House justice panel finds probable cause to impeach Sereno

VOTING 38-2, the House of
Representatives’ justice com-
mittee yesterday found probable
cause to impeach Chief Justice
Maria Lourdes Sereno.
Lawyer Larry Gadon’s im-
peachment complaint contains
four grounds: corruption, culpa-
ble violation of the Constitution,
betrayal of public trust and other
high crimes. The complaint also
alleged 27 acts constituting the
offenses charged against the
Chief Justice.
Oriental Mindoro Rep. Rey-
naldo Umali, committee chair-
man, said his panel marked
“another milestone” for the
first conduct of a full cycle in
the initiation of impeachment
proceedings from filing and re-
ferral, to determination of form,
substance, and grounds, and
eventually the determination of
probable cause.
Umali said the impeachment
complaint puts into question
Sereno’s fitness to continue
serving as head of the judiciary,
stressing that all its members
must be “a person of proven
competence, integrity, probity,
and independence.”

Mechanized Infantry Battalion bringing to a total of
129 guns that were turned over to the authorities in this

Death Squad campaign that allegedly
saw at least 1,424 people murdered.
According to Sabio, that alone is enough
ground to establish a crime control
system that was instituted in Davao and
later, in the country.
Davao was allegedly run like by an
underworld-like or Mafia-like syndicate
that killed people on mere suspicion
-- again, mere suspicion -- of being
criminals with links to the drug trade.
Note that many of those killed were
poor people. According to Matobato, no
big-time and filthy rich drug lord was
ever targeted.
It allegedly all started with the
creation of “Lambada Boys” in 1988. It
was the now late broadcaster Jun Pala,
an erstwhile ally turned nemesis of the
then mayor Rodrigo Duterte, who sub-
sequently called it as the “Davao Death
Squad.” The popular radio commentator
was later killed in an ambush.
The ruthlessness of the DDS can
be seen on Youtube where Matobato’s
criminal past has been made public. Ma-
tobato himself admitted killing at least

Alas, Duterte and whoever has been
offering him stupid advise on this matter
are utterly wrong if they think they can
actually humiliate or totally prevent any
journalist or media outfit worthy of the
name from covering what are clearly
events of utmost public interest and
importance. As the saying goes, there are
more than one ways to skin a cat. But
this show of vindictiveness is not just
pathetically childish, more worrisome is
it shows Duterte’s penchant for taking
shortcuts in a case that is still pending
before the courts. In short, it betrays his
lack of respect for democratic institutions
and processes.
We see no need to urge Rappler and
Ms Ranada to stand firm for they have
from the get-go. But we do reiterate our
total support for them as they persist
in carrying out their task of informing
the public despite this government’s
damnedest efforts to shut them down. We
urge all independent journalists to close
ranks and stand with Rappler in refusing

stamped by a local source, hence the
sequence is month-date-year, but also
because there is no 022 in the calendar.
Then I went to the cashier to pay
the goods in the basket. I specifically
kept an eye on the price of the parme-
san cheese that I handed to the cashier
because of a similar incident that I
experienced in that supermarket a few
days ago.

The business
of corruption
SIMPLY put, bureaucrat-capitalism is
the practice of using the official ca-
pacity or authority of a public official
for his or her private
financial gain, by way
of doing some kind
of business activity.
In other words, bu-
reaucrat-capitalism is
simply and plainly
just capitalism, but
with the other extra Ike Señeres
layer of bureaucrat-
ic influence. Mind you, this is not just
simple graft and corruption that usually
happens on a per transaction only. This
is more than simple graft and corruption
because its economic life could extend
for many years, up until the time that the
official loses his or her position by way
of removal, resignation or retirement. To
understand what bureaucrat-capitalism
really is, we should also understand what
graft and corruption really is.
Nowadays, we seem to hear a lot
about corruption only as a general term,
and not about the combined term that is
graft and corruption. As it is supposed to
be, there is no graft if there is no cor-
ruption, because corruption is the cause
of graft. In that sense, it is therefore
wrong to say that there is no poor people
if there are no corrupt people, because
there will always be corrupt people for
as long as graft practices would make
them prosper. We have to be careful
about believing these misleading slo-
gans. Another example is the saying
that God will pity you if you work hard,
because the truth is, God will give you
his grace even if you do not deserve it,
even if you do nothing to earn it.
In theory, graft is the consequence of
corruption, because graft is committed
when someone corrupts a public official
one way or the other. Perhaps to drama-
tize the proper sequence, we should use
the term “corruption and graft”. This
discussion about corruption and graft
is however irrelevant when it comes to
bureaucrat-capitalism, because bureau-
crat-capitalism could happen even if
there is no corruption, and as a matter of
fact, it would even be difficult to prove
that a public official has committed
graft in the first place, because he may
not have stolen from the public coffers
at all, having made his or her money
from businesses that may have pros-
pered because of his official capacity or
authority.
Well, it is one thing to make money
from a business that prospers because
of official capacity or authority, in the
sense that it is a legitimate enterprise. It
is another thing however to make money
from “selling” approvals of government
contracts, or “selling” the outcome of
court cases. Under normal conditions,
a public official who is prone to com-
mitting graft would often ask what it is
for him if he influences the approvals or
outcomes. The way to answer him if he
or she asks is that he or she does not de-
serve anything, because it is his business
to deliver public services for the public
good, and not to conduct his own private
business for his personal gain.
I have heard stories about justice for
sale, as it happens when prosecutors and
judges would connive to influence the
outcomes of court decisions. I have also
heard stories about young idealistic law-
yers who resign from the big law firms,
after discovering that cases are no longer
decided because of monies, and not
because of merits. Add to that the reality
that many cases are now being decided

however agree to give cash
or in kind if and when they
are solicited, meaning if the
public official would be the
one to ask for a bribe. The
reason for that is a Christian
businessman has the duty
to feed his family and the
families of their employees.
In this equation however, the
Christian businessman is not
corrupting the public official
but in the final analysis, the
public official still ends up
committing graft. No, I am not
condoning small time graft
and corruption, but it seems to
me that bureaucrat-capitalism
is an even bigger problem.

Armm helps fisherfolk back on their feet

MALUSO, Basilan — Ab-
dulham Mohammad, 48,
remembers the good old
days of the fishing industry
of Maluso town in Basilan.
“Noon, pusit lang ang
hinuhuli ko, kumikita ako
ng P500-P5,000 kada
araw,” he said, adding
that most fishermen would
not even reach the market
since barter was already
being done along the way.
“Hindi na namin kai-
la-ngan magpunta ng
palengke dahil sinasalu-
bong nanila kami noon
para makipag barter,” he
recalled.
But commercial fishing
vessels have encroached on
their fishing grounds.
“Nagsimula ang
pro-blema dito sa amin
noong unti-unting pu-
masok ang mga vessels
sa municipal waters kung
saan nananagat ang mga
small-time fishermen,” he
said.
“Dahil malalaki ang
gamit nila, talo ang mga
maliliit hanggang sa nalul-
ugi sila at unti-unting bine-
benta ang mga kabu-hayan
nila,” he added.
Mohammad, however,
said the Armm government
stepped in, helping their
community by providing
fishing supplies, including
boats and fishing nets.
“Ngayon, unti-unti
nang nanunumbalik ang
sigla ng pangingisda da-
hil suportado ng Armm
ang aming kabuhayan,”
he said.
“Ngayong nagtatra-ba-
ho na ako sa munisipyo,
nakikita ko ang efforts ng
ating gobyerno para sa
Maluso,” he said.
Armm Governor Mujiv
Hataman said “historically,
Maluso (is) a fishing port.”
“Lahat ng isda papun-
tang Zamboanga at Isabela
(in Basilan) ay nagmumula
sa Maluso,” he said.
Hataman vowed that
his administration will
intensify its efforts in pro-
tecting the local fisherfolk.

municipal waters be made

aside from efforts to help the
fisherfolk, the Armm gover-

administration’s plan to help

RATE of the central bank’s Term
Deposit Facility (TDF) rose
across-the-board Wednesday,
with tenders rising above the of-
fering for all three tenors.
Data released by the Bang-
ko Sentral ng Pilipinas (BSP)
showed that rate of the seven-
day facility improved to 3.1767
percent from last week’s 3.0685
percent.
Bid coverage ratio also in-
creased to 1.6005 from 0.8750 last
week after banks submitted a total
of P80.026 billion worth of bids,
up from the P50 billion offering
and the P43.751 billion last week.
The auction committee award-
ed P50 billion for the facility.
Rate of the 14-day facility rose
to 3.1674 percent from 3.0984
percent last week.
Tenders reached P43.310 bil-
lion, higher than the P40 billion
offering, which was awarded in
full this week.
Bid coverage ratio, on the other
hand, declined to 1.0828 from last
week’s 1.1124 since bids for this
week’s auction was lower than
the P44.497 billion last week.
Rate of the 28-day facility went
up to 3.2627 percent from last
week’s 3.1665 percent.
Bid coverage ratio also went
down and ended at 1.1760 from
1.4440 last week after tenders
reached P23.520 billion, higher
than the P20 billion offering but

capital spending of $380 million
this year after ending 2017 with a
seven-percent increase in profit.
In a disclosure to the Philip-
pine Stock Exchange, ICTSI
said this year’s capital expendi-
ture budget would be mainly
allocated for the capacity expan-
sion in its terminal operations in
Manila, Mexico and Iraq.
The company said it would
also finance the completion of
its new barge terminal project
in Cavite City, Philippines, the
continuing rehabilitation and
development of its container
terminal in Honduras, and pro-
curement of additional equip-
ment and minor infrastructure
works in its newly acquired ter-
fering (IPO).
DMWAI plans to offer up to
679.2 million shares, or about
20 percent of its total issued
shares, proceeds of which will
be used to further expand its
real estate development foot-
print through a mix of commer-
deal with the four countries,
which made up the European
Free Trade Association (EFTA),
is a welcome development as
this is in line with President
Rodrigo Duterte’s thrust to im-
prove economic relations with
non-traditional trade partners.
On Monday, the upper house
approved the Philippines-EFTA
FTA.
The company aims to trans-
form three others: the Iloilo
International Airport, Bacolod-
Silay Airport and New Bohol
International Airport in Panglao
into world-class airports.
The first three are already

rhetoric question of the title.
As the vast majority of res-
idents in the country, I have
to endure everyday situations
that usually do not occur or

tiently endure these situations

repetition of these situations

can claim their rights against

companies that consider us
simply as buyers without any
rights.
The odyssey of my jour-
