In order to determine whether the employees fall within the definition of “workman” under

the Industrial Disputes Act, 1947 (“ID Act”), you have to review the roles and responsibilities and if
any employees report to him/her. Also check if it’s a supervisory role with salary above the
prescribed threshold, then he/she clearly falls outside of the ambit of protection under the ID Act.
