A dairy farm inspection was conducted at your facility on this date. This inspection revealed that the
following violation(s) were repeat violation(s) the previous inspection:

The Idaho Department of Agriculture/Grade A Pasteurized Milk Ordinance states that should a repeat
violation of any requirement set forth in Section 7 of the Grade A Pasteurized Milk Ordinance be found to
exist on an inspection, a reinspection shall be required after the time deemed necessary to remedy the
violation, but not before the lapse of three days. The reinspection shall be used to determine compliance
with the requirements of Section 7. Any violation of the same requirement on the reinspection, after two
consecutive violations of the same item shall call for permit suspension. The suspension will be in effect
until a reinspection indicates compliance.

Dear Producer:
A dairy farm inspection was conducted at your facility on this date. This inspection revealed that the
following violation(s) were repeat violation(s) from the previous inspection:

The Idaho Department of Agriculture/Grade A Pasteurized Milk Ordinance states that should a repeat
violation of any requirement set forth in Section 7 of the Grade A Pasteurized Milk Ordinance be found to
exist on an inspection, a reinspection shall be required after the time deemed necessary to remedy the
violation, but not before the lapse of three days. The reinspection shall be used to determine compliance
with the requirements of Section 7. Any violation of the same requirement on the reinspection, after two
consecutive violations of the same item shall call for permit suspension. The suspension will be in effect
until a reinspection indicates compliance.

RE: Stouder Holsteins Dairy final lagoon samples

I have conducted a textural estimate of samples provided from the completed


soil liner on the Stouder Dairy site. Estimates of USDA texture and clay
content are provided.

On September 21 st I received eight samples you pulled from the liner material
in the floor and embankments of the lagoon. Those samples had mostly silt
loam textures with clay contents ranging from 16 to 19 percent. All samples
were well within the tolerance for a suitable soil liner.

Today I received three additional samples from Donell Fluckiger of the Idaho
State Department of Agriculture. He pulled these representative samples as part
of his final inspection of the completed lagoon. Textures are all silt bowls with
clay contents ranging from 17 to 19 percent and were very plastic.

The textures and clay contents are consistent in both sample sets. All the
materials should provide a good seal for the pond if it is determined they were
properly placed, wetted and compacted. Based on the samples, this pond
should function properly and protect the groundwater aquifer.

Dear Mr. Stouder:

This warning letter is to inform you of an apparent violation of the Rules for the Control of Air
Pollution in Idaho, IDAPA 58.01.01.000 through 58.01_01.999 observed and documented during a
complaint investigation conducted by the Department of Environmental Quality (Department} at
Stouder Holsteins on March 13, 2007.
The apparent violation was as follows:

Legal Provisions Violated: IDAPA 58.01.01.600-617, Rules for the Control of Air
Pollution in Idaho, Rules For 'Control Of Open
Burning. General Restrictions.

IDAPA 58.01.01.603.01. Categories and Materials, states: No person shall allow, suffer, cause or
permit any open burning operation unless it is a category of open burning set forth in Sections 600
through 617 and the materials burned do not include any of the following:

i. Trade waste, as defined in Section 006, except as specifically allowed under Sections 600 through
617.

Description of Apparent Violation. On the afternoon of March 13, 2007, the Department received a
citizen complaint regarding open burning of trade wastes at Stouder Holsteins. The Department
dispatched Mr. Steve VanZandt to investigate. On arrival at the dairy, a large pile of material was
smoldering near a corral. Mr. VanZandt spoke with you and verified the material consisted of hay
bales and other trade wastes.

This is only a "warning notice." The Department intends no further action in this matter, and
beyond prevention of future violations, no future action is required of you. However, you should be
aware that a future violation of this type may result in civil or criminal action and the imposition of
monetary penalties_

RE: Grab samples from north pond at Stouder Holsteins

Today I received two samples you collected from the north pond at the Stouder
Holsteins facility. You indicated these soils are from the floor of the pond. I
determined that these are silt loam soils having clay contents ranging from 18 to
22 percent. If these materials have proper compaction, they should provide a
good seal for the lagoon.

These Laboratory soil results are an average of the duplicative/split sampling by the state lab, conducted
Oct/Nov 05.

Regulatory soil samples were recently taken by Idaho State Department of Agriculture (ISDA) on fields listed
below. The tests are taken for comparison of the Phosphorus (P) threshold and are obtained at one or two
depths depending on the resource concern of each field.

Surface water runoff concern exists when runoff leaves the contiguous operating unit from normal storm
events; rain on snow or frozen ground, or irrigation. Samples are taken at 0-12" and the P threshold may not
exceed 4Oppm.

Groundwater concerns exists when a high water table, fractured bedrock, cobbles, gravel, or course textured
soils are conducive for the downward movement of water and the associated nutrients. Samples are taken at
18"-24" and may not exceed 2Oppm with fractured bedrock or groundwater at less than five feet or 3Oppm
with groundwater at greater than five feet.

*Denotes field at or above Phosphorus threshold.

Any fields that exceed the Phosphorus threshold may only receive livestock or commercial Phosphorus
applications to crop uptake. Subsequent soil test results on fields that have exceeded the Phosphorus threshold
must show the Phosphorus level has remained the same or has been reduced. Failure to comply with these
requirements could result in revocation of your milk permit.

Note: When soil test Phosphorus (P) concentrations are above the threshold, the planner, in cooperation with the
producer, will design a nutrient management plan that will reduce soil test P concentrations below the threshold
and minimize potential off-site transport. This may require adjustments in crop rotation, irrigation method and
scheduling, form, timing or placement of P applied, and changes in P application rates less than crop P
uptake.
