AGREEMENT TO SELL

This AGREEMENT made this 15th day of May 2015 by and


between:-
1- Joshua Khurshid Alam son of Khurshid Alam Rath Jang,
Resident of 466 West Holly Avenue, Pitman New Jersy, United
States of America, bearing CNIC No._______________,
(hereinafter called the vendor) of the one part.
AND
2- Zafar Iqbal son of Nosher Khan, (CNIC No._________________,
resident of Chak No.40/3-R, Tehsil & District Okara 541-
Askari-9, Zarar Shaheed Road, Lahore Cantt, Lahore,
(hereinafter called the vendee) of the other part.
WHEREBY the parties hereto mutually agree as follows:

1. The vendor will sell and the purchaser will buy all that
is contained in land measuring 32-Kanals 9-marlas
described below the rights belonging or appurtenant
thereto.
2. The vendor is exclusive owner through succession all
that is land measurin32-Kanals 9-Marlas situate in
Square No.33, Khewat No.69/3, Khatoni Nos. 206 to
214, Chak No.46/RB, Tehsil Sangla Hill, District
Nankana Sahib and is also in possession of the said
land.
3. The vendor has assured the vendee/purchaser that
the land is free from all and every type of
encumbrances, disparities, litigation etc and the
vendor has full, complete and undisputable title in
land described above and also that vendor is perfectly
vesting with full title to convey in the said land t the
vendee/purchaser.
4. The vendor entered into an oral agreement with the
vendee/purchaser on 4th of March 2015 for sale of the
land described above for total consideration of $ 64000
US Dollars. Out of aforesaid total consideration settled
between the parties to this deed $ 17000 US Dollars
were paid to the vendor through banking transaction
detailed below and $ 15000 US Dollars were paid in
cash:-
i. $ 4000 US Dollars paid through cashier’s cheque
No.755472 dated 04.03.2015 in favour of the
vendor issued by Nabila Nasir;
ii. $ 6000 US Dollars paid through cashier’s cheque
No.1509501253 dated 04.03.2015 in favour of
vendor issued by Hassan;
iii. $ 7000 US Dollars paid through cashier’s cheque
No.1509501254 dated 04.03.2014 in favour of
vendor issued by Medha Kumar;
As ________ integral part of sale transaction of land
in question between the parties. The vendor also
executed General Power of Attorney in favour of
vendee which deed was registered as document
No.35. Bahi No.4, Volume No.15 on 18.03.2015, in
the office of Sub Registrar, Sangla Hill. Cash
payment of $ 32000 US Dollars was also received by
the vendor through Ch. Kasim and Mt. Tariq
________________________.
5. The parties to this deed of agreement have settled to
execute agreement to evidence the sale of the land and
payment of consideration and also the execution of
General Power of Attorney in favour of the vendee.
6. The vendee today received the remaining consideration
of $15000-US Dollars from the vendee thereby
acknowledging the receipt of full consideration in the
presence of marginal witnesses of this deed of
agreement to sell. As the vendor has sold the land in
question and has received consideration, therefore
Power of Attorney already executed by him and duly
registered as document No.35, Bahi No.4, Volume
No.15 dated 18.03.2015 is irrevocable Power of
Attorney.
7. The earlier agreement is an integral part of this
transaction of land in question between the parties.
Earlier to the execution of this agreement to sell the
vendor had executed a deed of General Power of
Attorney in favour of Abaidia Abun registered as
document No.122, Bahi No.9, dated 1.12.2010 with
Sub Registrar Sangla Hill which has been cancelled
thrugh Cancellation Deed No.22 Bahi No.4, registered
on 07.03.2015 before the Sub Registrar Sangla Hill.
Any agreement or other documents executed by the
said Attorney under the authority of said deed of
Attorney are illegal, void and inoperative qua the rights
and title of the vendor.
8. All expenses of preparation of sale deed and cost of
stamps and registration charges shall be borne by the
purchaser.

and subscribed their respective hands on this document on
the day, month, year and place here-in-above mentioned.
