1.4 PART OF WORDS AND TERMS


.1 Refer to and acknowledge other words, terms, and definitions in the Contract. Refer to NCC
Tender Requirements and General Instructions to Bidders and as described in Supplementary
Conditions.
.2 All terminology used within these documents identifying Architect, Engineer, Consultant,
NCC Engineer, etc. shall be replaced by NCC Representative as defined by the General
Conditions.

1.5 COMPLEMENTARY DOCUMENTS


.1 Refer to NCC Tender Requirements and General Instructions to Bidders for Complementary
Documents.
.2 Specifications apply to all project packages except where indicated otherwise in the title to
apply to specific packages.
.3 The Contract work consists of multiple projects at the buildings adjacent to the Tin House
Court. This work is documented in 5 packages of drawings, each of these for a distinct part of
the whole scope of the work and a specifications document which for the structural and
masonry sections are divided by building, and labelled accordingly.
.4 Drawings, specifications, and schedules are complementary each to the other and what is
called for by one to be binding as if called for by all. Should any discrepancy appear between
documents which leave doubt as to the intent or meaning, abide by Precedence of
Documents article below or obtain direction from the NCC Representative.
.5 Drawings indicate general location and route of conduit and wire/conductors. Install conduit
or wiring/conductors and plumbing piping not shown or indicated diagrammatically in
schematic or riser diagrams to provide an operational assembly or system.
.6 Install components to physically conserve headroom, to minimize furring spaces, or
obstructions.
.7 Locate devices with primary regard for convenience of operation and usage.
.8 Examine all discipline drawings, specifications, and schedules and related Work to ensure
that Work can be satisfactorily executed. Conflicts or additional work beyond work described
to be brought to attention of NCC Representative.
.9 Refer to architectural drawings for location and placement of equipment, including interior
elevation and reflected ceiling drawings. Where a discrepancy exists, obtain instructions on
location.

1.6 PRECEDENCE OF DOCUMENTS


.1 Except as otherwise governed by the Supplementary Conditions and General Conditions, in
the event of conflict within and between the Contract Documents, the order of priority within
specifications and drawings are - from highest to lowest:
.1 Agreement - Between Owner and Contractor,
.2 Supplementary Conditions (if any),
.3 General Conditions of the Contract,
.4 Sections of Division 1 of the specifications,
.5 Specifications:
.1 Sections of Divisions 2 through 49 of the specifications, and
.2 Specifications specifically indicated on drawings.
.6 Schedules and keynotes:
.1 schedules within the specifications, then
.2 schedules on drawings.
.7 Drawings:
.1 Drawings of larger scale shall govern over those of smaller scale of the same
date, then
.2 Dimensions shown on drawings shall govern over dimensions scaled from
drawings, then
.3 Location of equipment and outlets indicated on architectural drawings takes
precedence over positions or mounting heights located on mechanical or
electrical drawings.
.8 Later dated documents shall govern over earlier documents of the same type.
.9 Resolve conflict or discrepancy between the two language versions of the Contract
Documents as directed by the NCC Representative
.10 In the event of conflict between documents, including but not limited to differences
between drawing packages or specifications, the decision of the NCC Representative
shall be final.

1.7 DESCRIPTION OF THE WORK


.1 Work of this Contract comprises, but is not limited to:
.1 Demolition:
.1 existing foundation at 7 Clarence Street
.2 temporary cladding at the east wall of 465 Sussex Drive
.3 part of the structure and roof of the existing basement level kitchen serving
13 Clarence Street.
.4 Kitchen and related service infrastructure serving the kitchen at 13 Clarence
Street.
.5 Selective demolition of parts of 445-465 Sussex Drive as required to
implement proposed new construction.
.6 Selective demolition of parts of 13-15 Clarence as required to implement
proposed new construction.
.7 Excavation around 445-465 Sussex.
.2 General construction of a new building located at 7 Clarence Street and identified as
7 Clarence Street. (Package 1)
.3 Kitchen and accessibility renovations, and building structure and systems upgrades,
and addition of sprinklers at 13 Clarence Street (Package 2)
.4 Accessibility upgrades for 445 to 465 Sussex Drive. (Package 3)

.5 Site upgrades for the general site serving all of the above addresses including
landscaping, site services, lot grading and drainage. (Package 4)
.6 Historic Masonry and exterior envelope repairs for 445 to 465 Sussex Drive.
(Package 5)
.7 The documents for the above components of work are prepared as individual
packages. Co-ordinate the work between all of the related packages.
.2 Division of the Work among suppliers or vendors, subcontractors and other contractors is
solely the Contractor's responsibility. Neither the Owner nor NCC Representative assumes
any responsibility to act as an arbiter to establish subcontract terms between sectors or
disciplines of work.

1.8 CONTRACT METHOD


.1 Construct Work under single, stipulated price contract.
.2 Relations and responsibilities are between the Contractor and the Owner.
.3 Provide the required bonds, and liability insurance to ensure such specified assurances to the
Owner.
.4 Assigned Subcontractors are required to provide requested bonds covering faithful
performance of subcontracted work, to the Owner plus payment of related obligations
.5 Refer to Section 01 21 00 for cash allowance amounts applicable to assignable contracts.
.6 Assume responsibility for assigned contracts as Subcontracts forming part of the Work.
.7 Contract Documents were prepared by the NCC Representative for the Owner. Any use
which a third party makes of the Contract Documents, or any reliance on or decisions to be
made based on them, are the responsibility of such third parties. The NCC Representative
and the Owner accept no responsibility for damages, suffered by any third party as a result of
decisions made or actions based on the Contract Documents.
.8 For purposes of reference in these Contract Documents, the term "Contractor" shall mean the
party in contract with the Owner.

1.9 DOCUMENTS PROVIDED


.1 Owner will supply the Contractor with ten (10) sets of Contract Documents for construction
purposes.
.2 The Contractor may obtain additional sets of Contract Documents.
.3 An electronic set of documents in pdf format will be provided at the contractors request.
.4 An electronic set of documents in editable format may be provided at the discretion of the
consultant for purposes of transferring changed information recorded on as-built documents to
the electronic Record Documents.

1.10 PERFORMANCE OF THE WORK


.1 Substantial Performance of the Work in 13-15 Clarence (Package 2) including building access
upgrades described in the Site Work (Package 4) is required for Partial Owner occupancy
before May 31, 2015, 2016.
.2 Substantial Performance of the remaining Work is required for Owner occupancy before
December 15, 2016.

1.11 CONTRACTOR USE OF PREMISES


.1 Contractor has unrestricted use of site as designated by Limit of Work on the Construction
Documents until Substantial Performance of the Work.

.2 Emergency Building Exits During Construction: As shown.


.3 Construction Operations: Limited to areas noted on Drawings.
.4 Time Restrictions for Performing Exterior Work: 7:00 to 18:00 Monday to Saturday, unless
noted otherwise in Division 00.
.5 Work to be carried out Monday to Saturday. No work permitted on Sundays, unless noted
otherwise in Division 00.

1.12 PARTIAL OWNER OCCUPANCY


.1 Schedule and substantially complete designated portions of Work for Owner's occupancy at
completion of each of the following parts of the work and prior to Substantial Performance of
entire Work.
.1 For the work included in the following Packages (May 31, 2015):
.1 13-15 Clarence (Package 2)
.2 For the work included in the following Packages (December 15, 2015):
.1 7 Clarence (Package 1)
.2 445 to 465 Sussex Drive. (Package 3)
.3 Exterior landscaped spaces (Package 4)
.4 445-465 Envelope Repair (Package 5)
.2 Execute Certificate of Substantial Performance of the Work for each designated portion of
Work prior to Owner occupancy. Contractor shall allow:
.1 Access for Owner personnel.
.2 Operation of plumbing, HVAC, fire alarm, sprinkler and electrical systems.
.3 On occupancy, Owner will provide for occupied areas:
.1 Security.
.4 Maintain fire and life safety systems and public access to exit to be maintained during all
stages of the Work.

1.13 PROTECTION OF EXISTING


.1 Arrange and pay for an independent building and site condition audit of existing and
neighbouring property prior to commencement of work. Audit to include:
.1 Prepare photo record of exterior and interior, identifying existing condition in order to
be able to assess claims for damages resulting from the work.
.2 Provide a CD copy of record to the Owner's representative in jpeg or TIF format.
.2 Monitoring of rock removal vibration: Conduct monitoring by vibration measurements in order
to ensure that the vibration threshold is not exceeded, using seismographs installed on
monitored buildings. Allow for one seismograph installation each at 13-15 Clarence, 445-465
Sussex Drive, 457 Sussex Drive and 19 Clarence Street. Monitoring to be conducted by a
certified specialist with minimum 3 years experience in similar work, and acceptable to the
Consultant.
.3 Protect existing property from damage, and repair damage resulting from work.
.1 Provide construction barriers around work, and prevent access to construction site
.2 Maintain no interruption to neighbours use of premises.
.3 Minimize interruption to neighbours access.
.4 Ensure continuous utility supply.
.5 Make good damage to landscaping and exterior and interior of neighbouring
buildings.

.6 Respond to claims from neighbouring owner for damage.


.7 Provide insurance coverage for damage claims.
.4 Construct new work shown on the documents located on neighbouring property, or City right-
of-way.
.5 Maintain public access to Courtyard system during work as indicated on the drawings.
.6 Install temporary construction bridge over basement level kitchen for duration of works
requiring equipment and supply loads over the kitchen roof. Transport bridge from NCC yard
to site and return upon completion of work.

1.14 WORK BY OWNER


.1 Security system other than shown on drawings
