Dear Judge Brodie:

We write on behalf of Defendant United States Soccer Federation, Inc. (“U.S. Soccer”)
and Plaintiff North American Soccer League, LLC (“NASL”) to report on the parties’ meet and
confer regarding proceedings following the Second Circuit’s recent decision (see ECF No. 52)
affirming this Court’s order denying NASL’s motion for a preliminary injunction. ECF No. 49.

Plaintiff NASL filed its Complaint in this action on September 19, 2017, and moved for a
preliminary injunction on September 20, 2017. ECF Nos. 1, 3. Following briefing and oral
argument by the parties, this Court denied NASL’s motion for a preliminary injunction on
November 4, 2017. ECF No. 49. On November 5, NASL filed its Notice of Appeal of the
Court’s Order to the United States Court of Appeals for the Second Circuit. ECF No. 50. On
November 6, the Court vacated the previously ordered briefing schedule for U.S. Soccer’s
motion to dismiss NASL’s complaint, pending NASL’s appeal.

On February 23, 2018, the Second Circuit issued its decision affirming this Court’s
November 4, 2017 order denying NASL’s preliminary injunction. See ECF No. 52. On
February 28, the parties met and conferred regarding the district court proceedings, during which
call counsel for NASL stated that NASL may file an amended complaint. The parties agreed to
and now jointly propose the following briefing schedule related to NASL’s complaint or
amended complaint:

• NASL’s Amended Complaint (if filed): March 9, 2018


• U.S. Soccer’s Response to the Complaint or Amended Complaint: April 20, 2018
• NASL’s Opposition to any moving papers: May 25, 2018
• U.S. Soccer’s Reply in support of any moving papers: June 11, 2018
