On November 9, 2016 the Federal Energy Regulatory Commission (“Commission” or

“FERC”) issued an Order Denying Motion to Dismiss and Issuing Certificate (“Order”) for
Millennium Pipeline Company, L.L.C.’s (“Millennium”) Valley Lateral Project (“Project”).1
Pursuant to Environmental Condition No. 8 in Appendix B of the Order, Millennium hereby
submits for filing supplement #1 to the bi-weekly construction progress report for the reporting
period ending December 27, 2017.

PROJECT SUMMARY:
Construction Activities During Reporting Period
 Tree Felling: Entire ROW tree felling by hand is 99.5% complete except at MP 0.69

 Access roads and access pads: Access Road TRO-007 is top soiled

 Grubbing: Is complete from MP 5 to MP 5.66

 Eagle Nest Monitoring:

Millennium has completed pipeline construction activities in the vicinity of the unoccupied
bald eagle’s nest located near MP 5.3 of the Project right of way. Prior to construction,
Millennium’s bald eagle biologist periodically inspected the nest. During the time period in
which construction activities occur in this area, Millennium has had and will continue to have
a bald eagle biologist on site. No nesting or breeding activities were observed by the bald
eagle biologist during this reporting period. Daily bald eagle monitoring reports for this
reporting period are attached.
 Grading: ROW grading is complete from MP 5.32 to MP 5.66
 Stringing: Pipe is strung from MP 5.32 to MP 5.58
 Welding: Welding is complete from MP 5.32 to MP 5.58
 Trenching: Trenching is complete from MP 5.32 to MP 5.58
 Backfill: Backfilling is complete from MP 5.32 to MP-5.58
 Restoration: complete from MP 5.32 to MP 5.46
 Bore of wetland W-V at MP 5.3 is 100% Complete.

Notices to Proceed and Variances

 On October 27, 2017 the Commission granted Millennium’s Request to proceed with
construction for all portions of the Project.
 Millennium filed a Request for Variance to add the Milford Yard as an additional Project
pipe/contractor yard during construction with the Commission on December 11, 2017, which
was granted on December 20, 2017.

Environmental Training
 Construction Environmental Training was completed on 11/28/2017.

Update on Federal Authorizations

 Millennium has received all authorizations required under federal law.
 On December 7, 2017, the U.S. Court of Appeals for the Second Circuit denied a request
from the New York State Department of Environmental Conservation to stay construction of
the Project and dissolved the administrative stay it had put in place allowing construction to
proceed.
 On December 15, 2017, the Second Circuit denied a separate request by Sarah E. Burns,
Amanda King, Melody Brunn and Brunn Living Trust, Pramilla Malick, and Protect Orange
County for an emergency stay to stop construction activity in the vicinity of the bald eagle
nest.

Planned Construction Activities During Next Reporting Period

 Complete restoration from MP 5.46 to MP 5.56. Install safety fencing in Bald eagle effected
zone with signage of no access. After 12/31/2017 there will be no access between MP 5.34
to MP 5.56.
 Start grading from MP 5.29 back towards MP 5
