COMPLAINT-AFFIDAVIT

I, JEFF TALATTAD, of legal age, single, and a resident

of Malibabag, Peñablanca, Cagayan, after having been sworn
to in accordance with law, depose and say:

1. That on December 18, 2016 at around 9:00 in the

evening, while I was at home preparing for dinner, I
received a text message from Antonio Paguirigan
(hereinafter respondent);

2. That the content of the text message is that:

“Magkita tayo sa Scorpion Bar” which was located at
Macapagal Avenue, Centro 11, Tuguegarao City, Cagayan and I
replied “OK”;

3. That on the same day at around 10:00 in the

evening, when I arrived at the agreed meeting place, I
immediately sent a text message to respondent Paguirigan
saying: “Asan kayo banda” while looking for respondent
Paguirigan;

4. That thereafter, I saw respondent Paguirigan

standing near the entrance of the bar that’s why I moved
towards him;

5. That when I come close to his place, I noticed a

motorcycle with a person on board driving towards me;

6. That when I was about to alight from my

motorcycle, I heard respondent Paguirigan saying to the
person driving the approaching motorcycle: “barilin mo na!”
(shoot him);

7. That, immediately thereafter, the respondents

escaped from the place of incident;

8. That after the shooting incident, two bystanders

helped me and took me to the nearest hospital for medical
treatment;

9. That my gunshot wounds were operated by Dr.

Francisco Villaflor and I was confined at the People’s
General Hospital Tuguegarao City, Cagayan for more than one
week;

10. That I am executing this affidavit to attest to

the truth of the foregoing statements for the purpose of
charging the respondents with Frustrated Murder penalized
under Article 250 of the Revised Penal Code;
