Hi Kathy:

Sorry it has taken me a few days to reply, I am still a little behind on ernail.

I don't remember saying the intersection would be moved this summer and if I did I shouldn't have. Under the
A2 system of government I don't really have that power. I did say it could be moved this summer.

There are other crosswalk, intersection issues that have come up as well. Mostly low volume in regard to the
number of people crossing with an exception or two, Washington and 7th comes to mind. Council Member
Hohnke and I have been working on a resolution that clarifies the rights of pedestrians and the responsibilities
of drivers, it should be on the agenda for the first meeting in July. We are thinking about a more holistic
approach to intersection changes although we don't have anything concrete yet. We still need to meet with
staff,

Dear Mayo Hieftje;

The King School crosswalk was scheduled to be moved last fall. This minor project was within the authority of city staff. It
was engineered and scheduled last fall without the need for council approyal. City staff identified funding for the crosswalk
and neighbors agreed to fund raise and coordinate the construction of the extension to the existing blacktop path.

However, the project was put on hold by the City Administrator after a neighbor opposed the project because neither the City
nor AAPS would agree to shovel/maintain the crosswalk ramps and sidewalklblacktop path on his property (in right-of· way
along the street, similar to other sidewalks and ramps shoveled/maintained by homeowners.)

Therefore, a council resolution is required now to direct the City Administrator to move the crosswalk.

As background, this is a two-year old request and the crosswalk move is supported by the Transportation Safety Committee
(TSC), the King School Principal, the AAPS Director of Transportation and many neighbors who have contacted you and other
council members.

Your response to me in the hallway of city hall (which I referred to in my original email in this thread) was, "We have all

summer." I interpreted that to mean time to move the crosswalk, not time to debate this project and allow cronyism to delay a
needed safety improvement.

Kathy,

I'd like to report out on your request for the construction of a new sidewalk, south of King Elementary School and on the east
side of Waldenwood Dr. and relocation of the marked pedestrian crossing near the school's eastern driveway.

Staff has assessed the situation from the perspectives of feasibility, finance and operations. A new path, approximately 200' in
length, would have to be constructed in the City's ROW. The new path would require grading on the adjacent two properties
fronting Pemberton Lane. Costs for a concrete path to tie into new ADA ramps at the PembertonlWaldenwood intersection
ranges from $15,000-$20,000. A non-standard asphalt path with concrete ADA ramps would cost $10,000. Both options would
require winter maintenance.

From a traffic and pedestrian standards and safety point of view, the traffic speed limit is low at 25 mph, sight distance is
sufficient, and traffic volume is low. In the last 10 years and within 500' of the existing mid-block crossing there have been no
reported pedestrian related accidents, and only one reported minor automobile accident. There does not appear to be a
groundswell of concern over pedestrian safety within the neighborhood. And our on-location visit seem to concur with the
notion that safety issues there are seemingly minor.

Both the AAPS and abutting property owners indicated they will not participate in the construction cost or the maintenance of
the sidewalk.

It is staff's view that constructing the sidewalk with a provision for maintenance will not be an effective solution given the
marginal improvement it would bring. Relative to other higher volume and higher traffic speed pedestrian crossings in the city,
and coupled with the safety history of the current crossing, would not cause the construction of a new path to be considered a
high priority. In addition, the City's CIP budget doesn't currently contemplate construction at this location and most likely
would not be altered given the low priority need for the new path.

Thus, staff is not recommending the expenditure and construction of a new path on Waldenwood Dr., especially in the
absence of a sidewalk maintenance agreement.

I appreciate that the aforementioned positicn is not likely to satisfy your ongoing concerns. I hope that you'll respect the
thoroughness of the assessment performed by staff and their findings.

Thanks for your prompt. professional reply. Unfortunately there are three key issues:

1. The summary financial numbers are not correct based on the detail I have from staff -- including the engineering
drawings.
2. City staff already supports this project by participating in the Transportation Safety Committee (TSC), a joint City -
AAPS committee that has existed since the late 1960's. As I have stated many times, the TSC recommended this
move -- thus the City officially supports this move.
3. You are not a member of the TSC, thus have no official authority to attempt to re-write history on behalf of city staff.

Regardless of Roger Fraser's personal opinions, he reports to City Council and needs to be held accountable. You were
elected to serve the second ward. not engage in this elegant, yet disappointing, cronyism. Please reconsider your role as a
council person and support this move for the safety of our students.

Really?!?! TSC, Kevin Karr, the police chief, etc. have all said it's a problem. How about all the near
misses that we all have seen. One soon-to-be 5th grade parent didn't realize that the near miss that
their then 4th grade son had while on safety duty at the end of the year was actually not limited to that
one time. I sent an e-mail to all the families I knew had children training to be a safety at that spot & told
them why I wouldn't let either of my children do it. Some were suprised to find out about this ...didn't
realize it since they don't walk their children to school.

There is limited site visibility since children aged 5-10 are the ones crossing at the mid-block & can not
possibly see over cars that are parked or waiting to turn in to the driveway (I assume most cars are
between 4 1/2 feet & 6 feet tall). Additionally, children can not & should not cross if any cars are in that
area (waiting to turn in, picking up, etc.) as children are not developmentally old enough to make a safe
decision ...added to the fact that drivers often make poor decisions.

Why is the city going to honor the comment that the homeowners won't maintain the sidewalk? Ticket
them then. We all have to do iLwhy should they get to opt oul. If they get to, then I want to opt out as
well.

I'm sure there's more to say ..

First, the financials have been consistent for as long as I've been involved in the matter - the only thing that
has changed since a couple of years ago has been the prospect of private funding being raised to help defray
the construction costs - the costs quoted to you reflect those that the City would have to incur if we assumed
the entire charge. If prior quotes were less than they were predicated on private funding to complement the
City's contribution. No funding has ever been allocated to the project that I'm aware of. Second, just because
the City parncipates in a committee does not constitute a formal or official approval of a given project - as you
noted in tonight's public comment, the TSC is advtsory only. Issues and recommendations that evolve from
groups like the TSC are considered on their merits by the City Administrator and/or City Council on a case-by-
case basis.

I made no attempt to "re-write" history and quite frankly, am unclear as to what you're alluding to. I merely
provided you with a summary of staffs assessment. By the way, you indicated that Chief Jones visited the site
(yes he di) and implied his support - for the record he too does not view the construction of a new path to be
warranted.

Lastly, there is no cronyism and I challenge you to provide evidence to clarify and/or and substantiate your
claim. All we can do is judge the facts. and as articulated, they fail to project the matter to a high enough
priority that would justify construction of a new path at this time. I'm sure that we would be happy to reassess
the issue if new and compelling facts became evident.

FYI. Stephen came late to this project and continues to make incorrect statements. Tony Derezinski had the lead on this
project until he transferred it to Stephen in the fall of 2009. The City staff were pushing to get it completed before the end
of the asphalt season and Tony was scheduled to be out-of-town for a week, so he asked Stephen to take the project. As
I stated before, staff had identified funding for the concrete ramp work and this minor project did not need Council
approval for the funding. The neighbors committed to pay for the blacktop path, so funding was not an issue.

I have emails to document this and the support of the project by staff, Stephen and Tony. All this changed with the
October 30 email from Roger Fraser to Stephen and now there is an attempt to rewrite history by someone who was not
involved until what was to have been the final week (or two) of the project. In addition, professional engineering and
safety staff are suspiciously changing their positions on this project to be consistent with Roger Fraser's position.

Roger continued violation of State law with the placement of metered parking near the mid-block crosswalk immediately to
the north of City Hall, indicates that he lacks the expertise and knowledge of crosswalk safety to be involved in this
decision making.

the matter, and even offer a Council resolution is merited. All we can do is judge the facts, and upon closer scrutiny, they fail

In response to your email of April 27, and more specifically your question about "taking a broader perspective," I reviewed my Tum off highlighting
Travel
Transportation Safety Committee (TSC) files and discovered that the most recent comprehensive transportation safety analysis

predates Patrick Cawley's service on the Transportation Safety Committee (TSC). Therefore, the requested analysis is summarized
below, along wrth the TSC background and my relevant experience. The Comprehensive Transportation Safety Program •• Final
Report (2001) is attached in .doc and .docx formats.

I summarized this analysis at the Council meeting on May 3, stating that I would send council members a copy of the report and
Kathy Griswold repeating my request that the City "honor the official process" by immediately moving the King School crosswalk to the nearby 4-way
intersection.

I appreciate your attention to this issue and interest in taking a broad perspective, but at the same time the crosswalk move

project was cancelled without explanation.

AnnArbor.com repeated the article on the crosswalk in their Sunday "newspaper" edition and the Lucy Ann Lance Show has
requested an interview with a parent and me next week. It would be great to announce a completion date for the King School
crosswalk project and plans to improve the process so future projects can be completed in a timely manner.

In addition, many of the recommendations from the comprehensive analysis •• which are standard in most communities •• have not
been implemented due to the lack of "political will" by the Council and Board of Education. Even as a trustee from 2001-2005, a time
when the focus was on addressing high school overcrowding and raising revenue, I was not able to develop the "political will" to
proactively address school transportation safety issues. Funding was approved in the 2002 sinking fund. but the initiative was
disrupted by the district crisis surrounding Skyline's construction delays and cost overruns.

It would be great if you would take the lead on a comprehensive safety initiative and I would gladly provide whatever support you
request.

1. Background on Comprehensive Analvsis

In the fall of 2000, I was hired by the Ann Arbor Public Schools (AAPS) as a consultant, per my contract, "to improve the safety of
students while traveling to and from public school." My work, in collaboration with the TSC, is outlined in the attached
Comprehensive Transportation Safety Program .- Final Report. The attached report and supporting documentation (available upon
request) includes:

• a comprehensive review of all school sites and school walk zones, including site audits
• maps of all school walk zones for communicating to parents. Crty staff generated these from satellite images (this project
predates Google Map and Earth)
• interviews (online and paper surveys and open-ended, in-person interviews) with parents, bus drivers, school staff, city
employees, and others
• a review of applicable best-practices in school transportation safety (including the AAA and the Michigan "Getting to School
Safety Program" guidelines, which have been replaced with the "Safe Routes to School Program")
• recommendations to the City (and other governmental entities) and AAPS for safety improvements.

2. Background on Formation of TSC

Documentation on the formation and authority of the TSC is available on request. Sylvia Lewis. one of the founding members of what
was initially established as the Safety Committee, gave me her personal file dating back to 1968. One of the first projects was the
pedestrian overpass on Plymouth Road for students crossing from UM housing to Northside School. (I am told rt was removed when
Plymouth Road was widened and the students were then bused.)

3. My Relevant Background

I joined the TSC in 1994, thus have over 15 years experience working with school staff, traffic engineers and safety officers on ADA
and school transportation safety solutions. My formal education is business and information systems (MBA from U of M in 1981), but
I had responsibility for and executive education in safety and data security at Burroughs, then Unisys Corporation. I have completed
the Michigan "Getting to School Safety Program" and "Safe Routes to School Program" training and worked closely with the AAA on
the school safety patrol program. I also conducted safety analyses at Emerson School and the Ronald Me Donald House.

Thank you for meeting with parents at the King School crosswalk last Friday. The weather was very pleasant
and the vehicular traffic was much lighter than when it is cold and/or raining.

The recommendation of the Transportation Safety Committee (TSC) to move the crosswalk to the safer 4-way
intersection is based on multiple site visits and the dangerous conditions created when vehicles are queued to
turn into the King School driveway. Many of the parents described this situation and Officer Clock and Police
Chief Jones can attest to it based on their site visit last winter.

The parents who advocated for the crosswalk move are now asking what the next step is. We are appreciative
of your time, but our goal is to get a safe crosswalk constructed at the corner of Waldenwood and Penberton.
I was told last fall that a council resolution is required.

Councilmen Rapundalo and Derezinski -- Are you willing to introduce the needed resolution in May, based on
your visit and the recommendation of the TSC? If not, what further information is needed?

Hello Todd,

Mayor Hieftje has agreed to meet at King School to discuss the crosswalk move. Per a conversation last night, he hopes
to schedule the meeting for this week. Ryan Stanton from AnnArbor.com has asked to attend the meeting, if his schedule
allows, and the Mayor has agreed.

I will be providing an update on this project at the City Council meeting this evening and future meetings until the crosswalk
is moved.

I believe you spoke to Roger Fraser and he said the crosswalk was not going to be moved. To my knowledge, that was
the end of your conversation. I recommend that you email Roger Fraser and request that the King School crosswalk be
moved immediately for the safety of your students and as recommended by the district's Transportation Safety Committee
(TSC). The TSC is listed on the City's website as an official committee and a traffic engineer and safety officer serve on
the TSC. You need to take this action for three reasons.

1. To support your staff who are on record (written) supporting the move -- Kevin Karr and Brad Mellor.
2. To support the established process of the City and AAPS, which is the TSC's process.
3. Not supporting the move (in writing) could be interpreted negatively by the media and City leaders.

As always, I am available to provide more information at your request.

Safety Committee (TSC). City staff have all the information, including the engineering drawings and contact information. However, I am
willing to provide whatever information is needed to expedite this project as most of the children are currently crossing at the 4-way
intersection without a crosswalk.

More than 7 weeks have passed since I sent you the e-mail below about moving the mid-
block crosswalk on Waldenwood (at the King School driveway entrance) to the corner of
Waldenwood & Penberton Dr. Since that time, I have done a site visit with Officer Clock &
Chief Jones on November 17,2009. That is the only communication, or response I have
had since my November 12, 2009 e-mail to you. I am extremely dissapointed that I haven't
heard back from anyone regarding this mid-block crossing move.
With winter having set in, this mid-block crossing has become even more dangerous!
Cars and buses typically slip and slide on snow & ice found on the city streets. It is no
different at this mid-block crosswalk. What makes this mid-block crosswalk even more
dangerous than before? The fact that there young children trying to cross the street in cold
(& snowy weather) to get to school at the same exact location where there are a huge
amount of cars PLUS multiple buses driving north & turning left into the King School
driveway, cars & buses driving south & turning right into the King School driveway, & cars
driving north or south on Waldenwood that have now gotten caught in the King School traffic
& are in a hurry to get to work. A mid-block crossing is dangerous enough as it is ...add
in snow, ice, children trying to cross to get to school, & impatient (or even "tuned
out") drivers to the mix & it's a recipe for disaster!

Moving the crosswalk to the corner of Waldenwood & Penberton Dr. allows children walking
& biking to school to be able to SAFELY cross Waldenwood. Moving the crosswalk from the
base of the driveway entrance is not only a logical, but a responsible thing to do.

Please let me know what it will take to allow our children a safe place to cross the street to
get to school.
