REPORT OF INVESTIGATION Complaint Number 17-004 NOTICE CONCERNING CONFIDENTIALITY This report of investigation concerns an alleged violation of Chapter 112, Part Ill, Florida Statutes, or other breach of public trust under provisions of Article Il, Section 8, Florida Constitution. The Report and any exhibits may be confidential (exempt from the public records law) pursuant to Section 112.324, Florida Statutes, and Chapter 34-5, F.A.C., the rules of the Commission on Ethics. Unless the Respondent has waived the confidentiality in writing, this report will remain confidential until one of the following occurs: (1) the complaint is dismissed by the Commission; (2) the Commission finds sufficient evidence to order a public hearing; or (3) the Commission orders a public report as a final disposition of the matter. STATE OF FLORIDA COMMISSION ON ETHICS Post Office Drawer 15709 Tallahassee, Florida 32317-5709 REPORT OF INVESTIGATION TITLE: JAMES BARFIELD Brevard County Commissioner, District 2 Merritt Island, Florida COMPLAINT NO.: 17-004 Exhibits A through E INVESTIGATED BY: fife Nadrargne dion ‘oberto Anderson-Cérdova Distribution: Commission on Ethics Respondent Advocate File Releasing Authority: Leal 2 Executive Director w/z2f> Date REPORT OF INVESTIGATION COMPLAINT NO. 17-004 (1) Mr. Matthew Nye of Melbourne alleges that James Barfield, a Brevard County Commissioner, failed to make required disclosures as to certain assets and income on his 2014 and 2015 CE Form 6, Full and Public Disclosure of Financial Interests. The Complainant further alleges that the Respondent failed to disclose his County Commission salary as income on his 2014 CE Form 6, failed to properly disclose retirement and money market accounts on his 2014 CE Form 6, and failed to properly disclose money market accounts on his 2015 CE Form 6. (2) The Executive Director of the Commission on Ethics noted that based upon the information provided in the complaint, the above-referenced allegations were sufficient to warrant a preliminary investigation to determine whether the Respondent's actions violated Article Il, Section 8, Florida Constitution, and Section 112.3144, Florida Statutes (Full and Public Disclosure of Financial Interests). (3) _ The Respondent, who was represented by his attorney, Mark Herron, stated by telephone that he has was elected to the Brevard County Commission in November 2014, and is the Chief Executive Officer of a medical staffing firm named Luke and Associates. He related that upon Mr. Herron's advice, he decided to submit a CE Form 6X, Amendment To Full and Public Disclosure of Financial Interests, for filing years 2014 and 2015. The Respondent advised that the 2014 CE Form 6 was the first time he filed a Form 6. (4) __ Brevard County Supervisor of Elections Office records reflect that the Respondent filed a 2013 Form 6, on June 16, 2014, as candidate for the Brevard County Commissioner position (appended as Exhibit A). EAILURE TO REPORT INCOME (5) The Respondent stated that it was a "complete oversight" and "mistake" that he did not disclose his income as a Commissioner on his 2014 CE Form 6 (Complaint pages 4-6). He explained that he corrected the issue when he submitted his amended 2014 CE Form 6X (appended as Exhibit B) on August 1, 2017. He advised that $4,627.97 is the amount of income reflected on his Brevard County provided W-2 Form. FAILURE TO PROPERLY DISCLOSE ASSETS ON 2014 FORM 6 (6) The 2014 Form 6 instructions (appended as Exhibit C) state: "How to Identify or Describe the Asset: Intangible property: Identify the type of property and the business entity or person to which or to whom it relates. Do not list simply "stocks and bonds" or "bank accounts." (7) The Respondent's 2014 Form 6 (Complaint pages 4-6) reflects an asset identified only as, "Money Market Account," with a value of $1,400,000. (8) The Respondent's amended 2014 Form 6X reflects a BB&T Investor's Deposit Account for $1,071,717.03. ‘The Respondent stated that this BB&T account is the only money market account he had as of December 31, 2014. He stated that this money market account essentially serves as "cash," and that he was told by BB&T that this account cannot be broken down into farther investments. (9) The Respondent overstated the value of his money market account by $328,282.97 on his 2014 Form 6. He explained that he had not reviewed his records thoroughly enough to provide the correct amount. (10) The Respondent's 2014 Form 6 also reflects an asset identified as "Value of retirement account ~ 401K Plan," valued at $160,000. (11) The Respondent's amended 2014 Form 6X reflects an "Individual Retirement Account Edward D Jones Custodian Prudential Premier Retirement," valued at $93,260.09, and "Edward Jones Joint Tenants with Right of Survivorship,” valued at $25,234.03. The Respondent stated that the Individual Retirement account is an annuity which cannot be broken down further into investment products, The Respondent related that these constitute all of the retirement accounts he had as of December 31, 2014. (12) _ The Respondent overstated the value of his retirement account(s) by $41,505.87 on his 2014 Form 6. He explained: When I put the information on my 401K, I just kind of estimated it, and I didn't do all of the leg work to go back and see exactly what it was. Once I did that, T put the accurate numbers in there, FAILURE TO PROPERLY DISCLOSE ASSETS ON 2015 FORM 6 (13) The 2015 Form 6 instructions (Complaint page 13) state: "How to Identify or Describe the Asset: Intangible property: Identify the type of property and the business entity or person to which or to whom it relates. Do not list simply "stocks and bonds" or "bank accounts." (14) The Respondent's 2015 Form 6 (Complaint pages 8-10) reflects under assets, a "Money Market Account" valued at $1,300,000. (15) The Respondent's Form 6X for 2015 (appended as Exhibit D) reflects a "BB&T Investor's Deposit Account," valued at $663,638.62. The Respondent stated that the BB&T account is the only money market account he had as of December 31, 2015, and is his personal account, which he can use for Luke and Associates business purposes under its filing as a Sub Chapter S corporation. When asked why there was an overstated difference of $636,361.38, between the 2015 Form 6 and the 2015 Form 6X, the Respondent explained that he took money from this BB&T account and placed it into a retirement account, and that other money from this BB&T account was used to cover business expenses. He added that it is a "fluid account," meaning there are many transactions. He clarified that when he claimed $1,300,000 on his, 2015 Form 6, it was an estimate of the amount of money he believed was in the account at the time. (16) The Respondent stated that in general, he read the Form 6 instructions, but "just kind of glanced over them," and now realizes that he did not spend the amount of time he should have reading the instructions. He related that he completed the Form 6's alone, and does not remember if he knew at the time that he could call the Florida Commission on Ethics for information on how to complete the forms or remember if he saw the help flyer (appended as Exhibit E).
