CONTRACT AMENDMENT No.

This Contract Amendment is signed and executed on _____th day of June 2017.

BETWEEN

PT. Pratama Nusantara Sakti, a Corporation incorporated under the Laws of Indonesia having its
Office at Jakarta Indonesia (Hereinafter referred as “EMPLOYER”/’First Party”, which expression shall,
unless repugnant to the context or meaning thereof, include its legal representatives, successors and
assigns)
AND

ISGEC Heavy Engineering Ltd. an existing company under the Laws of India having its Registered
Office at Yamunanagar, 135001 (Haryana) India and an Administrative Office at, A-4, Sector-24,
Noida-201 301 (U.P.) India (hereinafter referred as “CONTRACTOR”/ “Second Party”, which
expression shall, unless repugnant to the context or meaning thereof, include its legal
representatives, successors and assigns).

WHEREAS the EMPLOYER and the CONTRACTOR had signed and executed a Contract Dated 13th
October 2016 for Design, Manufacturing & Supply of 6000 TCD Sugar Plant along with 22 MW
Cogeneration Power Plant including Supervision of Erection and Commissioning thereof and other
Scope as detailed in the Technical Specifications and other documents annexed to the said Contract
on the Terms and Conditions as detailed therein.

AND WHEREAS the parties to the Contract had inter-alia agreed Time for Completion to be 18
(Eighteen) months from the Effective Date of the Contract.

AND WHEREAS subsequently certain delays occurred at the end of EMPLOYER which entitled the
CONTRACTOR to suitable extension in Time for Completion and accordingly CONTRACTOR had
requested for time extension to the EMPLOYER who after due consideration of the request of the
CONTRACTOR has agreed vide its email dated 27.05.2017 to grant time extension for completion of
shipments of the Machinery and Equipment up to 30th June 2018.
 NOW THERFORE IT IS AGREED AS UNDER:

1. The Time for Completion as mentioned in Clause 6.1 of Contract is extended up to 30th June 2018 for
the shipments of the Machinery and Equipments on CIF Panjang Port (INCOTERMS 2010) for the
6000 TCD Sugar Plant along with 22 MW Cogeneration Power Plant. This is however, subject to
timely fulfillment of the Obligations by the EMPLOYER and Force Majeure.

2. Subject to above Amendment all other terms of the Original Contract dated 13th October 2016

remain unaltered.

IN WITNESS WHEREOF the respective parties have signed this amendment of the Contract on the
______th day of June 2017 through their duly authorized signatories.
