MOTION FOR POSTPONEMENT

The undersigned counsel for the accused respectfully prays for Postponement of Hearing
in the above-entitled case and respectfully manifests that:

1. That he received the Notice of Hearing for Promulgation of Decision dated January 18,
2014 on January 23, 2014;

2. That in the said Notice, the promulgation of the decision is set on February 04, 2014, 9
o’clock in the morning;

3. Unfortunately, counsel cannot appear on such date and time as he had earlier committed
himself to appear before the Regional Trial Court of La Trinidad, Benguet, Branch 8, in
the following cases:
a. PP vs. Annie Batumbakal, Crim. Case No. 12888-R

For: Homicide; and

b. PP vs. Annie Batumbakal, Crim. Case No. 12889-R

For: Frustrated Homicide

Hence, this motion;

4. That counsel will be available on February 06, 2014 at 8:30 o’clock in the morning;

5. That this motion is not interposed to delay the proceedings of the case but due solely for
the reason aforecited and that counsel offers his sincerest apology.

PRAYER

WHEREFORE, premises considered, it is respectfully prayed of this Honorable Court to

grant this motion and that the scheduled hearing on February 04, 2014 be cancelled and reset to
February 06, 2014 at 8:30 o’clock in the morning.

A General Relief is likewise prayed for.
