Deleqation of oower as per Section 23 (5) to the Pradeshiva Sabha Areas

declared as a Development Area of the Urban Development Authoriw as
per Section 03 of Urban Development Authority Act No.41 of 1978
amended bv Act No.04 of 1982 and Act No.44 of 1984.

This is with reference to the Circular No. DDG (P)|il|fi dated 08.02.2017 on the above
subject.

From and out of the powers that were delegated to the Local Authorities and thereafter
taken over by the urban development Authority from the Local Authorities by the above
mentioned circular, power No.02 (iv) set out in the said circular is re-delegated to all
pradeshiya sabahs except, the Municipal Councils,Urban Councils, Core Area of Metro
Colombo Development Region and pradeshiya sabahs of Monaragala, Karachchi and
Maritimepattu in terms of the Board of Management decisions No. 19/2017,2I120I7,
2212017 dated 03.10.2017,02.II.20I7 and 21.11.2017 and on the order of the Hon.
Minister of Megapolis and Western development as follows,

i. As per Section 23 (5) of Urban Development Authority Act No,41 of 1978 amended
by Act No. 4 of 1982, the powers are hereby delegated with effect from 15th
December 2017 to all Municipal Councils, Urban Councils, Core Areas of Metro
Colombo Development Region and all Pradeshiya Sabha except Monaragala,
Karachchi and Maritimepattu to accept applications, process applications, charge
processing fee and grant approvals in respect of development and subdivision of
lands over 40 perches in extent (0.1 Hectare) and to accept the 10o/o extent of the
land area for the community and recreational activities and/or to charge 1Oolo of the
market value of the land subjected to such subdivisions, issuance of the Certificates
of Conformity, carry out all activities and take steps with regard to development and
maintenance of land and all incidental activities thereof in respect of developing such
lands over 1.0 Hectare in extent.
 ii. Moreover, it is hereby declared that all activities and functions executed in
reference to the power taken over on issuance of the Circular No.
DDG (P)/01/11 dated 08.02.2017 by this Authority remain vatid, come into
force, and exist continuously.

Fufther, it is notified that the Urban Development Authority has the right to retake the
above mentioned powers delegated as aforesaid.
