CHILLING EFFECT
Definition:
Also called libel chill, a chilling effect is defined as a situation in which people hesitate to exercise basic
legal rights in fear of the possible negative effects and sanctions their decision would cause. This is
commonly used to hush criticism and freedom of expression, silencing the people with the threat of legal
sanction.
A chilling effect situation can be used in a Debate through the following points:
- Showing how less legitimate information can be obtained while the chilling effect is still in place.
- All false statements are considered unprotected, but allowing the distribution of this
information can deter those who are aware of the truth to speak in fear of their information being
invalid. The truth will thus be chilled because of the regulation of false information.
Less legitimate information regarding various political issues would be obtained in fear of the people
being punished with their leakage of information. People would not risk a legal sanction just to be able to
practice their right to speak.
Statements are classified as protected or unprotected based on their value or their harmful effect. Certain
intent requirements are useful, however, it should be made sure that the legitimate information should not
be covered up by false, unnecessary statements.
