
A: I went to the door and ask him who he was and that Tony was not here.
Q: Did you get any response from him?
A: Yes. He told me that hes here not for Tony but for Edmundo.
Q: What did you do after, if any?
A: Since, I recognized his voice, I opened the door and I saw Sonny. He
was furious and went inside looking for Edmundo.
Q: What happened after, if any?
A: He punched Edmundo and fell to the door of the comfort room and
when Edmundo was able to get up he immediately drew his gun and levelled it
to the accused and told him to get out of the room.
Q: Did the accused get out of the room?
A: No.
Q: What did the accused do instead?
A: He sidestepped and caught the hand of Edmundo causing the gun to
drop to the floor and Sonny hit him again causing him to fell down.
Q: What happened after, if any?
A: Sonny went on his way to the location of the gun and I prevented him
to pick it up by hugging him but he just pushed me away.
Q: What did the accused do after?
A: He picked the gun on the floor and fired it at Edmundo and he pointed
the gun at me and threatened me not to tell the police and he immediately went
out.
Q: If the accused is within the confines of this honorable court will you be
able to single him out?
A: Yes your honor.
Q: Where is he?

Court Interpreter:
the witness pointed a person inside the court room wearing a_________ t-
shirt. And identified himself as Sonny Lukban.
 Q: After, Edmundo was shot by the accused what did you do after, if any?
A: I went outside and ask for a help. After few minutes an ambulance
came and after we brought Edmundo to the Hospital, I went to the Police station
to report the incident.
