Employment Standards Assignment

1. What is the Employment Standards Act?


An act that ensures all employees receive the basic standards of compensation and conditions of employment,
promoting fair treatment, encouraging open communication, providing fair and efficient procedures, and assisting
employees to fulfill their responsibilities.
 Who is not covered by this act?
Employees excluded by regulation
2. Minimum Wage:
 Are there two minimum wages? Explain. What are the new minimum wages going to be?
Yes, because it is being increased. The new minimum wages:
September 15, 2016 - $10.85 per hour;

September 15, 2017 - $11.35 per hour;

June 1, 2018 - $12.65 per hour.

3. Minimum Daily Pay:


 What is the minimum amount of hours that you are paid if you show up for work, even if the boss sends you
home?
4 hours

 You are scheduled to work an 8-hour shift then the boss asks you to work another 2 hours. How many hours must
s/he pay you for?
3 hours

 You show up for work and work 1 hour before a power failure happens so the boss sends the entire staff home.
How many hours must the boss pay each employee for the day?

 How many times a month must your boss pay you?
At least twice a month
4. Work Breaks:
 How often does an employer have to give you a 30 minute meal break?

 You were paid for the months of January on the 3rd and 18th and for February on the 10th and 14th. Is the

Yes they are, because it’s still twice a month and there is no mention of preset pay periods

 You work in a restaurant where you are required to wear tan coloured pants, a black collared shirt, belt and casual
shoes. Who is responsible for supplying the outfit? Explain
Myself, because the clothing is not a uniform for the restaurant because there are no specific brands/logos on
them

 You work at a golf course and are required to wear a white shirt with the company logo on it. You must also wear
dark coloured pants or skirt. Who is responsible for supplying the outfit? Cleaning it? Explain.
The golf company must supply and clean the shirt with the logo because it is product of the company and a
specific ‘uniform’. The pants and skirt are not proper ‘uniform’ because they do not have logos and have general
requirements.

8. Deductions:
 What deductions must you pay (or have come off your cheque)?
Federal income tax
 What deductions are optional (your choice) to have come off your pay cheque? Provide examples.
Employee benefits (ex health insurance, dental insurance) , retirement plan contributions
9. Statutory Holidays:
 What are the two (2) conditions that you must meet in order to be paid for a statutory holiday?
Worked or earned wages for 15 of the 30 calendar days preceding the holiday
Worked under an averaging agreement at any time within that 30 day period

10. Leaving the Job:


 Do you have to give your employer advance notice that you are quitting your job?
No, but it’s customary to give a two week’s notice to be polite
 Why would it be a good idea to let them know?
They will have a better impression of you, since they will have time to be prepared for your leave and scout for
someone else to fill your position. If you resign without notice, they will likely have to scramble to find someone
to replace you and that will leave a bad impression of you, which is bad if you need them for reference

 What does being laid off mean?


Being asked to leave because the company/employer no longer needs you to fulfill your position. Ex. could be
caused by more advanced tech that stole your job.
 When would you get terminated?
after at least two week’s notice and two week’s regular wages
 What are some reasons that an employer can fire you? Does the employer have to give you notice that you are
being fired?
They don’t need to give you notice or even give you a reason, unless you’re covered by a bargaining agreement or
employment contract
Some reasons include: damaging equipment or property, drug or alcohol possession at work, misconduct,
falsifying company records, poor performance, stealing
 If you are fired how long does the employer have before s/he must pay all your wages?
48 hours
 What is a Record of Employment (ROE)?
A form given to employee by employer that determines the amount of benefits you can receive from Employment
Insurance. It states how long you worked, how much you earned, and why you left

11. Vacation Information:


 You just started a full time job so how many weeks of holidays will you be entitled to in your first year?

12. Protecting your rights:


 Why is it a good idea to record the date, time and details of an incident that may have occurred at your work?
This way you have proof that certain events happened, which can protect you, protect others, or expose others if
there has been misconduct or any other sort of inappropriate behavior such as stealing, vandalizing, etc

 Why do you think it would be a good idea to keep a record of the days and hours you have worked?
This way you can double-check and ensure that you have been paid the right amount of money for the right
amount of time you have worked. Also you can ensure that you are working a legal amount of time/frequency

13. Explain why it is your responsibility to know your rights as a worker.


It is my responsibility because others may not know or care about my rights, in which case there would be no one to
ensure I am being treated fairly. If I know my own rights, I am able to assess the situation for myself and ensure that I
am treated the way I am supposed to be without relying on others’ knowledge of my rights
