PETITION

Petitioner, through counsel, respectfully alleges:

1. That she is of legal age, married to, but separated from


_____ (Respondent hereinafter), and presently resides at _____ for
more than six (6) months prior to the filing of this Petition.

2. Respondent is of legal age, married to but separated from


Petitioner, and with address at _____.

3. Petitioner and Respondent married each other on ____ at


______ as shown by a copy of Certificate of Marriage hereto attached
as Annex A.

4. The marriage is governed by the absolute community of


property regime, and the Petitioner and Respondent acquired no
property either real or personal, of significant value, during their
marital consortium.

5. Petitioner and Respondents union was blessed with one


child namely _____. (Copy of the childs Certificate of Live Birth is
hereto attached as Annex B).

58. As found by Dr. _____, a qualified clinical psychologist,


Respondent manifested symptoms of a _____. The psychological

63. In view of the psychological disorder of the Respondent to


comply with the essential obligations of marriage and such incapacity
being found to be grave, incurable, and permanent, and existing prior
to or before the celebration of marriage between them, and its root
cause having been clinically identified, there is a necessity to declare
the marriage a complete nullity.

64. The Petitioner seeks to have her marriage to Respondent


be declared null and void because of the foregoing reasons.

PRAYER

WHEREFORE, premises considered, it is most respectfully


prayed that after notice and hearing, the Court render judgment
declaring the Respondent psychologically incapacitated and declaring
as null and void the marriage between Petitioner and Respondent in
accordance with Article 36 of the Family Code.

Other reliefs, just and equitable under the premises, are likewise
prayed for.
