12 Defendant Joseph Zernik, Receiver David J. Pasternak,

13 Richard Ormond of Buchalter Nemer specially appeared on behalf of

14 interested party Mara Escrow, Inc., and Moe Keshavarzi of

15 Sheppard, Mullin, Richter & Hampton appeared by telephone on

16 behalf of Plaintiff Nivie Samaan.

17 Upon considering the Receiver's Ex Parte Application, the

18 supporting Declaration of David J. Pasternak and all exhibits

19 attached thereto, all of the pleadings and other documents in the

20 Court's file for this case, and all other oral and documentary

21 evidence presented to the Court in connection with the Receiver's

22 Ex Parte Application, the Court issued the attached Ex Parte

23 Order which was served on Defendant Joseph Zernik in the
