W H E R E A S Muslim recognised as Minority Community in the State Of

W e st Hengal and minorities have the right under Article 30 ol the Constitution of
India to establish and administer educational institution ol their choice;

A N D W H E R E A S the Stale Government is competent to declare a

purlieu’.ai institution as a minority institution and till such time the government
issu e an oidet declaring that it is a minority institution, they can not operate as
Mmonty Institutions.

A N D W H E R E A S the Suprem e Court has held that the G overnm ent ate
the Competent Aulhority to verify and determine the minority status of an
Educational Institution for the purpose of Article 30(1) of the Constitution of India.

A N D W H E R E A S the Govt, recognised Madrasahs, including Hooghly

Govt M a d ra sah and Ihe Calcutta M adrasah were originally established by the
Muslim minority and continuously administered by the members of that minority
lo subserve and promote Ihe interests of Ihe minority community concerned.

A N D W H E R E A S the abovesaid M adrasah s were, in course o f times,

recognised alongwilh liabilities by the Government for promoting educational
mieresls of Ihe Muslim minority and on verification it has been ascertained that
more than 9 0 % students are pursuing their studies in these institutions and these
M adrasah s are functioning under supervision of the W.B. M a d ra sah Board
constituted wilh member representatives of the Minority Community concerned.

A N D W H E R E A S the State Govt, having been satisfied about the above

antecedents of all Ihe recognised.'M adrasahs which are aided and guided by the
Governm ent prescribed guidelines relating to admissions, selections etc and
about their continuing and sustained functioning for promoting the interests of the
concerned minority, have become satisfied that these institutions are fit to enjoy
minority status of an Educaiional Institution for the purpose of Article 30(1) of the
Consbiution of India,
